Park County, CA - Woman, Hit by Car, Sues Google for Faulty Directions |
|
Park County, CA - Lauren Rosenberg says that the Google Maps BlackBerry application told her to use Deer Valley Drive—a highway also called Utah State Route 224—to walk from one Park City address to another.
However, the directions did not tell her that there were no sidewalks along Deer Valley Drive, which, Rosenberg alleges, led to her being struck by traffic.
“As a direct and proximate cause of Defendant Google’s careless, reckless and negligent providing of unsafe directions, Plaintiff Lauren Rosenberg was led onto a dangerous highway, and was thereby stricken by a motor vehicle, causing her to suffer severe permanent physical, emotional and mental injuries,” according to the complaint filed in Park County district court.
Rosenberg is asking for Google to pay her medical expenses in addition to punitive damages and loss of earnings. She is also suing the driver of the vehicle, Patrick Harwood of Park City.
Google Maps warns users about walking directions on its version for computers, saying that “Walking directions are in beta. Use caution—This route may be missing sidewalks or pedestrian paths.” However, the mobile version of Google Maps does not come with the warning.

When the sidewalk ended she should've stopped. Google didn't force her to walk in the middle of a highway. She could've seen that there was no sidewalk.

With all due compassion for this woman's plight, this sounds absurd on the face of it. Could she not see for herself that there was no sidewalk?! Can anyone involved in a car accident sue Rand McNally for not indicating that there may be other vehicles on the road? If she felt the road was unsafe, why did she continue to walk there? This is just craziness.

Was her lawyer also hit by a car? No sane lawyer would take on such a case, I guess he too is suffering from severe psychological damage.

Idiotic. She should have used common sense.
I recently rented a GPS unit with a rental car, and every single time I switched it on I had to click a release that 1) I would not operate the GPS while driving, and 2) They would not be held liable for faulty instructions. Because of idiots like her.

Sounds like you are as dumb as she is. Are you going to follow google's directions and drown in the ocean? There is a minimum amount of common sense required. It sounds like this woman should be diagnosed as having "intelligence below minimum requirements."

Let's get our "Daily Dose of Lomdus" here...
ממה נפשך, if Google is at fault (they aren't), how can she sue the driver - the driver had every right to be driving down the middle of the road without sidewalks? And if the driver IS at fault (he isn't), than what did Google do wrong? All the program did was send her down the road, where a faulty driver was waiting to knock some sense into her?

I think she should sue blackberry or whatever phone she was using. How dare they let suck fatal content show up on their screen. I mean, can you imagine if she googled a zoo and then she gets bitten by a tiger? If i wer her, i'd also sue her phone charger compnay who allowed such a dangerous device to recharge, leading to her near-fatal experience.

I know someone whose GPS told him, he was in the Atlantic Ocean. If he was really heading for the ocean, don't you think he'd have the brains to stop before he sank into the water? GPS is just a tool and you have to use your brains and not only rely on what it tells you.

I think she should sue her parents and her school teachers for teaching her to read! and sue the Shoe Company that provided her with the ability to walk! Reminds me of the bloggers who blame everything on other Men that talk in Shul! Its time people grow up and start taking responsibility for their actions.

I believe she should sue g-d for her being created. Then her parents for birthing her. Next she should sue her teachers for not educating her. The list could go on on on on and on. DUMBBELL sue yourself and have a life the way you made it happen.
