    New York, NY – The marshals who evict people from their New York City apartments have begun an unofficial two-week holiday.

    The marshals have been honoring the eviction moratorium for decades but don’t seem to know when or why it began. Tenant advocates say it probably was created to help landlords avoid negative publicity for tossing people out at Christmas.

    Bronx Housing Court Judge Jaya Madhavan says the eviction moratorium is “one of those myths that take on the force of law.”

    The city’s Department of Investigation regulates the 45 marshals and doesn’t sanction the tradition.
    Tenants scheduled for eviction say they’re glad for the reprieve.

    I thought the Sherrif does that. US Marshals are federal agents and chase fugitives.

    Where is the ACLU for the past 30 or 40 years yelling for Seperation of Church and State to put these folks out on the street ?

    the landlords that these thugs owe money for months dont deserve a peaceful holiday after spending so much time in court and attorney fees .. what a shame

    Let us not forget that at the time that the marshals don’t evict this is like they are having a personal vaction too. Let them enjoy themselves

    They should take a holiday also from towing cars.

    Oh! they won’t do that. they’d lose too much money. A tenant won’t run away in two weeks, so they make the money two weeks later. But towing cars?????????

    The tenants would just take their 72 notice and go to housing court for a stay of execution and no judge will refuse to sign so close to the holidays.

    Its a fact of life and the landlords knew it when they bought the buildings (or should have known and if they didn’t they didn’t do proper due diligence) so I have no rachmanus for them over this cost of doing business more than any other cost of doing business.

    No different than ash trays at restaurants and towels in hotels. There is no excuse to steal either of them but if you didn’t know to calculate the costs into your business plan you shoould have planned on going into a different business.

    There are NOT enough Marshals – they don’t like to do evictions they take too much time – and they can make more money with towed cars etc.
    Its really the judges that don’t issue as many eviction orders in Nov thru Feb that allow a moratorium.

    Chief Justice Kay is the one who first suggested No winter evictions and judges and marshals acted accordingly.

    Most housing judges in NY are originally anti-landlord activists and don’t believe in property rights.
