Albany, NY - A judge says he won't rule on last week's takeover of the New York Senate by a coalition of Republicans and dissident Democrats.

State Supreme Court Justice Thomas McNamara is dismissing the case, saying it's improper for the court to get involved in a legislative tussle. He recommends the legislature resolve the question of who's in charge of the chamber.

Meanwhile, Gov. David Paterson says he'll step into the Senate session and run the chamber as he did while lieutenant governor. He says that will temporarily help Republicans and Democrats pass critical bills while they figure out which party controls the Senate.

If nobody is working and they are playing like kids in a sandbox, I do not see why we should waste taxpayer $$$$$ to pay them. Their paychecks should be withheld until they decide to go back to work and they should not be paid for last week!!! FREEZE THEIR DOLLARS!!!!!!!!!!

They are working. This is just as much part of their job as anything else they do.

Please I wish this fight goes on forever. So they wont have time to raise taxes. There is now a bill pending to raise sales taxes by .50%. You know how much this will cost us?

finally a judge mit seichel! he understands the meaning of "separation of powers"! on the other hand, you have lawbreaker patterson who is no longer the Lt Gov, and thus has NO RIGHT to "step into the Senate session and run the chamber as he did while lieutenant governor." he should be impeached.

Not passing the sales tax increase will cost us all those after school vouchers the City Council just put back into the budget.
