New York – Orthodox Man Files Suit, Charges He Was Fired For Asking For Kosher Food

    In the nine page lawsuit filed on April 22nd in federal court, resident Robert Seidenberg charges that John Reinhardt, CEO of Fillmore Real Estate, fired Seidenberg for suggesting that kosher food should have been offered at a Fillmore-sponsored event run by the Brooklyn Board of Realtors in May, 2013.

    Fillmore allegedly began shouting, “You have some nerve to ask me a question about kosher food. We don’t need people like you at Fillmore,” in front of a group of witnesses including Seidenberg’s wife, Arleen Weisbrod, also a real estate agent. Seidenberg who had worked previously at Fillmore, had been employed with the agency for two years at the time of his termination, which he said came immediately after the event. While Seidenberg said he attempted to apologize for his remarks, he was notified approximately two weeks later that he had been dismissed because of his wife’s employment at a competing real estate firm, a violation of company rules that Seidenberg claimed he was never made aware of.

    In a VIN News interview, Reinhardt said Seidenberg approached him as he was preparing an introduction for the morning’s guest speaker, prominent motivational lecturer Steve Harney. According to Reinhardt, Harney, a sought after national speaker, waived his fee for the event in an event to recognize the efforts of area agents in the months following Hurricane Sandy.

    “Two minutes before I have to introduce Steve Harney to 350 people Bob comes up to me and asks to talk to me,” Reinhardt told VIN News. “I’m busy trying to memorize my speech and I ask him if it could wait until after my introduction and he says ‘No, it can’t wait we have to talk about it now. Don’t you think you should pay attention to the religious people?” I blew up at him. I was insulted he could say that to me because it is so far from the truth and there was kosher food the next table over.”

    Then-president of the Brooklyn Board of Realtors Rosalie Daniel confirmed that kosher food had been made available at the May 2013 event for all those who had requested it in advance.

    “Kosher food has always been arranged and has always been made available,” said Daniel.

    Reinhardt said that Weisbrod’s employment with Keller Williams had been a significant issue for him, but he let the matter slide as a favor to a sick neighbor who was related to Seidenberg, but that after the neighbor’s death he no longer had any reason to keep Seidenberg on.

    “His wife joined Keller Williams in Brooklyn and it isn’t good business for a husband and wife to be working for competing companies,” explained Reinhardt. “She is working for the competition, trying to beat us in our own market and we don’t allow that.”

    Seidenberg’s lawsuit noted that Reinhardt was aware of another Fillmore employee whose wife also works in the real estate business, for a different agency, but Reinhardt said that the two situations are vastly different.

    “She works in Long Island, in Commack,” said Reinhardt. “She isn’t competing with us.”

    Seidenberg’s lawsuit stated that he has lost commissions and referrals as a result of his firing from Fillmore and continues to suffer from “severe and lasting embarrassment, humiliation and anguish, and other incidental and consequential damages and expenses,” and claims that Reinhardt’s actions were malicious, intentionally injurious and violated his civil rights, entitling him to punitive damages.

    According to Reinhardt, this is Seidenberg’s second attempt to sue him for damages because of his firing from Fillmore, with the first lawsuit dismissed by the court. Seidenberg’s lawyer, Michael Ferch said he had no knowledge of any previous legal action and called the reason for Seidenberg’s dismissal “a thinly veiled excuse of anti-Semitism.”

    “My client and I stand by the allegations in the complaint and we are confident that the judicial system will continue to defend religious rights and anti-discrimination laws in the workplace,” said Ferch.

    Seidenberg, a 75 year old Sheepshead Bay resident, is suing both Fillmore Real Estate and John Reinhardt for racial discrimination in termination of employment in violation of the civil rights act of 1866, the New York State human rights law and the New York City administrative code. Seidenberg hopes to collect in excess of $3 million, plus all legal fees, if the court finds in his favor.

    We must always be on guard against thinly veiled anti-semitism but we must be even more on our guard against blatant bullying. In this case bullying and opportunism is clearly what is being used to try and get money from someone else’s’ pocket.

    Anyone 75 year old who pleads “other incidental and consequential damages and expenses,” and claims the Defendant’s actions were “malicious, intentionally injurious and violated his civil rights, entitling him to punitive damages” is a nobody with no real case looking to pad out his pension. Still at his age, at least statistically the “severe and lasting embarrassment, humiliation and anguish” won’t last too long. Male life expectancy in the USA is 75.96 and in New York a little longer at 77.80, so Bob just hang in there and bear the embarrassment, humiliation and anguish a little longer.

    Well yes of course they should have offered kosher food. But those yidden in corporate america please don’t get any ideas from this story. Don’t make your corporation crazy about kosher food. I attend many triefa coprorate events. Why make a tzimus over such small things. If they offer of course take it but please don’t make noise about it. Even if they don’t fire you they make think twice about hiring another fruma if you make their lives crazy

    Shame on you Robert Seidenberg! What are saying to Kol Yisrael Arevim Zeh Bazeh!
    At your age of age 75 and because of you being greedy for a little kosher meal/food you are causing hundreds observant Jews to not get hired by corporate America. I am insider I worked at various fortune 500 companies in the last 20 years at some IT positions I was also part of the interview panel where I had to give my opinion when to hire new candidates. We have enough issues with leaving early on Fridays etc. YOU have no idea how much damage greedy people like you are causing to other observant Jews. Just daven Mincha in one of the local places in Downtown Manhattan or count the number of kosher restaurants you could see that the number participants had only decreased in the last 10 years. WHY? I Know!

    This is a good lawsuit. Israel is not the panic button for the greedy. If we have rights to have our meals as can be safe for our faith, that is honor for the world. This is a good change for our people to see that our rights will be protected. Lets hope this suit has all merit and the future can be trusted for Jews to work in America and elsewhere.

    I dont know about this one. If he pestered him a minutes before his speach , I in his shoes before a speech would curse even more. let the court ddcide who was more crazy here or if this is baloneys or very very serious. If he is always ANTISHEMI , let more people sue now as we to proveNow I cant stand when jews are robbed or taken any advantage from or suffer shame violence in America and they are quiet KATZON LOTEVACH. It starts small and grows bigger until it becomes a bigger problem like france.

    My husband is a Chassidic Jew & worked at an Israeli-owned IT firm. Sometimes there was Kosher food (when the secretary remembered to ask him where he would like them to order in from) & often, not. He was a tad annoyed but never said a word – he drank his coke & as soon as he could he left.

    Now we are in Israel. He works for the same company here and he tells me that they accommodate him & the other frum Yidden as much as possible. Every morning there is fresh fruit, cakes, bagels & cookies for the staff – under badaatz Eida Chareidis. Everyone eats the food! He doesn’t eat the fruit as he’s not sure of the shmitta status.

    Point is – complaining about such a trivial thing is going to harm the employee. I am the last one to say back down, don’t make the goyim mad, but pick your battles! Is chowing down so important? Keep quiet, don’t make a fuss over something like this, and go home & have an extra piece of kugel. BTW – did anyone notice the report quoted the boss as saying there was Kosher food for those WHO PRE-REQUESTED IT.

    This lawsuit will be thrown out as well. It’s stupid & a chilul Hashem.
