Terra Bella, CA - FDA Issues Pistachio Warning |
|

Terra Bella, CA - Federal food safety officials are warning consumers to stop eating all foods containing pistachios while they figure out the source of a possible salmonella contamination.
The Food and Drug Administration said that central California-based Setton Farms is voluntarily recalling more than 1 million pounds of nuts.
No illnesses have been reported, but the plant has been shut down voluntarily since late last week.
California health officials say that because Setton Farms shipped nuts to 36 wholesalers across the country, it will take weeks to figure out how many products could be affected.
Setton Farms, based in Terra Bella, a rural hamlet in Tulare County, did not immediately respond to calls for comment. It is the nation’s second-largest pistachio processor.

Interesting that this comes immediately after the USA strong-armed Israel into giving trade preferences to American pistachios.

You mean this wasn't banned form Pesach yet? I heard you can make bread from it.

Many of their products have hashgacha as confirmed by the Setton Farms website. Yiddin should stop eating all nuts until this issue is resolved

While we are on the subject of nuts, do you guys eat peanuts on Pesach(i know peanuts are really a legume and not a nut, but most people consider them as nuts).
Some Ashkenazim consider peanuts to be kitnious, however I found this
" With reference to peanut oil, I wish to reprint the responsum of Hagaon Rabbi Moshe Feinstein, Shlita:
Translation:
“Concerning peanuts, which were called stashkes in Europe—they have been accepted as being permitted on Pesach and are not considered kitniyos (legumes that are forbidden on Pesach) because all the reasons for the prohibition of kitniyos do not apply to peanuts. Peanuts are not sown in fields (with grain), and even if they were there is no fear that grain would be mixed together with the peanuts; bread is not baked from peanuts; and generally speaking though they are vegetables they have the appearance of nuts rather than kitniyos. And even though I have heard that in some places they were considered kitniyos, peanuts should not be forbidden in places where it is not known for certain what the custom had been in their city, because, with reference to kitniyos, when in doubt one should be lenient.
Therefore you may give certification for peanuts and the oil derived from them, and they will be permissible to the majority of persons. Those who know for certain that the custom of their city was not to eat peanuts on Passover should not eat them; others are permitted to eat them.”

There are other issues including those about Judaism in general and about kashrut that we should be discussing. It would be nice if this website would allow people to suggest topics and articles to be discussed.

R Moshe's teshuvah is well-known, but I don't find it persuasive. Peanuts are a legume like any other legume - they grow in a pod. The reason mustard is kitniyos is because it grows in a pod, so why should peanuts be different? As for the argument that it wasn't known when the issur on kitniyos was accepted, nor was maize, and yet the achronim all accept that it's included.
BTW, I'd like anyone to demonstrate a sensible difference between quinoa and buckwheat. The main reason for the issur on kitniyos is that they're cooked as a kasha just like grains - and that fits quinoa exactly.

Chasidish people just simply won't eat anything that their parents didn't eat "in der heim" So, no quinoa, no peanuts, etc. no problems.
We can eat quinoa all year long, and peanuts too, as long as we have no allergies. So Pesach is a tradition, and a strong one! Why mess with it?

I find it amusing that a poster known as "Rav Mihouse" knows better than Rav Moishe Feinstein, Z;tl, and dismisses the posek of one of the gadolim as "unpersuasive". The heilege rebbe would be pleased to hear that he doesn't know a pea from a pod.

The Setton family are Syrian Jews who provide a quality product with good hashgacha at a good price. I hope they do not suffer unduly because of this.

Though I usually do not stick up for Milhouse, in this case, he was not being disrespectful in any way.
We ALL respect the Gaon, Rav Moishe Feinstein, ZT"L, highly.
However, he was matir some things as a "das yochid" and as such, no matter how big of a godol he is/was, many people, though still respecting him, to not accept that heter upon themselves.
Furthermore, Rav Moshe gave a reason for his heter. When a posek gives a reason for a heter, it is for a purpose. It means that if one does not hold that reason is enough for him, he does not need to accept it.
Many of us accept a blanket issur for ALL LEGUMES, knowing well that some were never planted with wheat. So, for us:
Leegumes are ossure on Pesach
If it is a Legume, it is ossur
Peanuts are a Legume
Therefore peanuts are ossur
Thus to those who hold that ALL Legumes are ossure, Rav Moshe's heter is "unpersuasive" and that is said with MUCH respect for Rav Moshe.
Also, Rav Moshe also clearly said that those who have the minhag to not eat them still can not eat them. He did not say his heter overrides previous minhagim.
Also, there are many people who DO have, as stated above, a MINHAG that we do not eat what our grand parents did not eat on Pesach. This means we do not eat ANY new food, period.
There is a story from a retired Rabbi I know.
He came from Brooklyn to a new job he got at a "shteller" in the Midwest.
He arrived and took over from another rov who retired.
That Pesach he had orchim and they saw him eat something
(I will not say what, so we don't get into a new debate)
which he always ate of Pesach, and never heard that there was every any inyan to anyone else.
The members of his congregation were shocked. The old rabbi told them it was ossur on Pesach.
From the Seder, he walked over to the retired rov's home, down the block, to ask him why he did not eat xxxxx on Pesach.
The Rov, who had come from Europe directly to this Midwest City replied"
"When I arrived here I was asked about that item. I had never seen it before in Europe. Ever. I did not know what it is, or how it grows. So, I played it safe."
The new rov said, "So, this city does not eat xxxxxx. I live here now, so neither do I. "
And, he went home and had his rebbitzen toss all the xxxxx in the trash.
This item is such that EVERYONE in Brooklyn eats. Ashkenazi, Sepharadi, Litvish, Chassidish. But, in this city in the Midwest, it is still not eaten.

Peanuts are, if you read carefully, Safek Kitniyos.
That makes peanut oil a Sfake Sfaykah.
A person from Brooklyn calls it a Fake Sfayka.

That is easy to say if you are not a vegetarian. For vegetarians, and especially for vegans, finding what to eat on Pesach is very hard. Being able to eat peanuts makes things much easier.

Nuts are healthy for those who don't have a weight problem. Nuts have plenty of calories, so those who are overweight should avoid them. Compared to other nuts and seeds, pistachios don't have as much important vitamins and minerals. Raw sunflower seeds are probably the highest overall in nutrients(they are kitniyos though, so not good for Pesach) and are the lowest priced. If you shop carefully you can find unshelled sunflower seeds for $2 a pound or less, which is often cheaper than unshelled peanuts. Sunflower seeds are also a more complete protein source than peanuts. Below is the address to a website that lists the nutritional values of foods. Most people in the US are deficient in magnesium. Raw sunflower seeds have around triple the magnesium of pistacios.

So on Pesach drop the vegan nonsense. What's more important? A din in Ramo or a self-imposed shtus? Instead of compromising by calling peanuts "not-kitniyos", why don't you compromise by calling eggs and milk, or even fish, "not-meat"?

I find it amusing that a reform sheigetz amhoretz, who holds R Moshe in utter contempt, is suddenly insisting that his words are infallible and nobody may disagree. You probably eat kitniyos anyway, so what's it to you?
Kvodo shel R Moshe munach, but he is not the last word in halacha, and he is only influential to the degree that his reasoning persuades others. In this instance, I find his reasoning unpersuasive, and I've explained why. Readers are free to make up their own minds.
