Photo by Yossi Zamir/Flash90.Israel – A compromise proposal enabling the release of the parents of the Emmanuel students was approved Sunday by the High Court of Justice, after being presented by the parents and petitioners with the approval of the State Prosecutor’s Office. The judges ruled that the incarcerated parents would be released on Sunday.

    The decision followed a compromise deal struck on Sunday morning between Shas spiritual leader Rabbi Ovadia Yosef and the Slonim Rabbi, religious leader of the Ashkenazi families who had refused to send their daughters to the mixed-ethnicity school.

    “It seems that in the country today, decisions are made by the Gedolei Yisrael [Israel’s foremost Haredi rabbis] and no one else,” said one of the fathers.

    “We reached highs we shouldn’t have reached, I hope the matter is indeed concluded, “Judge Edmond Levy said, noting that “we are one people after all.” Petitioner Yoav Laloum heralded the “end of discrimination in Emmanuel” at the end of the hearing.

    Shortly after the ruling, the imprisoned fathers who arrived from the Maasiyahu Prison, stepped out of the court into a crowd of hassidim who welcomed them with ovations, song and dance. MK Yakov Litzman (United Torah Judaism) was also present and said, “This is our victory which showed the whole world that one can sit in prison in order to better educate our children. The High Court won’t acknowledge its mistake – but it made a big one.”

    One of the fathers who were released said, “The decision is very pleasing. We got in jail since a doubt had been cast on the authority of the great minds of our generation, for this we were imprisoned and we were wrongly accused. Not only is there no discrimination (in Emmanuel) but there is true partnership.” He further noted, “Prison is not a pleasant place, but we were greatly strengthened by the massive support. At the end of the day, the court accepted the appeal of the generation’s great minds.”

    According to the proposal, the students will return to the Beit Yaakov school for the school year’s remaining three days and will study the “love of Israel” together, without separation. During the subsequent summer holiday a long-term solution must be found and presented to the court by August 25.

    The High Court judges appeared satisfied with the compromise during Sunday’s hearing. Judges Edmond Levy and Hanan Meltzer, however, emphasized one point: The parents’ representative must acknowledge that the compromise is within the implementation of the court’s previous verdict, which revoked the discrimination in the school. The parents’ attorney agreed and handed the proposal to the prosecution, which after careful examination accepted the compromise as well, and confirmed it upholds the verdict.

    The parents’ lawyer, Attorney Mordechai Green said, “The spirit of Judge Edmond Levy’s decision from Friday made us understand that the judges want the verdict to be followed to the full. It was then decided to reach an agreement. The honorable Rabbi Ovadia Yosef sees it as a solution to a social problem. The girls from Emmanuel are currently very confused.”

    During a break in the hearing Laloum said, “According to Rabbi Yaakov Yosef’s instruction, we made it clear we wholeheartedly accept Rabbi Ovadia Yosef’s proposal. This decision has already ended discrimination in Emmanuel, this case has run its course.”

    Attorney Shosh Shmueli of the prosecution said, “We welcome any agreement which upholds the verdict.”

    The agreement noted that following consultation with their rabbis the two parties renounce any disagreement, call for the cessation of mutual slanders, and agree that educational establishments must accept students solely on the basis of religious background and not according to ethnic affiliation. It was further agreed that there was no room for separations and fences in the school. The petitioners also agreed that the parents be allowed to establish a separate school on the following school year.

    According to the agreement, during the next three days the school will hold conferences and lectures for students of all courses “in support of unity and the love of Israel.”

    Shas chairman Minister Eli Yishai attended the hearing and said prior to the official approval, “I am confident that ultimately this sad and painful affair will end to everyone’s satisfaction with love and unity. I do not think it is just to take a girl, put her in a school where she is shunned, and be coerced to study there. The solution is not the High Court but getting up and doing the right thing. ”

    Some 30 haredi worshippers also arrived at the Supreme Court Sunday and read out chapters of Psalms. Police and Border Guard forces were present at the site to prevent any possible riots.

    who remembers when the slonimer rebbe said , that even one day he will not allow his chassidim to send the kids to a mix school, and today he allowes 3 days.
    did the torah change overnight???????????

    The Slonim group can open their own school next year. Thus, the Charedim stood down Secular Israel and won the batte. The Secular exposure to the Charedi World is through watching demonstrations on television. A few hundred Charedim protesting another chilul Hashem does not frighten them. The only time they see the 100,000 plus ‘sea of black’ is at a funeral of a Gadol Israel. Rav Rav Shach, zt”l was niftar on Erev Shabbos, not enough time for such a turnout, Thus, it has been many years since the Secular has had the wits scared out of them. Last weeks country wide demonstation, highlighting the unity of the Charedi World, e.g, Chassidim, Litvak, Sefardim, put the sheker of the Medina into clear relief, and bought those loyal to Hashem at least 10 years of quiet.

    It’s wonderful that a compromise was reached and that the mothers will not have to sit in jail. If the Slonimer Rebbe Shlita had foresight perhaps this compromise could have been reached earlier and even the fathers would have not had to sit. Not only that, but instead of wasting 3 hours demonstrating, 150,000 could have been learning Torah. 450,000 hours of Torah wasted on this!!! Not to mention the hundreds of thousands of Shekel wasted on legal fees!!!

    After reading the interview with Rabbi Yaakov Yosef, I have no idea who to believe. It’s a sad day when there are no true leaders you can count on to get the unbiased truth. Bottom line is do your own thing.

    What kind of comprise is this I would call is capitulation by the Slonimer Rebbe the sefardim won they got everything they wanted. Sorry chasedim but you were fooled big time you went to prison thinking that you are being Moiser Nefesh for your daughters Chinuch, at the end of the day you accomplished nothing

    Bottom line : it all boils down to a few dollars $$$$ !!!! . I think the only ones that demonstrate l’sheim shomayim is satmar & the kanayim. where were all these “mekadesh shem shomayims” when they were digging graves ? or the Karta chilul shabbos parking lots etc…..

    Y’all are so wrong. Slonim won a real victory. They get their exclusive Chassidic school nex year. For three days the children will learn some meaningless class together. This was face saving for the court and the Sephardim.This was a game of chicken and the Sephardim swerved. Meanwhile a Sephardi child knows that they can’t enter Charedi society and maintain their heritage. Rav Ovadia’s ranting againsdt going to Ashkenazi Yeshivos was an admission of defeat. The Rav was saying spare yourselves the agony of trying to please heartless biased Ashkenazim. Let us all make believe we quit and not face the fact that we were fired. Spare yourselves facing the sneering Ashkenazim who won’t let you in to contaminate their kids,and when confronted will call you mechlelei shabbos,secular influenced wild unreliable people.

    I do not know what arrangements were made, but the rule to the farshtunkener courts and evil judges MUST BE MADE!
    Never mix in to religious matters, hundreds of thousands of Torah hours would be lost to have sent this point across, and if this was not accomplished, all went to waste!
    The non-nazi Israeli courts MUST be put in place – ONCE AND FOR ALL!
    THIS MUST NEVER NEVER HAPPEN AGAIN!!
    As they say in Israel – NEVER AGAIN!

    reply to #1 . the decision is as follows . slonim wil open a new school next year. for now there will be a YOM IUN for all girl schools in Emanuel (4 in total) slonim track will attend as well.

    Wasn’t this what was demanded in the first place by the courts? The government told them they could start a private school NEXT year but not for the remainder of this year. The reason why people couldn’t send their kids to Bnei Brak was because legally municipalities can only spend education funds on residents. This is why you can’t live in Beitar and send your kids to Beis Yaakov in Har Nof. What was accomplished by all this?

    that unfortantlly the torah changed overnight ,(not that i agreed with slonim in the first place )
    just wait and see ,

    If you read it you see that Slonim Won big time. They are not going back to school. They are spending 3 days listening to speeches from Rabonim together. Then they are being allowed to open ytheir own school which the court and education ministry had denied them until now. So they won.

    can everyone open their eyes.Yahadus charedi lost big time. the demonstration was to protest that the rabonim are above secular law( seperate schools was a by product) but the judge stood his ground and all parents at the end signed and the “compromise” adhere to “his ” verdict.

    2. Satmarer Bros. who should receive Shishi and who should be buried
    next to the Divrei Yoel ,decided by a African judge.

    camp will Bobover send their children or which Nigan for Lecho Doidi.
    4.Emanuel Shkozim with so called 2nd class Rabonim ran to court for Chinuch guidance decided by several women and 2 Lokshen experts.
    4. Kahaneman/Markowitz of Ponevez who should get Shlishi or say
    the Psiche at the Yarchei Kala is still in court litigation.

    Just on the threat of the women going to jail, one woman already miscarried. The rebbe weighed his options. He could take a bullet in his own chest, but watching the women being carted off to jail would be too terrible a tragedy. After the judge conceded that they could have separate schooling next year, if they agreed to this compromise, it would have been foolish to turn down that offer, even though the parents are being forced to do things that they shouldn’t be forced into. Yes there is a loss, conceding to the reality that the courts are more powerful. But there is also a victory, in that the courts won’t be so quick to open future cases attempting to control charedi chinuch. So the rebbe’s fight was certainly not in vain.

    they have to say that and think that since they think that their Gedoleim are never ever wrong and cannot make a mistake.

    Which of course is against the Torah since the Torah showed us even Moshe could make a mistake I think rashi mentions that

    You are 100% right!!! The court granted the right what they said from the beginning that they want their own school. And now, who has the last laugh?? You bet, the Slonimer Chassidim. THE GOVERNMENT AUTHORIZED IT, THE GOVERNMENT WILL HAVE TO FUND IT TOO!!!!!!!

    By definition “a compromise proposal” means there are no winners. Each side can claim a victory on certain things, but on the whole, it was a VERY sad episode for the jewish people. If only the Slonim Rabbi and R’ Yosef had sat down to work this out weeks ago….

    The Chareidim(sefardim & ashkenazim) won and the judges saved face. Before this “compromise”, the “supreme” court wouldn’t allow a separate school next year either.

    Compromise is always good, we shouldn’t deride the Slonimer Rebbe for compromising, it’s a shame that the Slonimer Rebbe couldn’t bring himself to compromise earlier to compromise for the sake of equality. The sad truth is that this was discrimination all along and girls were rejected based on Sephardic background not on religious background. We should’ve focused on the real issue which is, are we Charedim correct in discriminating against Sephardim. Unfortunately it took the hated Israeli secular court to bring our “Gedolim” to their senses just as the blogosphere forced them to pay attention the child abuse problem. When are we going to get REAL leader addressing the REAL problems?

    The slonimer Rebbe spoke tonight and adressed all your questions and it was aired in all local media. The two things he said that we need to be Moisser Neffesh on and will not budge even if he is put in front of a firing squad
    1- The rebbe said the school will reunite.
    The Rebbe proposed all along, that If all Schools in Imannual will come together for a three day seminar his school will join. Last night at 1:30 am Mr. Lalum was still not accepting this (untill Rav Ovadia got involved and left him no choice)
    2- The judge up on till this morning (see his letter that he wrote on Fri.) Insisted that the only way the parents wll get out of jail, is if they sign that they accept the court order although it is inconsistent with Daas Torah
    The parents said they will not sign and were released scott free

    Ashreinu ma tov chelkeinu that our gedolim will not bend ther hashkofos for the BAGATZ

    The Bagatz is the Supreme court of eretz yisroel. If it makes “our gedlolim” happy to say they did not bend, thats wonderful but who cares. They recognized the authority of the court and secular law and thats all that matters. If they want to say they “won” thats fine too.
