Washington - It was a very serious subject—- law of war issues—- but Sen. Lindsey Graham of South Carolina turned it into a lighter moment during questioning of Supreme Court nominee Elena Kagan.

During today’s Senate confirmation hearing, Graham asked Kagan where she was when the an attempted terrorist bombing of an airliner took place near Detroit on Dec. 25, 2009.

“I’m assuming the question you mean is whether a person was apprehended in the United States is ..,” Kagan began.

“No I just asked you where you were at on Christmas,” Graham interjected.

Kagan chuckled and said,  “You know, like all Jews, I was probably at a Chinese restaurant.”

“Great answer,” Graham said over the laughter in the hearing room.

Actually, most Jews I know, no matter what level of observance, ARE out in restaurants that day. There's no traffic and nothing else to do because there's no work and everything is closed except for kosher (or otherwise "Jewish") restaurants.

There is no question that religion did not hamper or would not have hampered her ability to act that evening so it was just a vitriolic appeal to anti semites all over to note that she is a Jew. The senator is from South Carolina, not the far side of the moon, so he is almost certainly aware that Jews don't celebrate Dec. 25th. He was pointing out that she is Jewish and doesn't believe in Jesus - and in his home district being a Xtian is a big thing. This definitely hints at anti-Semitism. Mr. Graham should reread the Constitution and the Bill of Rights, particularly the First Amendment which guarantees freedom of religion. She did the right thing by answering with a joke and not giving him an excuse to stretch the issue out.

What does Graham's support for EY have to do with his asking a dumb and obviously inappropriate question. She did a great job of saving him from his own stupidity by deflecting the question with a funny answer with a joke that probably everyone watching was waiting for.

Please,if she was miguel estrada you would highlight this point over and over and demand her withdrawl.Her answers are inadequate and not exactly truthful.Aron barak turned the court into a liberal lawmaking activist court in the most absurd fashion.Thanks to him the court is now the most activist court in the worls.To qoute a rabbi from LA.

There's no such thing as an illegal question. Senators can ask whatever they like, and can vote on whatever basis they like. And knowing Graham the question was probably coordinated in advance with Kagan's staff; his vote for confirmation is in the bag.

I agree with Commenter #23--Uninformed people should not be making negative comments about Senator Graham. Keep in mind that both Houses of Congress are expressing very strong support for Israel now, including this senator. He deserves credit for this--and our hakoras hatov.

She belongs to the Reconstructionist sect, told off Rabbi Shlomo Riskin at the tender age of 12, and admires the worst judge in the history of the world, in the opinion of Jewish judge Richard Posner. She is pro-disengagement and pro-2 state, and does NOT speak for me as a Torah Jew.

I am from the state of south carolina and this is only the latest of a string of embarressing comments made by politicians from here. From the infamous "You Lie!" shout heard around the world (made by Congressman Joe Wilson) to the
"giving welfare breeds stray animals" comment made by Andre Bauer, if you heard some comment making the news, it probably came from SC. All i can say is that not all of us are like this.

Actually in the United States it is difficult for an official not to stand up for Israel. Believe you me as much as Obama's policies have been challenging to Israel, they could be a whole lot worse if he had his way. At the moment he simply does not have the power to completely throw Israel under the bus. That says a lot about the power of the Jewish lobby in America. May it continue amen.
