Monroe, NY – Mount Kisco resident and land developer, Irving Bauer, 70, has found himself in the news again amidst the ongoing conflict to expand Kiryas Joel and make room for the still growing community, according to a story in the Times Herald Record (http://bit.ly/1MAefCF).

For nearly three decades, Bauer, a member of the Nitra sect, has owned approximately 70 acres of undeveloped land in Kiryas Joel, but he has refused to sell his 10 percent share of the total 691 acres, choosing instead to wait for the value of the land to increase.
In what has become a prolonged court case with Orange County, Bauer alleges that his sliver of property, located along Nininger Road across from the Monroe state police barracks, can accommodate over 1,000 new condos and is worth tens of millions of dollars. But in an earlier court case involving the property, an Orange County public health engineer testified that Bauer’s property is not worth nearly as much as he contends, saying that the “lack of adequate water supply is a predominate factor which cannot be disregarded.”
Orange County has already spent upwards of $500,000 in its dispute with Bauer about taking the land. The case is now pending in the Appellate Division. Bauer’s attorney would not reveal if, or how soon, his client intends to sell the property. “He is land-banking, confident that its value is increasing,” Gerald Orseck said. Bauer did not return calls left for him at either of his office locations.

We do practice capitalism in the US so what exactly is the issue – good for him! And what is the legal issue here that Orange County is fighting?

Bauer is a fine upstanding gentleman. The issue here is quite interesting. The local municipality wanted land to reconfigure the dangerous curve on the road and to do that they needed the land. They made him a low-ball offer which he refused and they went ahead and seized the land through Eminent Domain. He sued and his lawyers contend it’ was worth millions before they cut off that chunk while the town claims that without KJ’s anticipated water pipeline, the land is worthless.
