Jerusalem - Flag Burning Yeshiva Student Claims Freedom of Expression

Jerusalem - An ultra-Orthodox yeshiva student indicted for flag-burning has asked that the charges be dropped as protected freedom of expression. The student’s lawyer also told the Jerusalem Magistrate’s Court that the law, as it stands today, is effectively a dead letter as it doesn’t specify intent to dishonor the flag - and so many Israeli citizens effectively break the law on a daily basis without ever being charged.

According to police, Yehiel Hazan, a 20-year-old Neturei Karta yeshiva student from Jerusalem, burned the national flag on Yom Hazikaron (Memorial Day ), during a demonstration in the city’s Shabbat Square. The police prosecution service charged Hazan with desecrating the flag and with rioting the following day. According to the indictment, Hazan held the flag up on a pole and set it on fire, and later stamped on it along with others.

Hazan’s attorney Yair Nehorai asked the court to drop the charges. “Although no one disagrees that the burning of the Israeli flag is a hurtful, insulting and provocative act, the court is requested to rule that the offense to public sensibilities as described in the indictment is not grave enough to stand up to the criteria allowing infringement on freedom of speech,” the lawyer wrote. “In balancing the values of freedom of expression and public sensibilities, freedom of expression clearly takes precedence.”

Nehorai reminded the court that when Chaim Miller, while deputy mayor of Jerusalem, described the flag as “a stick with a blue and white rag on it,” the Attorney General at the time decided not to indict him, a decision that was upheld by the Supreme Court.

“Clearly, the enforcement of offenses of this kind should be extremely rare, if at all,” said Bar-Ilan University constitutional law professor Ariel Bendor. “I don’t think the law should be enforced even if the offense was carried out with a clear intention to desecrate the flag to deliberately offend people or demonstrate a lack of patriotism - but not in the context of incitement and trying to cause rioting.”

Bendor said the case raises questions of selective enforcement, as the law is not usually enforced even when the desecration of flag is intentional.

Nehorai also argued before the court that many Israelis inadvertently break the law every day - for example, by mistakenly raising a torn or damaged flag, or by stepping on flags on the street on days like Independence Day. Dirty and ragged flags can often be seen in government institutions, even in courts, the student’s lawyer said.

Jerusalem Magistrate’s Court Judge Dov Pollock is expected to address Hazan’s request shortly. Nehorai said he will appeal to the District Court if the charges are not dropped.

I am pretty sure that "Freedom of Expression" is a secular concept. Loshon harah is freedom of expression but forbidden. The individual is trampling on the very symbol that he is seeking protection under. As usual the Neturei Karta contradict themselves by the very nature of their own acts.

The problem with this for this young man and his friends is that if he has freedom of expression to burn flags, then chilonim can turn around and argue they can run through mea shearim in shorts or drive through religious neighborhoods on Shabbat/chagim as part of their freedom of expression.

The US Supreme Court has ruled a few years ago that burning the Flag is a form of Free Speech and since then legal in the US to burn the Flag

The point is that the Israeli Court DOES believe in such concepts, and overturns laws all the time based on them, so it should be consistent and uphold this defendant's civil liberties too. Or do civil liberties apply only to leftists and Arabs?

The point of civil liberties and democracy is that it applies to everyone, whether they believe in it or not.

What an ignoramus. In the USA it is NOT against the law. In the USA you have every right to burn a flag, so long as it belongs to you, and you observe basic fire safety, and it's not made out of material that emits toxic fumes when burnt.

As a non-zionist, I think that flag burning is just plain moronic. It shows the world that the blue and white flag, which indeed is what Reb Chaim Miller called it, a schmatta on a stick, actually has power over us. Just ignore it and turn your back to it, but don't make a fool of yourself and the rest of us who see the flag as an emblem of kefira by burning it.

Doesn't matter. Freedom of expression doesn't have limits depending on the neighborhood. If you have the freedom to burn the Israeli flag in Mea Shearim, then why would a chiloni person not have the freedom to drive through there on Shabbat?

Because the cases are not parallel. The chilonim already drive and go half-naked in their own neighbourhoods. So by what right do they tell Meah-Shearim residents what to do in theirs?

Unfortunately they already have that right under Israeli law. They put mezuzos in urine, and claim it's free speech. Only now do they decide to impose limits on expression.
