Jerusalem - Supreme Court Orders Father Accused of Killing His Baby, to Begin Jail Term |

Jerusalem - The Supreme Court has rejected an appeal by a 22-year old haredi man convicted of brutally beating his three-month old infant to death to delay the start of his jail sentence pending his appeal.
Yisrael Valis, who was sentenced last month to six years in jail by the Jerusalem District Court, will now begin serving his prison term as scheduled on January 4 even as the appeal is heard.
“The severity of the crime and its circumstances tip the scales in favor of immediately carrying out the sentencing in accordance with the public interest,” Justice Yoram Danziger wrote in his ruling.
“The personal circumstances of the appellant create empathy but are not sufficient in and of itself,” he added.
Valis was previously being found guilty of manslaughter for repeatedly biting, beating, pinching and punching his own baby since he was born because he “did not accept him” due to a congenital defect in the child’s neck muscles.
Valis was arrested two years ago after he admitted during police questioning to repeatedly beating his child.
Jerusalem District Court Judge Hanna Ben-Ami noted in her ruling that Valis had expressed no remorse for his actions whatsoever since the beginning of the case.
At the same time, the court found that Valis did not intend to kill his son and that his actions stemmed from recklessness, and as such the court saw fit to exercise leniency in its ruling despite the severity of the crimes.
The prosecution had praised the sentencing as befitting the crime, while the defense and Valis’ family members criticized it as overly harsh.
The defense is appealing the sentence.
The young father’s 2006 arrest led to days of haredi rioting in Jerusalem, after leaders of the vehemently anti- Zionist Edah Haredit community - which the Valis family is part of - accused police of concocting a “blood libel” identical to European blood libels against the Jews.
The baby died in a Jerusalem hospital, a week after his father hurled him against the wall when he started to cry.

Death due to an accidental act of negligence is in fact the definition of involuntary manslaughter. The prison sentence the Israel courts have passed on is within the range of what courts in New York would give for the same offense.
And if an Arab had been responsible we'd be calling for his head.

This was an *accidental* death, albeit with negligence. (That is the definition of manslaughter.) There is no capital punishment, in fact no imprisonment, under halachah for such an offense -- the perpetrator would go to one of the six cities of refuge.

There's no jail punishment in the Torah. If someone by mistake killed someone, he'd run to one of the 6 Arei Miklats until the Kohen Gadol died. And that was it.
If someone intentionally killed someone he won't be killed because of that unless he was warned and there were witnesses. This case is at most accidental. Since there's no Arei Miklats today, he just has to pray to Hashem to forgive him. No reason to be so harsh on him.
Very sad how some Jews can be so cruel.

Don't be so positive. It's unfortunately a shame, how corrupted the Israeli Justice is, and how biased they are against observant Jews. I spoke to some one who has gone through the Israeli Justice, as he has gone through a series of questions and answers, at the court level, he has finally been asked to sign and confirm that whatever written has been said by his own mouth. He was stunt to see how they changed his own words to words that he hasn't even said. Thank God, he was stubborn, and refused to sign. It was only after 3 times of rewriting it, as it finally matched his own words, and so he was willing to sign. No one knows the truth in this case, however doctors on the case have numerous time confessed that there was no sign of torture. Don't judge your friend until you have been in his shoes, and you decisively know all the facts. “Hashem Tzilchu“: The Bal Shem Z"L comments that your judgment on others is a judgment for yourself. It's your own shadow. In heaven as there is a case against you, your judgment for others will be used in your own case. The extent of bruising the infant had, was not from the resuscitation, but from PURE abuse.
The lack of remorse from the father, should be a major red flag to everyone.
This man deserves his prison time (& much more in my opinion), and the people STILL defending him, and standing by his side, should get psych evaluations.

so what's your plan? Are the Charedim ready to have a non corrupt government? Are they ready to defend the Jewish people against our enemies? Are they ready to work and support themselves? To care about all the Jews who live in Eretz Yisroel? If so, the path is ready. Charedim are increasing in demographics and if they are ready to take on the challenges, alot could be done. But it seems to me they are so busy fighting each other, or in any case just caring about their own small communities, that they are not stepping up to the job that they should do.
