Tokyo, Japan - One of The Teens In Drug Scandal On Way To Israel

Tokyo, Japan - After reporting in detail on the tragic imprisonment of the 3 Israeli yeshiva bochurim in Japan over the past 2 years, VIN News can report now that One of the teens Yosef Banda is right now in the air flying back to Israel. He left Japan at 10:40 p.m. aboard El Al LY076 from Hong Kong, and will arrive in Israel at 11:00 p.m. Israeli time tonight.

He is being transferred to Israel as part of the Prisoner Transfer Agreement which Israel has signed with a number of countries which fortunately include Japan. Several Israeli and Japanese ministries and numerous activists were involved in arranging the ad-hoc agreement to bring Yosef home. Yosef is the 6th Israeli prisoner which was transferred back to Israel from Japan.

The Israeli request to transfer Yosef was 5 months in the making, and was finally signed by the Japanese Justice Minister on Feb. 24, 2010. As part of the agreement, Israeli police had to send 2 policeman to Japan to escort Yosef on the way back to Israel..

Yosef has spent the months since his sentencing praying, learning, and doing prison work which is not difficult but is carried out under strict discipline. The Japanese allowed him as many visitors as he wanted after fulfilling his prison obligations, which helped hold up his spirits all this time.

Yosef was sentenced to 5 years in prison, and Japan agreed to deduct the 274 days of his imprisonment in Japan (after sentencing) from the total. At the end of the 5 years, the Japanese verdict stipulates that the courts in Israel may, under certain circumstances, add another 3 years of imprisonment to his sentence.

There is a possibility that Yosef will spend Pesach with his family, since prison regulations permit giving a holiday furlough to a prisoner who has served a quarter of his sentence.

Atty. Mordechai Tzivin told VIN News in satisfaction, “This is the beginning of the end of the affair of the bochurim in Japan.”

Together with Dayan Chida Weiss of Antwerp, Atty. Tzivin was involved in helping the boys from the beginning of the case. Yosef’s transfer to Israel was made possible due to the extensive international ties activated by Dayan Weiss, the assistance of Atty. Gal Levertov, the director of the International Department in the State Prosecutor’s office, and Atty. Regina Tapuchi, who directly handled the case.

Others who were pivotal in bringing Yosef home include Rav Yaakov Bleich, the chief rabbi of Ukraine, and communal askanim Aaron Nezri, Elimelech Bindiger, Yaakov Yehuda, and Shabtai Gelber.

Despite the exhilarating news of Yosef’s return to Israel, Atty. Tzivin adds soberly: “We hope and pray that the older two boys will be acquitted and will be able to go home ‘not guilty’ as soon as possible.”

Yaakov Yosef be Reizel’s verdict is scheduled for Wednesday, 9th Nissan.

VIN requests that Klal Yisroel plead for heavenly mercy for Yaakov Yosef be Reizel. Since he is classified as an adult, the prosecutor has requested a much stiffer prison term for him than was given to Yosef ben Itah Rifkah, who was a juvenile/ minor at the time of his arrest.

I'm torn between feeling good for the familiy of this bochur to have him home and safe in EY but at the same time, this sends a terrible message to others who may take the risks of repeating the repulsive act of smuggling drugs. So many of the postings here on VIN keep making heroes and martyrs out of drug smugglers, ganovim and muderers in the name of pidyon shavuim and the simple fact that they are yiddin held in jail by goyim.

Nevertheless, I can't help think about these boys and Toyota (which is Japan). I am not suggesting Mida K'neged Mida only due to these boys but also with regards to Japan's beyond strict penal code. What ever the case is they are getting their just desserts.

you would make a good judge. however there is law involved, which under many circumstances would judge the defendant not guilty. sooo my advice to you, go to law school, practice law for a couple of years and then give your "know it all factual" opinions some thought before sounding like a moron.

No. He is right. We pray for and help these boys as we pray for and help all yidden. We are not judgemental. That is Hashem's job. They were caught red-handed trying in to smuggle in a large quantity of drugs and only their version of the story.

Japan is one of the USA best allies, you should not be wishing them ill. These bochurim did aveiras and were punished justifiably for them.

ל'בחדרי חרדים' נודע, כי בחשבון הכולל ולאחר חישוב הזמן בו ישב בבית הכלא ובמעצר, ישהה בנדא שנה אחת בלבד בכלא הישראלי. את החופשה הראשונה יקבל יוסף כבר בפסח הקרוב, אז ישהה עם בני משפחתו.

כזכור, אתר 'בחדרי חרדים' דיווח על בקשתו של שר המשפטים יעקב נאמן ממשרד המשפטים היפני, שיואיל בטובו לאשר הסגרה של בנדא לארץ, לצורך ריצוי עונשו. הבקשה התקבלה לפני מספר שבועות. תחילה נאמר למייצגי העצור כי כבר ביממה הקרובה הוא ינחת בישראל, לרווחת בני משפחתו, שנאלצו לבלות שעות ארוכות במטוסים על ציר יפן-ישראל, ונקלעו בעל כורחם להוצאת סכומי עתק. ברגע האחרון נראה היה שיש עוד עיכוב, אך המאמצים צלחו והוא יגיע לארץ כבר היום.

שלושת הבחורים שנעצרו בשדה התעופה ביפן, לפני שלוש שנים, כשברשותם סמים, מפוזרים בבתי מעצר ובבית כלא בטוקיו שביפן. השלושה, נשלחו על ידי בן ציון מילר, חרדי מישראל, וטענו כי הלה אמר להם כאשר נשלחו למשימה, כי הוא מבקש מהם להעביר עתיקות ומוצרי יודאייקה. המשלח נעצר - והוא עומד בימים אלה למשפט.

בשבועות האחרונים עלתה האפשרות כי השלושה יבואו ארצה, בכדי להעיד בבית המשפט נגד מי שהפיל אותם אל מלתעות הפרשייה הסבוכה. הדיון בנושא ממשיך, במקביל למאמצים להביא לעונש מופחת לשני הבחורים שטרם נגזר דינם.

משפטו של הקטין מבין השלושה הסתיים לפני מספר חודשים, וגזר דינו ניתן בהיכל המשפט היפני. הוא נידון ל-8 שנות מאסר, עם ניכוי שליש על התנהגות טובה.

העצור השני, יוסף גרינוולד, עומד בימים אלה למפשט ומספר דיונים כבר נערכו בעניינו. בדיון האחרון זכה גרינוולד למשלחת חיזוק מכובדת, בראשות האדמו"ר מזלוטשוב, שהגיע לעודדו.

r u outa ur mind guilty as sin just cause a couple of kids got fooled into doin somthin stupid doesnt mean they r guilty it could happen to any of our kids may we b zoiche to see all of them back in isreal bkarov

Why do you say they are guilty as sin? That is a bit harsh - they were duped and you know it. The only thing they are guilty of is being naive and gullible.

When davening for these boys, don't forget to also daven for Gilad ben Aviva - Gilad Shalit. His situation is far closer to pikuach nefesh than these boys.

Israeli jail "ain't no picknik", but thanks to Shas you can have a minyan, mehadrin food, full time kollel (and in some cases, like his, go home for Pesach and Succos). Plus they speak your language and ppl don't have to fly to the other side of the world to visit you.

It is still jail, but it's INCOMPERABLE.

You Moron 2 years in a Japanese prison and another 3 years in an israeli prison i sort of think he did his time you can show a bit of compassion for a very obvious innocent boy

Why? They broke the law as well; they just thought they were smuggling antiques at least that is their story. They also were getting paid for thier act.

Have you ever heard of Pidyon Shvuim? Bikur Choilim is a Mitzvah and Pidyon Shvuim is also a Mitzvah. To do both is a great idea.

I am jealous of Dayan Weiss too. Have you ever heard of Reb Leiv Sorah's?

To those who say that these boys should, CH"V sit in prison, what would they say of one of those boys was someone dear to them and they know that boy made an innocent mistake and did not intentionally smuggle drugs but thought, as reports indicated, they were bringing in antiques? How can any rachman ben rachman wish ill on these young boys?

To David, I take it you were on that plane and that's how you know they're "guilty as sin", or are you a prophet? Or, perhaps, just as a sin can be committed without any knowledge one is sinning, perhaps that's what you meant?

Perhaps "guilty as sin" was a poor turn of phrase, but I think the rest of his comment is valid. Yes, the bachurim involved deserve our concern. Yes, we should continue to pray and work for rachamim.
