New York - Brad Simon, a former federal prosecutor and assistant U.S. Attorney for the Eastern District of New York, said he is surprised the government's case appears to rely so heavily on the testimony of one key witness with a checkered past who Sources have identified as Solomon Dwek.

"This guy, at least from a defense attorney's point of view, seems like a treasure trove for defense purposes," said Simon, who is now a criminal defense attorney who represents clients accused of white collar crimes. "I would love to have the opportunity to cross-examine this guy."

Prosecutors said they have hundreds of hours of video and audio recordings documenting much of the money laundering and bribes.

U.S. Attorney Ralph J. Marra Jr. called the money-laundering case "unprecedented" in the "number and prominence of the individuals involved."

The rabbis and their associates continued working with the witness even though they sometimes expressed concern about the possibility of getting caught.

In March, the witness was driving Fish to a Brooklyn meeting with Levi Deutsch, an Israeli who supplied cash for Fish's money-laundering operations. When the witness mentioned cross streets to which they were headed, Fish became nervous, according to court records.

"Don't even say the street. . . . in this car," Fish said, according to the complaints. The witness reassured Fish that "there's nothing. I had (the car) swept. Don't worry about it," to which Fish replied, "swept, shmept."

Giving illegal profits to tzedaka doesn't make one a tzaddik.

It's called mitzvah habo b'aveirah.

I don't see rabbi Fish being accused of going to Atlantic City, night clubs, or brothels. Nor did he drive anything remotely resembling a newer model automobile. As a previous commentator noted, Rabbi Fish is a true tzaddik. He reaches out to young men who have not had a religious education, making bar-mitzvahs at his own expense (there's whre the mopney went), and making weddings for orphans (that's where the rest of the money went).

Right, but (without looking at the current charges, on which he's anyway innocent until proven guilty) he's a very special person, he takes care of many impoverished russian families, and other immigrants in distress.
In this case, if he's c"v proven guilty, although law is law, it still makes some difference when someone does it for his personal gain, or for the sake of impoverished families.
Let alone in this case when the entire story was a ugly entrapment by some piece of dirt, a known criminal.

I hope the one thing we learn from this is that even if u r the biggest baal chesed and u have the greatest intentions u absolutely cannot engage in illegal activities. besides for being halachicly questionable, it is a tremendous chillul hashem. unfortunately we jews have to put a tremendous value to money bc our cost of living is so high and we have a huge network of institutions that rely on the publics monetary support. why dont you ever see the "pashut shoemaker" get an aliyah in shul. we have to all b more honest in our dealings. this is the only way to move away from the dishonest culture that thrives in our communities

No, but legally you have to file a form afterwards to pay the NYS Sales Tax for the taxable purchase amount if you live in NY.

To add to #s 1,8,9,11 and 15- Rabbi fish is a true Tzaddik who has devoted his life to helping the downtrodden of our society, literally getting kids off the streets and into yeshivas. Allnthe school administrators can attest to that. He has had no monetary or materialistic gain from the alleged crimes he has been charged with. May Hashem protect and shield him from these troubles.

Jul 26, 2009 at 12:20 PM Lest We Forget Says:

Rabosi, just because someone was arrested doesn't mean they are guilty. We need to remember that very very well. HKBH will judge us like we judge others. Do WE want to be judged guilty without being afforded a "trial" by HKBH. Don't forget what Rashi brings when Yosef HaTzadik revealed himself to his brothers, "Oy lanu l'yom ha'din, oy lanu l'yom ha'tochacha."

Did we perhaps fall from our pedestal? Yes but lets do what we can to bring ourselves up again. It is us to ALL of us!

If you're not an accountant then don't try to talk like one.
The IRS actually does NOT consider money gotten from "begging" as income. Actually people in the US that live off of "begging"want that to change so they can get an earned income credit...

like the family didn't know what the son was doing? after being arrested in 06 and running around making deals? if they didn't know, it means they didn't want to know-just like the Madoff victims didn't know it was all a ponzi scheme. Right! And, in any event, the mosser will still be going to jail regardless of his help. think of the brian mcgloclin story very recently. that guy wore a wire and set up a very big assemblyman. even with all his help, that mosser got ten years. the judge wanted him to get fifteen, but the US Attorney went nuts saying that if the judge gave that guy 15, no one would ever become cooperating witnesses. so here, this mosser ho must have been facing more than 100 years (Look at Samet- 27 years for 3 million) this mosser here will still go away. ok, maybe only 9.9 years so he goes to a camp instead of a low, but still many years in prison.

The goverment rapes people with taxation. therefore what Rabbi Fisch did isn't such a big aveirah in my eyes (though still illegal ). Rabbi Fisch is probably the only reason I'm frum today. He was my father in ruchnios and gashmios. He paid for my summer camp, tefilin, and even my clothes while asking nothing in return. And that is why he's a tzadik and you're schmuck for nocking a yid beshas tzarah.
