Spring Valley, NY - One Teenage Yeshiva Student Dead, Another Injured After Off Duty Cop Tries Passing Car In No Passing Zone

Spring Valley, NY - One yeshiva student who was standing with on the edge of a busy Suffern road is dead and another is in the hospital after being struck in a chain reaction crash involving a car and a minivan.

Ramapo Police said that the accident took place at 11:50 PM Wednesday night on Route 202 between Wilder and Limekiln roads and involved two cars, driving eastbound on roadway. 

A 2008 Honda driven by 19 year old Tzvi Hakakian of Monsey had slowed down, possibly to turn into a driveway, when it was sideswiped by a 2016 Lexus that attempted to pass the Honda on the left side. 

The Honda continued traveling eastward while the Lexus, driven by 24 year old Jonathan Mosquera of Suffern, veered off to the left, crossing the westbound lane of the highway and hitting two pedestrians who were standing near the edge of a driveway.

17 year old Marcus Tawil was taken by Hatzolah to Good Samaritan Hospital where he was later pronounced dead.  David Maldonado was transported to Westchester Medical Center where he was admitted in serious condition.  Both drivers were taken to Good Samaritan Hospital and treated for minor injuries.

Lieutenant Mark Emma of Ramapo Police said that the area where the accident took place was a no passing zone.

Test performed at the accident scene on Mosquera, an off duty officer with the Newburgh Police Department, indicated that neither drugs nor alcohol played any part in the accident.

Police are continuing their investigation to determine the cause of the accident which took place near a dormitory for Sephardic yeshiva, Tiferet Torah.

There have been several fatal accidents on the Suffern portion of Route 202 in the recent past which has no sidewalks and few streetlights. 

“It is the most dangerous road in town,” Emma told VIN News. “The speed limit is 50 miles per hour on much of the road.  It is dark, has no shoulders and no escape route for a car. It is a tough road.”

The local DA, Zugabi, is well know for being extremely lenient to the Orthodox community. He has let several Hasidic pedophiles off the hook with very lenient plea deals. This is of course in return for the block vote. He most certainly would not "throw the book" at a Yeshiva student. If you are not familiar with the local situation, please don't throw out ignorant comments. And to add, this Yeshiva is illegal and has numerous
code violations but has not been shut down due to the Ramapo inspectors being on the take.
Also, why are Yeshiva students hanging out at the top off the driveway at midnight?
I'm not in anyway making light of the tragedy of this but you and many commenters here seem to feel like you are always victims and every goy is an anti-semite.
As of now this is an accident although it is likely some form of charges will be brought after an investigation. Doubtful this would qualify as manslaughter.

#6; #9; of what relevance is it as to why the students were out there. Is it like they were asking for it? Women groups get angry when we say "why were they out so late" Is this your subtle message. Also all Yeshiva students have night Seder and probably just finished learning and were chilling before saying good night. Remember they were off the street. Is 1150 so late? Many college students are partying at this time. Do you know what "night Seder" even is? Do you have an underlying issue with yeshiva boys studying a lot.
#8; Reflector stripes? Really? Did you read the article? The cop lost control of his vehicle it crossed the street and hit two kids standing off the street. How do reflector stripes play a role? Or do you have issues with "those" people?
And on this topic I wonder How DOES a 24 year old cop have a Lexus 2016? Unless he got it from his parents, an investigation is in order. That's how they got Al Capone.

If you're really a Rockland resident you would know that hassidic people regularly wear reflectors at night in Rockland County. Only a moron would attempt to walk on dark roads at nights here without a reflector. In my neighborhood we proudly wear our reflectors!

Maybe if the drivers saw little reflections they might drive more cautiously rather than driving along and seeing only the open road. I know i do.
Its scary driving home from shul motzeih. shabbos. Black coats make someone invisible....and everyone is in a hurry..
2 members of our kehilla have been hit by cars.
Good news ...... reflective tape on a coat or jacket is being more popular.

Another illegal yeshiva. Legal schools are very well lit at night. Blame the owners and not the cop. I'm very familiar with this yeshiva and there is no supervision. The boys can hang out all night and no one cares. Parents should investigate who is supposed to be in charge or this tragedy can happen again.

A white shirt does not replace a reflector. A car going 50 MPH is very likely not to see someone wearing a white shirt in time. I'm not implying that the off duty cop did anything wrong.

Who said he did anything wrong? Someone slowed down in front of him. Could be the person slowed suddenly. If the driver in front of him was actually turning into a driveway, he had the right to pass him on the left.

Did you even read the article? Do you wear a reflective vest when you are in your driveway?
You seem to be okay with the guy speeding in a no passing zone but this poor soul that was in the wrong place at the wrong time is at fault? here where some reckless driver passed someone who was turning left - on the left - hit that car went off the road and killed someone - the haters want to blame everyone except the reckless driver. Yet - I am sure if the driver that killed this boy was Jewish - all these phony issues would go away and the haters would be calling for all charges against the killer driver.

That might be true but it has no shaychis to what happened here. The reflecting vest would not have been strong enough to deflect the car which sped off the road.

I start with the sadness of a parent; this is horrible news. Some thoughts:
The State sets the speed limit on State raods. Don't blame the Rockland County Highway Dept.
The young man driving, was he the one the other ones were waiting for? Did he use a signal, or just slow down too quickly?
The police officer should be subject to the full penalty of the law. Speeding? Too close? Inattentive?
He's not much oldr than the bochel.
The Yeshiva only recently became legal. If the proper procedures had been followed, maybe the area might have been safer for students? Lights, a school zone...maybe a waiting area well lit at the top of the driveway?
Reflectors might have reminded the drivers to be cautious. Might have helped the one to find his turn easier. Might have reminded the other to back down and not rush.
Might haves are all we have in the aftermath. One man dead, one in bad shape, two others left to deal with whatever part they played. I cannot think the officer is happy, or the other young driver.
As a parent, all I see on all sides is pain and sadness.
Maybe we should fix what can be fixed instead of shouting at each other?
