Postville, IA - Rubashkin Filed Motion to Move His Trial

Postville, IA - A former manager at a northeast Iowa kosher slaughterhouse is asking that his trial be moved after the recent anniversary of an immigration raid at the plant renewed media interest in the case.

Former Agriprocessors manager Sholom Rubashkin asks in a motion filed Tuesday that his trial be moved to St. Paul, Minn., or Chicago because he can't get a fair trial in Iowa.

It's the second time Rubashkin has sought a change of venue. Last March a federal judge denied the request.

Rubashkin's latest motion argues that, among other events, the anniversary of the May 12, 2008, raid brought "extensive, inflammatory, and ongoing adverse pre-trial publicity" that taints the potential jury pool.

The trial is now set to begin Sept. 8 in Cedar Rapids.

This is absolutely correct assessment of the current atmosphere in eastern Iows. No other high-publicity trial jurisdiction would refuse such a request for change of venue.

Allow Rubashkin a change of venue as he requests.

I do not understand. Rubashkin always claimed that he treated his workers well, paid them well and they (and the town) loved him. Now he is claiming that he cannot get a fair trial because the people hate him? Something is fishy in Postville.

He has already been convicted in the media , by the judges , jury & government. The trial is a scam whereever it takes place. He needs Tefilos & rachmei Shomayim.
Le us t the judge gets caught on a scandel & has to resign, let some other officials do the same, & bingo.
We need Nisim, and those are in reach, most of the powerful, have something not so kosher about them.

The trial will not be held in Postville but in Des Moines so locals are not likely to be in the jury pool. Futhermore, the Agri scandal has been on the front page of every major newspaper in the country, over and over again. SMR will get as fair a trial in Iowa as he would in any other state - including Alaska. The problem for SMR is not the location of the trial but rather, bank fraud is bank fraud is bank fraud. Along with other federal charges it will be extremely difficult to explain why this is not part of a general pattern of criminality undertaken by the owners and therefore worthy of a more harsh sentence.

In Postville he could maybe get a fair trial, but not in Cedar Rapids. The jury pool there has been saturated with negative press about him, but has no personal experience of the good he did.
