Sullivan County Judge Frank LaBuda took a tour of a controversial shul and community center in Bethel on Friday afternoon to determine if it is safe enough to remain open.
White Lake, NY - In the ongoing showdown between a Hasidic bungalow colony, and the town of Bethel over the use of a newly built shul and community center.

This morning in Monticello court, the town lawyer argued that its premises is not safe to use, the Sullivan County Judge Frank LaBuda decide to took a tour of the controversial shul and community center in on Friday afternoon to determine if it is safe enough to remain open.

VIN News has learned that Judge LaBuda has just issued a temporary certificate of occupancy permit to allow its operation.

first of all this shows you that you have a fair judge. he went out and checked the premises and found it satisfactory to issue a temporary certificate of occupancy permit to allow its operation .

second , were are all those people who were screaming chillul hashem , it does not seam like one to me . they went to court and the judge ruled in there favor.

third , that is the problem on these boards , people feel that are rabbonim who know how to pas-ken the laws of hilchos chillul hashem , when they don't have a clue what a chillul hashem is .

fourth , if people really felt that they new what they were talking about , they would hide behind anonymous or fake names.

Wow! Finally some positive developments to report. It was getting pretty depressing to visit VIN lately.

You are obviously not familiar with the chain of events in this particular case. Everything was done perfectly legal and orderly.
It was the town, under pressure from an unfriendly neighbor with clout, that derailed the process.
So please try and be informed before popping off your lectures.
It would be especially nice if at least during the 9 days, we all resist the Yeitzer Hara to demean and besmirch the reputation of our fellow Yidden.
The Goyim don't really need our help.

A Certificate of Occupancy (C of O) is exactly what it says it is: the key document certifying the LEGAL use and occupancy of a building. Notwithstanding how many people violate the law -- as happened in this case -- a new building cannot be LEGALLY occupied until a C of O has been issued. The argument: "but every one does it," is disingenuous and wrong.

The RIGHT thing to do would have been to: (1) request the C of O from the town of Bethel and then (2) gone to court when they refused to issue it (and not react with an attitude of "screw you, we'll do what we want and begin using the building anyway"). The judge would then have come to the site, issued the temporary C of O, and (3) the community could have started using the building LEGALLY and with respect for the due process of law. Quite simple really.

Here is a clear picture where a town withheld the permits "for no good reason" (or maybe there was some "hidden" reason"..), and there was no way to please them, since ALL BUILDING AND SAFETY CODES WERE MET, so there was no other option than court.
And now the judge was convinced that THERE WAS NO REASON NOT TO GRANT A C.O.
BH that all morons like you and alike have to swallow the victory of the "frum" yidden, that acted according to law, and made a big kiddush hashem.

I know the Judge personally, the men is a real mentsh and very fair. He took the time to see it for himself, what a wonderful thing. He is well liked and respected by all the Rabbonim upstate. Ask Rabbi Barros or Chanowitz about Judge Labuda, they will tell you what type of person this men is.

9: If you were the fire department, you would let these people die, because they themselves weren't careful about safety. Think about that for a minute, and compare it to the moral compasses out there. Whatever reason these people rationalized that they didn't need to get the proper permits from the proper people, you don't stand by and not save these people's lives. And the Judge too? C'mon.

Are you in Eng-land, or in denial land?
everything was done properly, and the building dept. promised a C of O if a punch list is completed, that punch list was completed in a few days, they came to inspect and they find nothing missing! then they started a game of playing around for "no good reason", after begging and asking for "a reason" they were still hitting a wall.
So the judge came into the picture, and BH approved it.

U R nuts. Don't u see the Hassidim were discriminated. The biased. They were forced to take the case to a court of law. We are lucky we have a healthy court system.

the owners had there own engineer who argued that it is safe to occupy the building, thats why the judge went down on hes own with the lawyers and engineers of both sides, and after a short overview he decided that the town was only doing it for SOME reason, so he issued them the CO.

What is amazing is that the town building inspector testified for Satmar. It was the planning or zoning board that subsequently decided not to give the CO. The inspector was there for regular inspections throughout construction and said everything was up to code. The town is now saying that the inspector did not do a good job. Does that not sound like dicrimination to you?
Obviously that is why the judge felt comfortable deciding by himself, because once he got there it was obvious that the towns claims were patently false.

I can believe you talking like this I was in court Friday you have no idea whats going on WOW you must be sad !! Like the judge sad to the town lower not the safety is your problem you have some think say it in my face. Than the judge sad. I feel it just its not right I'm taking a ride to betthel

The only Chilul Hashem, and numerous other transgressions that I see here are the negative and nefarious comments that I see posted in regards to this issue. It is obvious that those that posted negative comments are completely unaware of the facts in this case, and are among that unfortunate group that are always eager to bash anyone,be it Chassidim or anyone else that they have taken a dislike to. As a homeowner in near proximity to the Satmar Lapidus Colony, and a participant in the cost of the construction, I am very familiar with all the details. Every phase of the construction of this magnificent edifice was done 100 % legally and thru the proper channels.Unfortunately, there is a local developer ,who happens to be Jewish,who is vehementely opposed to any form of growth or expansion by the Orthodox in the White Lake area. His influence on the Town Planning Board is blatant.This construction was initially approved by the Town Building Inspector, Tim Dexter, and he personally monitored the construction from day one. It is tragic to see in this day and age the blatant Anti-Semitism being perpetrated by the Town Planning Board (of which 2 out of 5 are Jewish ),a known local developer, and numerous other local groups. The Town Planning Board even tried to fault thier own Building Inspector even though he did everything by the book. As the Building Inspector himself stated at a meeting which took place yesterday at the White Lake Shul Of Rabbi Fishbane, " I never understood what the persecution of the Jews meant until I witnessed this whole scenario".This Building Inpector,Tim Dexter, put his job on the line by standing uo for what's right. As is witnessed by the Judges decision, the Satmar Kehilla did it by the book, and the only reason for this occurence is obvious Anti-Semitism. For those detractors and posters of negative comments, bear in mind the Mussar Seforim that you learn but do not practice,especially during these Nine Days. May Hashem grant us the ability to practice true Ahavas Yisroel, for if we do not practice this among ourselves how can we expect better from others. May the Geula Shleima come yet before this Tisha B'Av , and may we all rejoice together in Yerushalaim Ir Hakodesh together.
