England - Judge Goldstone Responds to Death Penalty Story

England - The England based newspaper The Jewish Chronicle  asked Judge Goldstone to confirm the report in Yediot that as a judge in the South African court of appeal, he sentenced 28 people to death. Here is what he had to say:

  I have seen a translation of today’s “preview” in Yediot. The facts relating to the death penalty are:

  1. During the nine years I was a trial judge from 1980 to 1989, I sentenced two people to death for murder without extentuating circumstances. They were murders committed gratuitously during armed robberies. In the absence of extenuating circumstances the imposition of the death sentence was mandatory. My two assessors and I could find no extenuating circumstances in those two cases.

  2. While I was a judge in the Supreme Court of Appeal from 1990 to 1994, all executions were put on hold. However, automatic appeals still continued to come before the Supreme Court of appeal. We sat in panels of three and again, in the absence of extenuating circumstances, some of those appeals failed.

  3. It was a difficult moral decision taking an appointment during the Apartheid era. With regard to my role in those years I would refer you to the joint public statement issues in January by former Chief. Justice Arthur Chaskalson (the first CJ appointed by President Mandela) and George Bizos, (Nelson Mandela’s lawyer and close friend for over 50 years). The statement was published  in full by the South African Jewish Report on about 23 January…

  Finally, I would say that these events took place 25 - 30 years ago. At that time a number of democracies had not abolished the death sentence. I do not understand why my actions as a judge im those years precludes me from campaigning today against the death sentence or precludes me from judging war crimes whether committed in the former Yugoslavia, Rwanda or the Middle East.

Anomalous for an American to condemn a judge for issuing a death sentence. Affect change in your own front garden first - particularly when it comes to passing down the death sentence on black males in the Confederate States who have not been given adequate legal representation by any standard.

You will have to come up with evidence that Judge Goldstone sentenced INNOCENT people to death. If you can not do that, then you should keep your mouth closed. Every country on the planet has criminals of every sort: murderers, rapists, burglars, scam artists and every country on the planet has a judicial system to punish these people whether it's apartheid Africa, Taliban Afghanistan, China, Cuba, U.S. Israel, or the Netherlands. Besides, Goldstone was was an appellate judge for period that reviewed a lot of the death sentences, this means that original trial court judges sentenced the same people to death and he just reviewed the process.

What Israeli media is doing is a desperate last ditch attempt to smear a judge and assassinate his character to deflect attention from Gaza war probes that he conducted in hopes the credibility will be questioned. This age old ad hominem argument against Goldstone will not help Israel gain sympathy from the world. It only makes you look more suspicious and guilty.

Frankly, I do not care a bit about his track record as a judge, not the death penalty issue, not the apartheid. I am focused on the blatant lies, distortions, and false conclusions of his report on the Gaza War. He disqualified any evidence that indicated that Hamas used civilian shields, and he fabricated war crimes against the only country in the world that risks everything to protect civilians anywhere (yes, more than the US). I think that such dishonesty is damaging and dangerous, and that he should have nowhere to walk on this planet where he will encounter anything but solid ridicule and distrust. I would not trust a liar like this to lend him a dime.

What a liberal small minded dohdoh are you. When when writes about the comparison to the Nazis, no one is comparing the level of atrocities. Who hit or killed harder or worse. The 'confederate states' haven't existed since 1865. Analogy fail.

The equal protection clause safeguards the right to fair and equitable representation regardless of the defendant's race. Comparing it to apartheid is both disgusting and a disgrace to people who actually suffered through the apartheid system. Go back to whatever foreign country you crawled out of before you lecture Americans about our legal system.

Yes, blacks accused of crimes in South Africa certainly did have fair trials. They didn't have to prove their innocence, the prosecutor had to prove their guilt. South Africa, for all its faults, was the freest and most democratic country in the region. There is no reason to doubt the guilt of any of the murderers Goldstone sentenced, and this entire line of inquiry will lead nowhere. Goldstone is a bad Jew, a traitor to the Jewish nation, and his report on Gaza is a hack job; but from all accounts he was a good judge.

Did you read the report in the Yediot? Apparently not.

Here are a few facts that you might have missed:

1 Judge Goldstone wrote that hitting a convict is a proper way of punishment.

2. Judge Goldstone did give clemency for a white murderer but never for a black man.

3. At the end of the apartheid regime the laws were changed and any black person could be held in jail without ever seeing a judge. Prominent judges resigned in protest but not judge Goldstone.

4. Since Israel boycotted judge golstone investigation into the so called "war crimes", all his investigative material was provided either by Hamas or by Israeli left wing organizations like Betzelem.

Anyone drawing any conclusions from a terrorist organization and from self haiting Jews, must be a self hating Jew himself like you.

Now about the logic (which you are apparently so gifted with...). I will try to make it simple. If you or judge Goldstone where active during WWII, you would be arguing for Hitler.

Our biggest enemy is our own self haters like you and Judge Goldstone!

If you try to defend goldstone on basis that the accusations against him are false how about the baseless and false accusations he made against isreal?

So he is the one who is aloued to make false accusations and he doesn't have to prove that the ones he is accused off are false?
