Brooklyn, NY – Apple Hit With Class-Action iPhone 3G Lawsuit

    Brooklyn, NY – A Long Island man has so many hangups over his iPgone 3G, he’s filed a class-action lawsuit against Apple and AT&T in Brooklyn federal court.

    The lawsuit which was filed by Avi Koschitzki, said Apple shipped a device they knew was defective. He said the smartphone was not as fast as the ads portray, and the 3G connection is still faulty.

    When Apple released the iPhone 3G this summer, one of the biggest selling points was the high-speed 3G connection. But almost immediately after launch, complaints rolled in from around the globe about issues with staying connected to 3G networks.

    Apple eventually acknowledged there was a problem, and later released a firmware upgrade that was supposed to resolve the issue.

    According to Koschitzki’s lawyers, the 3G iPhones, “demand too much power from the 3G bandwidths and the AT&T infrastructure is insufficient to handle this overwhelming 3G signal” due to the extremely high volume of 3G iPhone traffic attempting to utilise it.

    Beyond joining the emergent chorus of complaints pointing out inconsistencies with the iPhone’s 3G capabilities and Apple and AT&T’s claims that the second-generation model would be “twice as fast” as the original (2.5G) EDGE network, Koschitzki’s filing also includes notice that numerous owners are apparently suffering from cracks around the smartphone’s integrated camera.

    “Although Apple was and is aware that the handsets were and are defective, and that consumers have experienced repeated instances of cracked housings, Apple has nevertheless allowed the defectively designed iPhones to be sold to the public,” the complaint said.

    Apple has been hit with other lawsuits regarding the reception and connectivity of the handset, and it has also had to pull an ad in the United Kingdom because the commercial was deemed misleading. The company has not responded to press inquiries regarding the latest lawsuit as of this writing.

    The legal matters do not appear to be affecting the popularity of the touch-screen smartphone, as Apple recently sold 6.9 million iPhones in the third quarter. The company has already surpassed its goal of selling 10 million handsets in the calendar year, and the iPhone 3G was the top-selling handset in the United States last quarter.

    The ad does mention, if you read the fine print, that it is a simulation, and not exactly how the iphone works. Can people start getting jobs, and earning their money, instead of suing every moment they want the chance? Instead of getting a settlement, these people should just get NEW phones, and maybe a consolation prize, but loads of cash? For what, “punitive” damages. Oh please!

    Who absolutely needs an iphone? How many people only use this overpriced novelty to facebook or twitter? How sad!!! It’s sad that people will spend gobs of cash in this economy to have a shinny bauble.
    That being said the interface is revolutionary but apple with its insatiable greed has locked the phone so you can only do what they want you to do. I welcome the google phone, not the current one, but the ones that will learn from this first g-phone.
    What is even more pathetic is the amount of yeshivah kids who have this and other very expensive phones. How many of their parents are paying full yeshivah tuition?
    In addition how many yeshivah kids are “Early Adopters” paying even more for these devices? In the 2 schools I worked at and when I was a Tech Consultant for the “Rich and Famous” I would routinely see Jewish kids with phones not yet available in the US.

    I had an old iPhone and now have the 3G one as well. I also unlocked my phones and switch sim cars freely without any problems. A class action lawsuit is such a waste of time and a chilul hashem. Dont like the phone get a blackberry.

    Some of the comments here are absolutely bizarre! Why shouldn’t someone sue? I’m sure Apple is giving this guy a hard time.

    That said, speaking as someone who bought 9 macs since 1997, and 5 iPods, Apple makes remarkable products, and has above-average customer service.

    BUT every now and then, Apple decides that a problem isn’t a problem — even if thousands of people have the same problem — and makes it nearly impossible to make an exchange; and absolutely won’t offer a refund. Even if you buy the expensive “Apple care” extended service warranty.

    As a result, this guy is suing, and my last laptop is now an expensive doorstop.

    Have the iPhone and most say its the best phone in the world. Have some connection problems but not more than other phones.
