(STAFF PHOTO: BOB BIELK)Lakewood, NJ - A 43-year-old Seaside Heights man who admitted driving much younger men to violently rob Orthodox Jews was sentenced this morning to 25 years in prison for his role in the crimes.
Before he was sentenced, Jose Diaz Jr. of Franklin Boulevard professed to have no advance knowledge that violence was going to be imparted during the crimes.
But First Assistant Ocean County Prosecutor Ronald F. DeLigny said Diaz was almost twice as old as the two men he transported to the crimes, and he did that “knowing full well” the victims of the robberies were likely to be injured.
“I didn’t know who was getting hurt,” he told Superior Court Judge James Den Uyl. “I knew about a robbery, but hurting somebody, no, I don’t think so. I don’t hate nobody.”
Diaz pleaded guilty on Sept. 21 to conspiracy to commit robbery and bias intimidation in connection with an incident on May 25, 2008 in Lakewood in which David Davidovish, then 38 and visiting from Israel, was attacked with a baseball bat and robbed of several hundred dollars and a laptop computer. Authorities said a codefendant, Devon Hardy, 20, of Lakewood smashed the windshield of Davidovish’s car with a baseball bat as the victim was parked in the lot of a convenience store on Route 9.
Diaz also pleaded guilty to robbery and bias intimidation in connection with an incident on July 8, 2008 in Lakewood in which a rabbi, Jack Goldbaum, then 41, of Lakewood was accosted in front of his home.
Diaz has admitted that he drove Hardy and Timothy Swift, 19, of Toms River to that robbery, knowing that Hardy was armed with a knife. Goldbaum was punched and stabbed four times, and his wallet stolen.
Authorities said Orthodox Jews were targeted because they were unlikely to resist the robberies.
Den Uyl ordered that 15 years of Diaz’s 25-year sentence be subject to the state’s No Early Release Act, which requires that 85 percent of the term be served before he can be considered for release on parole.
Den Uyl on Oct. 9 sentenced Hardy to 30 years in prison for the two robberies, and Swift to 10 years in prison for the robbery he participated in. Both must serve 85 percent of their prison terms before they can be considered for release on parole.

Here we waste the best years of some criminals they need to be punished, but don't deserve a free hotel, curtisy of the taxpayer.
Hard labor & corperal punishment, would be better
Or supervised day labor where money goes to the victims & they pay their stay.If possible a way to make their lives worth something. 25 years for a 43 year old guarantees us, the taxpayer will pay for him until his death. If so why not chop his head off now? If he deserves less then death, find a meaningful punishment.
Hardy after 30 years will be 50 & will spend the rest of his life coutesy of us taxpayers, He will probably not wed or have children nor a life afterwards. So put him a way ffor life or chop his head off now.
I don't condone their crimes, but I do think prison is dished out to long & easily over here, & it isn't a deterent just a cost. IMHO

I see your point. However, prisons, especially state prisons, are not pretty. This piece of garbage is going to state prison. It is far from a hotel. I am not referring to the accomodations or the food. If you knew what goes on in these places you would not have written what you wrote.

Isn't it sad and scary that a guy who aided in what came close to murder and real danger to himans is put away for 25 years while a good man who made mistakes financially is put away for almost 1,000 years!!!!!!!

U know what this is jose's daughter and yea he may have been charged with watever but i kno my father wasnt the one who stabbed the man so its whatever oone can say anything unless they know the story and in my point of view there are 3 sides od the stories his the man and the truth so before yall come out yall mouth about my father make sure u kno the damn truth okay and yes my father is taking a harge for something he didnt do but atleast he is a man to do it so whoever yall are can drop dead i dnt give a damn and im not just sticking up for him because he is my father im stickin up for him because i know my dad very well and i ko he doesnt have the heart to try and kill someone and yes he is in prison doin his time and imma have my dads back regardless of wat he does!!!loveu daddy ur lil nena and grandchild!
