Spring Valley, NY – Yeshiva’s Lawsuit Against Town Of Ramapo Dismissed Due To Lack Of Evidence

    Mosdos Chofetz Chaim housing development (VINnews) Spring Valley, NY – For the second time in five years, a federal judge ruled that a yeshiva did not provide sufficient proof in its case of anti-Semitism against villages in the town of Ramapo.

    Mosdos Chofetz Chaim has had an almost 10-year long legal action against the villages of Pomona, Chestnut Ridge, Wesley Hills and Montebello, alleging they opposed a housing development based on anti-Hasidic sentiments, according to lohud (http://lohud.us/1xPEt1l).

    The yeshiva development includes 32 two-bedroom units and 28 four-bedroom units for students and their families.

    Chaim’s action accused the communities of incorporating as villages to block the expansion of Hasidic neighborhoods through restraining zoning. It also alleged that the the villages used environmental laws to shoot down the town of Ramapo’s adult student housing zone, and singled out the yeshiva’s housing and study center on Grandview Avenue.

    Rabbi Aryeh Zaks, his family and other supporters of Chaim claimed the villages worked together to strip the yeshiva of its civil and religious rights under the Constitution, and also under the Fair Housing Act. Chaim asked for $100 million in damages.

    U.S. District Judge Kenneth Karas stated in his 76-page decision that there was a lack of evidence of discrimination.

    Karas dismissed the yeshiva’s first legal action in 2010. The congregation then appealed.

    It is no Yeshiva, it is a housing project built through lies and deception. They had no permission to build the many structures that they did, they lied about people living in them and how many people were living in them. .When the neighbors make anti-Semetic statements it is over poor behavior by supposedly “Frum” people like whoever is making the money on this fraud.

    What a beautiful bais medrash they have full of yungerleit siting and learning. I feel terrible that they couldn’t prove what we all know about the rampant anti semitisem going on in ramapo. That the judge also agreed was true I hope they appeal and justice prevails!!!!

    I couldn’t agree more! Gorgeous building! I don’t know why people fought against this place… looks like they don’t bother anyone and it’s always nice and clean.

    They should keep up the good work! The best kollel in the tri state area!!! Feel terrible that they lost.

    It really can be a case of residents unwilling to accept a grand building in an area town meant to be small and quiet.

    Strategically they are silly. Either way you cut it the area is going to be flooded with orthodox jews. Chofetz chaim type of jews are generally more secular than other perhps chaisidish type. If i were secualr I would want them in my nieghboorhood. I guess to them any black hat even if it goes with blue shirts( as in the case of chofetz chaim) is chassidish.

    I wonder why ramapo and the surroundng areas have such a heavy caseload of “antisemitism” and “anti-chassidish” lawsuits, incidents and legal actions. I wonder if the community itself is doing something to instigate it. If you don’t follow the rules, follow the law and/or try to help keep the area as it was (residential areas are not meant to have commercial properties!!!) It is no wonder that people are angry!!!
