Joseph Stern says his neighborhood needs more housing â but he contends a planned 179-unit building will flood the area with traffic.
Brooklyn, NY - A band of Borough Park neighbors is suing to stop a developer from building an 8-story, 179-unit apartment complex in a lot that abuts private backyards.

The developer contends he’s following the law. Local residents acknowledge the need for more housing in the neighborhood, which has the city’s highest birthrate. But they argue that plans to include a bank and a 259-space public parking garage in the Dahill Road complex will add to traffic congestion in the neighborhood.

This project has recently been embroiled into a feuded argument at the recent primary elections, where some residents have claimed that Councilman Simcha Felder betrayed them because he voted to approve this project, and others said that Simcha was trying to help the community get affordable housing.

On what basis are the neighbors suing? If the developer followed the law, then a suit is nothing more than a stall tactic.
While no one likes such a project in their backyard, times and neighborhoods change. Live with it.

The main problem is not the traffic that 179 apt. The problem is that its a landlocked piece of property with no access point for school buses so all busses will have to wait on 50TH street to pick up the kids can you imagine @ 8:30am what gridlock there will be to get to Flatbush? But what can we do Felder needs campaign contributions

What a sham.

I think that 50th streets residence have every right to go up against this project just like any other neighborhood have rights.

We have a court for a reason!

BP is a unique place with no place to expand, for a developer to come in and bring their garbage into the area well he has every right so do the residence in the neighborhood have the right to oppose it by court of law.

I dont know what simcha Felder said or did not!

All I can say is that maybe he tried but wasen't successful at it..........

This apartment building is not being built for yidden. It is 8 stories high they are either 1 or two bedroom apartments. This builder is only interested in amking money he has no intrest in making more apartments available for the yidden in Boro Park The builder does not live in this area and he has Reb Simcha in his back pocket. Ask all the people who live in the area who own homes there people with large families who spent hard earned mony to buy these homes this building will destroy the neighborhood and the builder and his friend could not care less.

You can contribute to 50Th street neighborhood association 1915 50th street Brooklyn NY 11204 so far this lawsuit has cost around $ 70,000. Any amount will be greatly appreciated

The problem with this whole project is that everyone involved lied from the get go Felder, wydra & Brach.instead of coming to the community (as CB12 recommended) and addressing the concerns there would not be a law suit but when they asked for a through street for emergency veichles & all other traffic they didn't want to listen when we asked for a restrictive deed to guaretee that they will build only apts. Suitable for our community 4-5 bedroom apts they ignored instead gave that to UTA that would not enforce it so let's hope the Judge teaches them a lesson

I truly believe Simcha Felder was not honest on this issue or he didn't want to backtrack on a major mistake. This particular project is flawed. I my self need five apartments for my married children, but this project as is, is not the answer to our problem especially when you hurt so many neighbors. Al tho i myself live two blocks away from this project it will not personally affect me as i have a driveway. I myself would like to see some more commercial space in Boro Park rezoned to residential to help our problem.

So, if people don't want Jewish organizations to get variances for zoning, that's anti-semitism.

But if Jews don't want a building going up, that is just taking care of the character of the neighborhood?

If there are objections to a camp having bright lights and loud noises in a rural area, that's anti-Semitism (if it's a Jewish camp). But objections that a private builder isn't building 4-5 bedroom apartments are all about the neighborhood values.

Someone want to explain the logic to me here?

Its a simple fact that the reason this massive project was approved was cause Simcha Felder supported it and hes a good friend of the mayor.

Now, THIS IS NOT A KNOCK ON FELDER, but it can be said very fairly that the po-construction side had better representation than the anti-construction neighbors.

I have alot of respect for Mr stern -whom I dont know- for standing up for his rights.

Im following this case, I was by the hearings at CB12 and by the BSA. At the hearing Stern said he has a problem with having housing in his backyard now it boiled down to traffic.

What I heard is:
3, 4, 5, bedroom apartments
each one with a Pesach kitchen
each one with a porch for a succah
A mikveh in the building for the people living there
Each apartment gets a parking spot in the garage
The elevator goes upto the 7th floor
The 7th floor apartment is a duplex with the 8th floor
No stores, Hotels, Motels, Shopping Centers in this project

Regarding the safty problem:
There will be a street lane (not for cars) running through the property so Fire trucks have access to the whole building in case of an emergancy.
This road will be on the side of the back yards from 50th Street, so no one will be looking into 50th Street houses.

SO EXPLAIN HOW THIS DEVELOPMENT IS NOT BEING GEARED FOR US YIDEN.

Guys wake up a lot of lies were spread till now. Pashkevilin were thrown on innocent people for no reason, time to stop all the sinas chinam.

Boro Park needs more housing and we are getting it B"H.

if you want to fight this project, one must use logical arguments to fight it, traffic etc.

The other arguments are stupid and anti-Goy, I want yidden houses, or no bathing suits, you will get laughed out of court and become a laughing stock in the media and shown what you trurly are, racist.

If one wants to live in a closed community move to an enclosed community, or create one, or move to the a non urban area where the neighbors are not close by so you do not have to see them.

BTY, how does this sound, I do not want Jewish housing here, My children should no have to see people who kill little animals to wear a stupid hat.

It is the same argument just turned around. does it feel good? does it sound right?

Mr. Stern said at every hearing was that this project is literaly in his backyard with no real access for FDNY when there is a fire they drag the hoses through his house. When the CPC asked MR. Stern what he would be happy with which you didn't hear since you were at the BSA hearing he gave a reasonable alternative that would give them over 100 apts with fire accsess. But Felder called down a deputy mayor for a private meeting with the commisioner & basicaly threatend her to approve this zoning change

Traffic studies for this project were done during the summer. That's not honest. Felder heard the entire neighborhood, including the rabbonim oppose this project. The traffic would be horendous, and dangerous for the many children on their way to school. If the developers cared for the neighborhood, they would do something about the trash and trashy goings-on by the FDR high schoolers hanging out on their property

the high sky rocketing cost for rent in boro park williamsburgh is thanks to section 8 program, were if you have it you can pay - but if you go out to work and try to make it on your own you will live in a basement, get rid of the section 8 you will see how fast house prices will come crashing down and rent will stabilize because nobody will be able to afford the high priced rent.

get rid of section 8 that killed our real estate what do you think how do people that havent worked a day in their life buy a million dollar house? it has killed thousands of families that go out to work everyday - work hard to pay their rent they are forced to hand over their entire monthly paycheck to their landlord BECAUSE the guy sitting around and doing nothing gets to move in to a beautiful home nice kitchen etc paid for by the goverment.

Get rid of section 8 so those hard working people can afford to buy a house and those not working build them projects and put them there let the working class get something they DESERVE IT.

Oh after we get rid of the program you will find out that brick are not so expensive anymore sheet rock is not so expensive anymore etc.

This is not a traffic issue like 13th Ave there is no way u can dump 179 apts. In a backyard, yes its a backyard a landlocked piece of property & say it will not have a significant impact 179 apts that is more ppl than 2 long blocks in BP. You have to have a plan where do the buses go? The delivery trucks? The car services? The only place is on 50th street now imagine mon. Morning. For 179 x 3 kids avg.that use busses =537

Boro Parker Says:

The problim is thay said the same thing when thay built there building in williamsburg that it will be for yiddin and then quitley thay changed the plans, so these people cant be trusted.

Having once lived on that block for almost 20 years, I dont blame the people one bit for not wanting the project there. All thier points are very valid. That street is over congested due to Shoprite and the major insection at 20th Avenue. Adding all those cars will make it worse. There is NO way into or out of the area other than that corner. The other issue is that the housing is NOT for mi'sheluni rather it is for the undesirables who tend to occupy these projects.

The 7th floor is a duplex apartment with the 8th, so I think it will have more then 2 bedrooms.

Regarding him giving in writting, the developer has plans and he showed it to the board and he doesn't have to give anyone a din v'cheshbon.

As I know you guys on the block never tried sitting down with the developer to discuss it like mentchen. At the Board hearing you booed and clapped and made a one big chillul hashem. He submitted plans that were adjusted and changed with the help of Councilman Simcha Felder and due to the concerns by the community. The developer addressed every issue in the design and layout of the development that all of you were complaing about, so what do you want now?

When the structure will be up and apartments will be done the Boro Park will see what you tried selling the community is not true.

You all know that there won't be department stores in this development, You all know that the apartments are being built for the heimeshe olem, YES with Pesach kitchens and porches for a Succah, You all know that most of the apartments will be geared for big families, so stop already with spreading lies.

The agreement is that the restrictive deed will be in the hands of the neighbors so that they can make sure that there is no 12 story building, there will be a street going through the project for busses & cars & a privacy wall between the project and the neighbors
