Brooklyn, NY - Bus Crash Victims Win 7.5M in New York City Transit Suit

Brooklyn, NY - New York City Transit was ordered to pay a staggering $7.5 million in damages to a pair of Brooklyn women last week for a bus accident, their lawyer said.

Brenda Whaley and Amanda Wade were riding in a car on Ocean Parkway near Avenue U in Brooklyn in 2005 when a city bus ran a red light and smashed into them.

The bus driver alleged the car was at fault, and NYC Transit refused to pay the women. They went to court, and a jury found the bus driver was responsible for the crash.

The cash-strapped NYC Transit had a chance to settle the case for $3 million years ago, but refused.

Instead, the women sued, and a jury awarded them $7.25 million and $250,000 respectively last week.

“This was a good victory, but had the Transit Authority acted reasonably, they would have saved millions of dollars,” said Herb Subin, attorney for the two women. “As a citizen, I’m outraged.

“My client suffered horribly,” Subin said. “Her insurance ran out and she hasn’t been able to get the care she needs.”

A spokesman for NYC Transit said the agency plans to appeal the verdict and declined further comment.

Buses run lights and turn on streets without regard for cars or passengers all the time. Paying millions is not the answer. Accountability is. Any TA driver who drives a bus and such a thing happens should be fired and lose all pension rights. That would make them pay a little more attention.

I just wonder if the economy is surely so bad, where is this family going to get all this money.....believe me, I'm not jealous, but you know what they say, once the word gets out that they have a lot of money, more problems will arise rhan before their lawsuit against the mta.....so stay away fron them.....

These women don't have any leverage to get the transit authority which is a government enterprise to go to the beis din.

Let's see when you are gonna 'sit by the wheel' 8-12 hours per day 5-6 days a week, and still drive acording to the books...

Actually a spellchecker, or any checker, wouln't have helped, as the comment made sense as written, just not in context.

The mere fact that this verdict was obtained does not mean she will ever see the money or that amount. Appellate courts routinely significantly reduce these run away verdicts. This injured person still has a long way to go before she sees a dime, if she in the end gets a dime.
