Monsey, NY - Couple Spared Jail After Repaying $76G Stolen From Welfare Programs |

Monsey, NY - A married couple were spared jail time today because they repaid $75,899 stolen from welfare programs.
Their lawyers also convinced the judge that the couple stole to take care of their large family following losses in the real estate market.
The couple, who have 12 children, depended on the ultra-Orthodox Jewish community to repay $26,238 in federal Section 8 rent subsidy benefits and $49,661 from Medicaid, their lawyers said in court.
They pleaded guilty on March 5 to third-degree grand larceny, a plea that covered a charge of second-degree welfare fraud.
The judge said today that he didn’t send them to jail or prison because they repaid the money and their lawyers convinced him that the couple’s motivation was based on need, not greed.
The judge said that while stealing is never excusable, he tries to distinguish between those who steal for personal gain and those who steal to feed their families.
Both told the judge they were sorry.
The couple had faced between four and 14 years in prison.
The Rockland District Attorney’s Office agreed to a no-jail sentence if all the money stolen was repaid, as did the U.S. Department of Housing and Urban Development and the Rockland County Department of Probation.

Yes I am happy that this couple who seem truly contrite will not serve jail, however jail serves as a deterrent. If everyone who committed a crime knew that the worst he can face is repayment and no jail time then we would see more people committing crimes.

But the way the gov't programs were set up is unless you're dying and homeless, you can't qualify. They were probably entitled to it and not living a life of luxury, but barely scraping by. And instead of fighting and paying lawyers fees, were better off just paying it back and moving on with their lives. To support 12 children, you have to earn a minimum of $250,000 per year, anything under that you're barely scraping by. So I can see why they needed the aid.

while I am glad that this couple spared jail, I think all of the above comments are selfish. If they didn't deserve this money and took it anyway they ultimately hurt other people that are trying to do the right thing. ie, if there were no sect8 then apartments would be much cheaper both to rent or to buy. If there were no food stamps then the groceries would have cheaper prices. If there were no 'unearned income credit' maybe maybe I would be able to afford going to the country.

How about keifel? Is that achzariyus? Although modeh b'knas is patur, keifel sounds like something you wouldn't agree should be in a Torah of chessed. The truth is that too much chessed is achzariyus, and only hurts society in the long run.

The couple were each represented by their own attorney and one of them was the best criminal defense attorney in Rockland - Bill Frank. Judge Apotheker is a strong judge but a mentsch. This deal was the result of plea bargaining and negotiating - and good faith representations on the part of the accused. They are both convicted felons now even though there was jail time so it's not like they got off scot-free.

It seems as if you haven't learned any G'moro in Seider N'zikin. As any Yeshiva student will tell you, Moideh Biknas is Potur. In English, this means that if a person goes to a Beis Din and admits a theft (before 2 valid witnesses testify against the thief) he pays only the Keren (principal) and no Keifel (twice the amount of the theft).
Keifel is a K'nas, which means that is a penalty enacted by our Chachomim (sages).
So ... is it really that crazy (looking at it from a Jewish perspective)?

Alas, no matter how the story shakes out, we have our disagreements. As always in each case I rely on the judge to make the proper decision, it goes without saying, that if the defendant shows contrition, without resorting to a public relation blitz, it will go a long way when it comes to sentencing. As long as the judge has discretion they should use it for the betterment of the system, if they feel it is warranted. I applaud this judge for having the courage to do what he thinks is right.

No, it was a kiddush Hashem that they realized their mistake, owned up to it, and were helped by the community to repay. They have criminal records and will be under surveillance which is fair also.

You are wrong for 3 reasons (i.e. they would not have to pay Keifel):
1) The evidence against them was (most likely) not by 2 valid Eidim. Circumstantial
evidence (paperwork, DNA etc.) is not considered Eidus to impose a K'nas.
2) There is no K'nas Bizman Hazeh.
3) There is no K'nas in Chutz Lo'oretz.
