Postville, IA - Judge Denies Motion to Move Rubashkin Trial |

Postville, IA - A federal judge has again denied a request to move the trial of former kosher slaughterhouse executive Sholom Rubashkin out of Iowa.
U.S. District Court Judge Linda Reade rejected today the motion by defense attorneys, but suggested that she could change her mind as the Sept. 8 trial date nears. Reade issued a similar ruling in March, but allowed defense lawyers to renew their request after prosecutors filed new charges against Rubashkin.
Rubashkin is 1 of several employees of Agriprocessors Inc. named in a 142-count federal indictment for alleged bank fraud, harboring undocumented workers for profit, document fraud and other crimes. Rubashkin has pleaded not guilty.
The Agriprocessors plant in Postville was the site of a raid in May 2008 that led to the arrest of 389 immigrant workers.

If I was the prosecutor, I would agree to a change in venue since doing so would reduce or eliminate one important area for an appeal when he is convicted. This reinforces recent evidence of the ineptness of these DOJ prosecutors.

I may be naive but isn't someone who is accused of a crime under American constitutional law entitled to a trial by a jury of "HIS PEERS". If so, Sholom Mordechai has a right to have the trial held in Monsey or WB, not Postville or Podunk where the locals are not "his peers". Vat am I missing for all those legal experts on VIN??

Many defendants have argued that unless the makeup of the jury is demographically and of like race as the defendat this does not qualify as a jury of his 'peers' and have been met with very little success. One can only win such an argument if they can prove that certain people were deliberately kept off the jury for reasons as race or religion.

I believe that "peers" means fellow citizens in the community where the trial is held. It does not mean someone who is of the same religion, ethnic background, etc. The locals in the Postville area are his peers.

I think there might be one shop open but I don't know if you would have 12 people plus you need extras and they will definitely not pass Rubaskin's lawyer's test at least not all of them!

This is federal court, not a town court. The jury pool is drawn from the entire district of that particular court. I don't know just how big the district is, but it's probably about 1/2 of Iowa since Iowa has two federal judicial districts. That' s one of the reasons it's hard to get a change of venue. There may very well be no one on the jury from Postville or the immediately adjacent towns.

Why do you think? Because they've been promised green cards if they testify the right way, and prison followed by deportation if they don't.

The trial is Sept 8. That is not right away.
Besides - As far as I know, illegal aliens cannot be part of the jury pool. At least, not in Iowa. If the trial was moved to Chicago, then the odds of illegal aliens on the jury will be greater.
