Brooklyn, NY – Williamsburg Man Pins Hopes On Dashcam In Traffic Stop

    The 31 year old Williamsburg man was driving from a job site to the Brooklyn Queens Expressway on Mar. 27, 2014 when the incident occurredBrooklyn, NY – A Williamsburg man who claims he was wrongfully ticketed by the NYPD is hoping that a video camera that he installed inside his vehicle will prove his innocence when he gets his day in traffic court.

    The 31 year old man, who asked to be identified only as Abe out of fear of retribution by the NYPD, was driving from a job site to the Brooklyn Queens Expressway on Thursday morning when the incident occurred, as originally reported on CBS News.

    “I was on Metropolitan and was making the left onto Marcy on my way to the ramp to the BQE,” Abe told VIN News. “I made the left onto Marcy and about half a block in I see the cop stopping me. I was wondering what happened. I didn’t have a cell phone, I was wearing my seatbelt and wasn’t speeding. I thought maybe it was a checkpoint.”

    The police officer demanded Abe’s license and registration, informing him that he had made a left turn from an improper lane.

    “How could he see from half a block away which lane I was in?” asked Abe. “You can even see in the video, he had already stopped a small black car before me. He jumped away from that car to stop me and after that, he stopped another car, all in the same five minutes and took all our licenses and registration. It was impossible for that officer, who wasn’t in the intersection, to see what happened.”

    Abe acknowledged that perhaps the officer had confused his vehicle with another black minivan that was at the same intersection and was about to make the left turn from the wrong lane, but instead, continued straight on Metropolitan Avenue. Abe, who says he has a clean record with the DMV, drives a 2013 black Toyota Sienna.

    Abe advised the police officer that the entire exchange was being recorded. After the incident transpired, he took the opportunity to view the footage recorded by his dashcam.

    “I am always careful but when he pulled me over I wasn’t 100 percent sure of what had happened,” said Abe. “When I came back to the office, I saw I was actually right.”

    As someone who spends a lot of time on the road going from one job site to another, Abe considered the dashcam to be a worthwhile investment.

    “I have a lot of friends who complain about getting tickets they didn’t deserve,” explained Abe. “One friend said he was leaning on his hand and got ticketed for using a cell phone, when he wasn’t. Another one got a ticket for not putting on his blinking light. When a co-worker bought this camera, which was not expensive, I decided to get one too. It’s good not only for traffic violations but also in the case of an accident when sometimes you say one thing happened and the other guy says something else. This way I have proof.”

    Retired NYPD detective sergeant and John Jay College professor Joseph Giacalone told CBS that having the footage would definitely be a point in Abe’s favor.

    “Having something on video surveillance would definitely help your case,” Giacalone said.

    Giacalone said more personal dashcams are out there as they become more affordable.

    “New technology is changing not only the way police do surveillance, but also the way the public does surveillance of the police,” he said.

    Abe called the 90th precinct to complain about the $138 ticket, which carries with it a three point penalty, and has also filed a complaint with the Internal Affairs Division.

    Community leader Isaac Abraham said that traffic stops such as this one are common within the 90th precinct and that he is contemplating a class action suit against, saying that he has proof of further violations by police officers. Abraham also is urging drivers to install camera’s in their vehicles to record.

    It is unclear at this time if the officer who pulled Abe over is employed by the 90th precinct, or is a traffic enforcement agent.

    Ye these crazy cops, I got 2 cellphone tickets in 1 month, both when u was a 100% innocent, its just that I have no proof

    Abe is clearly innocent. Maybe this illiterate cop confused him with the van that tried cutting in front of Abe but then changed his mind at the last minute when he saw this cop waiting in ambush.

    this device come with a GPS device ,inside camera, and speed monitor, so almost every ticket you could prove in court

    I know Abraham very well, he is a cautious driver, and an amazing person as well, always ready to help out another human being. May he have success in getting this ticket dismissed.

    i was also stopped by the same cop in wiilwamsburg for a seat-belt violation back in September on Bedford cor wilson st. and i too was wearing seat belt at the time. i was car #3 in a 30 minute ticket blits. i clearly remember being very upset and i parked my car down the block to whiteness this rouge cop. so soon car # 4 was next! a yingerman stopped for cell phone use the guy told me he was talking on bluetooth that automatically comes on in his car, and the cop still gave him a violation. my court date is this coming april. for some reason the cop keeps on pushing it off. now i know why! i told him then that he is lying and i have a camera and i will use it against him in court (i don’t have one!) his reply was “do what ever the f…. u want” i hope this will cause this criminal cop to be disciplined

    No doubt this was end of the month quota for tickets being attained (note other car already stopped and cops standing in middle of the street to pull this guy over).

    There is NO WAY they could have seen what lane he was in, due to their perpendicular angle to his position.

    When the words of the police are taken as fact and one needs to PROVE their innocence – you know you are in a police state. If this man did not have a camera, what judge would even listen to his claim?

    With all the corruption that we see, it’s high time for cops to be held to a standard 10x higher than an average civilian for lying / falsifying reports. Their word is clearly no more valuable than any other average citizen, all the more so when they clearly have motive. A ticket given falsely should mean jail and immediate job loss. Completely unacceptable!

    He’s CLEARLY in the left lane. It could be the cop was blinded and possibly thought the other guy made the turn and was him. That being said he WILL beat the ticket but LOSE work time from it.

    drivers beware: police are pulling over drivers for failing to yield to pedestrians. This is harder then you think. Pedestrians crossing directly at your line of vision you can see. But if your a drop into the intersection its very difficult to see over your shoulder on your turning side.

    sometimes they think the average person will pay the ticket rather than take a day off to fight it in court.
    if you are innocent, go to court and fight the ticket.
    the judge will see a pattern of people proving their innocence with specific cops and they will lose their credibility.

    I had a similar story in the mountains this past summer. I got a false ticket in south fallsburg for passing a red light. I know 100% that I didn’t. I mailed back my ticket & wrote not quilty. By the comments, I wrote that they can even check on police car if he has a dashcam hopefully, cuz I don’t have anything to hide,’as im fully confident that i’m inmocent. They didn’t wave the ticket, & I don’t mind going on trial. I know that I can go to court & have the ticket reduced to a no point ticket if I plead quilty, but will still have to pay a fee. But i don’t feel like paying a cent for an offense i never did! I was surprised when a lawyer told me that we civilians are not innocent till proven quilty, cuz a policeman is considered proof to them. This really is unfair because than a police can give wrongful tickets anytime, & they get away with it. what can I do about my ticket? & what can everyone do about this common problem? Also, is there anyone to talk to about this re my ticket? Was the internal affairs division of any help? If so what is their tel # please.

    I got a false ticket from this same corrupt cop when I was making a right from Engert onto McGuiness en route to the bqe(which I needed to because there was construction on Nassau). The officer told me there was a sign “just put up today”. I never went back to check but from the way this shmuck was pulling over every second car I figured he’s just making his Bloomberg quota… ie stop every late model car that the jealous dunkin donuts jlobs are happy to ticket and fill city coffers with benefit goodies so they can retire at 45.

    i sold like 60 dash cams and they are the same that Hatzolah in NYC uses in thier Ambulnace its the ADR3000 i sold them for 290 and its on ebay the cheapest price u could get it is 395.00 if i have 20 people that want them i could order more as they come from korea and the shipping and i have to prepay for them

    That video was so clear and u handled urself well!! First he could only have seen the lane u were in at the last moment. U appear to b a cautious driver. The judge will throw out immediately. He definitely confused u with the black car to the right. U told him u were in the turning lane. The shame is for all those who don’t have a camera. What’s the name of that camera? Quality excellent!!

    This is newsworthy and the entire community (whoever has had issues with this officer) should get together. The CCRB as well as IAB, perhaps even DOI would love to hear from you.
