The Union of Orthodox Jewish Congregations of America has withdrawn its a lawsuit against Gas station chain for using a symbol that indicates a product is kosher. Stephanie Dowell/Post-TribuneHammond, IN - A group of orthodox Jews has withdrawn its lawsuit against a local gas store chain for illegally using the trademark sign designating kosher food.
The Union of Orthodox Jewish Congregations of America filed the withdrawal Monday in the U.S. District Court in Hammond. The group had filed suit against Luke Oil Co. for using the kosher trademark as part of its logo. Pictures submitted with the lawsuit showed the trademark, a U inside a circle, next to the name Luke on cups and on a wall above food.
An attorney for the congregation said at the time of the filing that it was important for the kosher trademark to not be misused because Jews and other people rely on it to tell which food is kosher, meaning prepared according to Jewish dietary law. The congregation owns the rights to the sign and approves its use on any food products.
The sign has been absent from stores for a few weeks now, although the lawsuit had continued. According to the withdrawal, the group said it had reached an agreement with Luke.

The only way to protect the trademark symbol and kashrus in general is to file suit. If anyone thinks the OU is out of the money you are out of your mind. Unlike another agency which madea killing on the McDonalds' oil lawsuit a couple of years ago, the OU doesn't do that.

Fact:
The circle U meat packing company used the symbol for decades on their pork sausages.
Whether or not the Circle V meat packing corp is the continuation or not, I don't know,
but there is a circle U food corp in Texas that makes spices.
Rule of thumb:
If the OU symbol is really really big, it's probably a brand or name and not a hechsher.
