Ashkelon, Israel - The violent murder of Ziona Samin, 62, a prominent rabbi’s wife who was found dead after having been allegedly strangled during a robbery in her home, is now accompanied by a difficult legal struggle and the Orthodox community’s revolt.
Rabbi Samin, head of the Yemenite congregation in Ashkelon, found his wife tied and beaten on the floor of their home.

The court received the State Prosecutor’s Office demand to carry out an autopsy, which was followed by the family’s objection and a petition to the High Court of Justice filed by ZAKA members and a political official.
An Orthodox crowd protested the request for the autopsy and blocked Bar Ilan Street in Jerusalem using trash cans, and also hurled stones at a police car driving on Shivtei Yisrael Street in town.

In a hearing held at the Magistrate’s Court in Ashkelon, Rabbi Samin asked to make do with an external examination of the body and release it for burial. According to him, his wife did not die of the flu or any internal disease. However, the Southern District prosecutor, attorney Yiska Leibovitz demanded the body undergo a postmortem.

Judge Dina Cohen decided to wait until the opinion of Prof. Yehuda Hiss, after the report was received, the judge determined that there was room to conduct an autopsy on the body.

In response, ZAKA’s pro bono attorney Dror Schussheim petitioned The High Court to overrule the verdict. Meanwhile, political officials, including Shas Chairman Eli Yishai, are working on the case. Yishai approached Internal Security Minister Avi Dichter and Police Commissioner Dudi Cohen as well as other sources.

Samin’s family members were upset at the judge’s ruling and the prosecutor’s insistence. “The funeral date has been postponed three times already,” Samin’s son-in-law Tal-Or Atari said. “Rabbi Samin is caving under the pressure of the events and has had to be treated.
“As an Orthodox family, we firmly object to any postmortem and abashment of the deceased’s honor. The Halacha strictly forbids us from doing so, and the family feels like Rebbetzin Samin is being murdered twice,” said Atari.

“All of the findings indicate (death by) strangulation. The prosecution wishes to operate on the body only to rule out any other death causes, should they catch the murderers. This is not a good enough reason to disrespect the dead,” Samin’s son-in-law concluded.

Reports that ZAKA and Police came to an agreement that the body will be transferred to Jerusalem Hadasah Hospital and only undergo an M.R.I. screening.

In Bnei Brak, police have arrested six Orthodox men for “smashing windshields and throwing rocks” during the demonstration.

The High Court of Justice has instructed a Jerusalem hospital to release the body of Ziona Samin, the wife of a prominent rabbi, so it can be buried. In this ruling, the judges rejected a demand by the State Prosecutor’s Office that the body undergo an autopsy, after the MRI revealed that she had been strangled.

    comments - arrow technically speaking (having been involved in such cases unfortunatley)strangulation though sometimes having visual signs around the neck area is very hard to establish and pinpoint cause of death w/o a post mortem.
    even a virtual autopsy can't pinpoint cause of death in cases of strangualtion .
    being this involves a crime here in USA we would also have a hard time fighting an autopsy even though here in usa we b"h have a govt that
    is simpathetic to religious objections and one can as well go before a judge to stop it in most cases

    comments - arrow An autopsy that is limited to gathering evidence required for prosecution is MUTTAR in Halacha. Gathering any other evidence is MUTTAR only to the extent of eliminating other cause of death. Gathering other tissue samples is USSER.
    This is long established procedure accepted in Israel and most Western countries - Why has this suddenly raised a riot?

    Every 'goy' knows that there are much less crimes by jews(of course there is some, but percetige wise its much lower),the statistics are very clear.

In any other country except the wonderful open democratic Zionist nation, the man would be sitting in jail. He said Oops! I'm sorry, and he didn't even lose his job, even though he's been stealing body parts for DECADES.

    On a technaical note, I believe lack of oxygen (strangulation) does something to the eyes and that's what they check for first for some type of cyonosis in the eyes. But it doesn't make a difference. If a person was found with a knife throught the heart they would still look for an excuse to do an autopsy, to make sure he wasn't strangled BEFORE the guy plunged as knife into his heart.

In this case there was irefutable evidence that the unfortunate Rebbitzen met her demise as a result of strangulation at the hands of a rusha. The MRI conclusively indicates the cause of death. I can not fathom why in Israel the government is making this unfortunate family suffer more & more. The only reason I see is that they are Shomer Shabbos. A Shomer Shabbos MD
