Kiryas Joel, NY – Man Arrested For Sexual Misconduct With Teen Boy

    Kirays Joel, NY – The New York State Police in Monroe arrested a Kiryas Joel Man for sexual misconduct with an underage teen.

    In its Press Release Police said that 27 year old Joel Mendlowitz had been involved in a sexual relationship with a 15 year old boy, also from Kiryas Joel, since October of 2013.

    The boy’s father found evidence of the relationship and reported it to the State Police.

    Mendlowitz was released pending an August 7, 2014 appearance in the Town of Monroe Court.

    My question is that lets assume that this person is NOT guilty of this crime or maybe he is guilty, isnt posting him on VIN news Malbim pnei chaveroy berabim, Rechiles, Loshon Hora, Shefiches Dumin..?
    Is a yiddishe site allowed to report this type of news and embarras this person,his wife and children in public.?
    I am only asking and would like to hear from a Torahdige view..
    Rosh Chodesh Elul is only 24 days away and very soon we all will be Klapping Al Chyte….Maybe its time to review what NEWS is fit to POST..

    he is released with out bail, how come you report it? its malbin pnei chveiro berabim there is no heter to report this berabim, the police knows about it, the court will handle it,

    I am happy that the man has been arrested and that the father of the boy did not just shut up. I hope he is not discriminated against in his community.
    However, it is halachally questionable if the name of the perpetrator should be published at this point.
    Perhaps he is innocent and this is smearing his name OR perhaps others who he has molested will come forward to press charges.

    To all those who complain : I have a kid otd is worst than death and thanks to child molesters it causes them to leave the derech since they suffer emotionally and have a type of nervous breakdown !!!! Yes finally now the victims can come forward be believed and stop the abusers

    Everyone is innocent until proven guilty . There is no source for permitting embarrassing people brabim to deter future crimes. This is completely forbidden according to everyone. Anyone can accuse you of anything and then you immediately become a defendant. I am sorry that digression was not used here. Very Sad.

    It is unspeakable how bad it is that children have been intentionally harmed.

    This is NO JUSTIFICATION to Name someone publicly based on an accusation ∨ arrest. It is 100% forbidden and like shfichas domim, and YEHAROG VE’AL YA’AVOR (see Tosfos, Sotah daf 10b, top of the daf).

    There are two aspects in Halochoh that clarify this…

    The first is:
    Even if it was proven that someone G-d forbid harmed a child in the past, they are not Halochically considered a rodef unless they are literally “on their way” to harm again (such as before authorities are involved). Once police and courts are involved (i.e. the person got “caught”) such a person is now not likely to continue harming and may very well no longer be a rodef.

    You may disagree, but this second reason all agree to:
    Being under suspicion or having been accused of redifoh does not make someone a rodef. The POSSIBLE risk to another child does not outweigh the DEFINITE “shfichas domim” to the family of someone ONLY accused and the possibly a 100% innocent person!!!

    Because people are emotional about the harm of children does not give them the license to disregard Halochoh or be megaleh Torah shelo keHalochoh!
