Shomrim police last week looking for the vehicleBrooklyn, NY - VIN News has learned that the reported abduction of a ten year old boy in Borough Park last week has turned out to be nothing more than an unfortunate misunderstanding. Official reports state that the boy darted out onto 48th Street between 14th and 15th Avenue and was nearly hit by a passing jeep. The driver of the vehicle, a Hispanic male, got out of his car, grabbed the boy by the arm and yelled at him, prompting some to believe that the driver was attempting to kidnap the boy.
Both local police and Shomrim spent three hours searching the area and an arrest was made later. The driver of the vehicle has since been released and was not charged.

you have a young kid screaming he was grabbed so ppl came running thinking it was a kidnapping, the driver explained his side and was released with no fines or trial. the system worked. what's your point with lawsuits and he's right?? sounds like a terrible thing was done to the driver, that's just not the case!!

did the boy and shomrim mess up here? yes. but come on, why did the driver think he could grab a random kid's arm and not be accused of something sinister? i've had my share of kids running in front of my car, and all i've ever done about it was roll down the window and yell at them to stay out of the street. if a stranger had grabbed my child's arm, i hope they would run away screaming "stranger danger" at the top of their lungs no matter what the person's intent!

I just witnessed a guy robbing a saw from an mta construction site. He was caught by shomrim, held for police to book him. when the mta site manager showed up, he said sorry my superiors dont want to press any charges, they took it as a mistake and that was it!

what no one seems to mention is that this kid was scared due to him being almost killed and in all probability he did not identify the vehicle on his own, there must have been other witness etc.
Those who helped him identify and assess the situation mainly those who witnessed the incident were to blame - they ultimately got the truth out by thoroughly grilling the boy after the fact- that should have happened before the suspect was arrested! And the correct term is "perp".

But he definitely committed a crime, and he can still be charged in civil court, and would probably have to pay nominal damages.

Are you nuts? If a stranger could stop your kid from getting hit by a car again wouldn't you want to say THANK YOU to this Hispanic male? This boy is not dead cause God wanted him to live! However, the driver cannot touch the child! Besides, he probably did it cause he himself was allll shaken up and gave out his frustration on the child! I do agree that many times I see children running into the streets without looking, but that's NOTTT only in BP!!!! (checkout the percentage in the Hispanic area) Regardless, leave the touching and disciplining to the parents and the most the driver can do is yell!

As a lawyer I suggest you study harder. There is no crime of battery in New York. A "charge" in civil court pertains to civil not criminal damages. If the facts in the article are correct and the plaintiff (possibly the boy or his parents) sued they would have to pay the defendant damages which would not be nominal.
Your professors in both criminal and civil law would not be amused.
