Postville, IA – A judge has ruled that the former manager of an Iowa slaughterhouse that was the site of a large immigration raid is a flight risk and should remain in federal custody.

U.S. Magistrate Jon Scoles issued the order today for Sholom Rubashkin. The former CEO of Agriprocessors Inc. was arrested last week on bank fraud charges and had been released on $1 million bond.
Federal agents say they found about $20,000 and passports in a travel bag in Rubashkin’s bedroom.
Prosecutors also allege Rubashkin tried to tamper with evidence when he was released from jail on other charges including harboring illegal immigrants.
Trial on those charges is scheduled for Jan. 20. A trial hasn’t been set on the bank fraud charge.

This is very unfortunate. Are there any good lawyers out there that would help out in this case? Perhaps Alan Dershowitz could be consulted? With treatment like this I have high doubts that he can get a fair trial or a fair sentence if chas v’sholom he is convicted. He is not accused of a violent crimes, and on a grand scheme of things his charges do not compare to the charges of some of these executives from enron, adelphia etc. While they never have been sheckled and kept in jail with a lot more resources. Lynn Stewart, who was convicted of terrorism, is out on bail, while Rubashkin, who is only accused of (serious) financial crimes, is denied bail. Rubashkin is in a mess of his own making but this decision is absurd.

I hate to ask a stupid question, particularly in light of the passion with which Torah and Emunah are being offered here as a basis for Rubashkin’s release, but, isn’t the judge – and for that matter the prosecution – simply a shaliach put in place to mete out the ratzon Hashem? My understanding is that the government offered proof that Agri execs fled to Israel after the May raid. This certainly didn’t help Rubahskin. The heat on him is getting too hot to handle in Postville so his ties there are minimizing. And he went to Canada claiming it was business but the prosecution offered testimony that it wasn’t. High profile case, issues with accountability, it adds up to detention.

That recall was also VOLUNTARY. The Rubashkins at great expense to themselves voluntarily recalled the products so such a thing should not happen. I do not know the statistical percentage of people that are allergic to eggs in the general population but I would guess it’s one in hundred or less. The recall only testifies to Rubashkin’s tzidkas and if you “saw red” I advise you to have your vision checked because the problem is with you, not with Rubashkin.

I am a shaliach on vacation, and am at a friend’s home for a 2-hour visit. He just showed me this blog, which I had not seen before. I am typing on his computer, because I can’t keep quiet.
This needs to be said:
Certainly None of us, no Jews, want to see Sholom Mordechai in jail. But all the whining and crying about hate and antisemitism is uncalled for, and is, in my opinion a Chillul Hashem.
These accusations are also untrue. Though I know his family, and certainly would rather he were not in jail, the prosecution DID make enough of a case for a good, honest judge to believe and agree that he IS a flight risk. To not allow bail in this case is a correct decision by the judge based upon the evidence.
To call him names, to put him down, so cry out “Anti-semitism” makes us look like the type of whining babies that no one likes to be around. There is no Anti Semitism here, except those who hate the whining.
It is simply justice doing its job. Just that this time it is hurting someone dear to us. This hurts us. But it is not unfair. The judge had no choice, considering the situation.
I have lived in 4 different states since leaving CH. It is my experience that antisemitism is NOT a major player in the courts.
In fact, since this case is bound to be looked at closely, they will be very careful to do the right thing.

Everbody thinks they know the truth.
That shaliach was at my home for 2 hours. His vacation was only about 18 hours. He flew in very late last night to be able to go a bris this morning. He stopped by my home for 2 hours before flying back to JFK so he could be there for the rest of the program. He made sure to take a flight early enough to stop at “The Ohel” which is where their rebbe is (or isn’t, depending….. I get all confused about that, since he is a yellow flagger type..)

The Kinus was one of the main topics he could not stop talking about. That is why I dragged him into my office to show him this blog. Talking about the Kinus is tiresome to a non Chabad person. But, yet, he is certainly a Shaliach.
In fact, from what I understand he went to the Kinus with about 5 people. He as the head shaliach, 2 who work with him and 2 of his baal habatim. He left them in NY and flew down here for the bris.
The “Vacation” he was talking about was the entire 2 weeks he will be away. This two weeks included the kinus, the bris, and 2 chasunas next week, one in Europe. His rebbetzin is meeting him at JFK for the flight to some city in Europe.
He will be returning to FL from Europe and warm up again. So he promises.

just so you all know the main beef that PETA (and Temple Grandin) has against Rubashkin is the fact that animals are already being chopped up minutes after shechita and that they can be seen jumping around and “withering in pain” after the shechita,
Hashem, who is the embodiment of Truth and Wisdom, has decreed in the Halochos of shechita that the most humane way to kill an animal is through shechita, and that immediately after shechita the animal is DEAD!!!!!!!!!!!!
I once saw a shechita performed in the courtyard of a shul in Russia, and with my very own eyes i saw the animal jumping without a head! IT’S ONLY NERVES!
this entire Rubashkin saga was brought on by PETA, people who claim to be more humane than G-d!!!!!!!!!!!!!!! Temple Grandin has said that she does not agree with the animals being processed so soon after shechita, well lady take your issues up with G-d when you get to heaven,
we as the frum community must recognize this entire saga as blatant anti-semitism and anti-Torah, you know in Denmark they want to pass a law against brit-mila unitl 15 years old, wait till PETA goes after the mohel in your area (which they won’t because they don’t care if the whole popultion dies, as long as animals are treated “humanely”
and for those who claim this to be the biggest immigration sweep in history (which it wasn’t), but even if it was, that is exactly the point, it’s the “biggest” sweep because the government is IGNORING and turning a blind eye to hundreds of other LARGER companies, Agri is considered peanuts to the big treif meat companies, and they are going after Agri, like Goliath against David, because they are Jews, we must recognize this and pull together as a whole with Achdus
the Jews have helped this country prosper so much, we deserve to be treated with humanity, Rubashkin may be worthy of a nominal fine (of which he received 10 million), but jail time, while the crooks in the banks who created this entire economic downfall by moving around billions of dollars around the world to make their companies seem stable are receiving taxpayer bailouts, and Rubashkin who moved some money around his comany to stay afloat is being imprisoned

The lion’s share of us “whining” are only saying not to rejoice in others’ misery. We don’t say “he’s innocent because everyone is an antisemite.” Some of us are saying “innocent until proven guilty.” And even if ultimately guilty, why do we have to have a forum in which his fellows condemn him instead of offering chizuk? Would that really be a chillul Ha-Shem? Do you really beleive that Jews bashing another Jew who has run afoul of the law serves to decrease antisemitism or engenders kiddush HaShem? Do you not read the posts that are peppered with terms like “lubabs” and “chamor bli daas?” Do you not know that those are intended to be less than flattering terms for chabad? Now, is being disgusted by this tantamount to whining? In that case, why aren’t more people whining?
