Brooklyn, NY – The NYPD deputy chief implicated in a steroid scandal is trying to have evidence thrown out in the departmental trial against him by claiming it was improperly obtained from a secret grand jury.

Michael Marino’s lawyer told the NYPD trial administrator that he will file a motion to toss out the customer roster at Lowen’s Compounding Pharmacy in Bay Ridge, Brooklyn – a list that names more than two dozen cops who allegedly bought steroids and human growth hormone.
Lawyer Michael Shapiro claims the roster was originally obtained by an Albany County grand jury through a subpoena and that the NYPD investigators did not have the legal grounds to access it.
“The NYPD investigator did not have sufficient cause to obtain it from a grand jury that – by law in New York State – is secret,” said Shapiro, who believes that the motion could lead to the dismissal of the charges against Marino.
Marino was among 27 NYPD customers who were charged after investigators seized records and $8 million worth of steroids and human growth hormone from the pharmacy.
The cops avoided arrest because they had prescriptions but were slapped with departmental charges under NYPD drug policy.
Marino, 49, declined to take a year of probation and be docked 30 days’ pay and vowed to fight the charges. An NYPD spokesman declined to comment.
