Israel – Rabbinate Takes Action in American Jewish Divorce Case

The man, who has refused to give his wife a divorce, was detained in Israel following her request; she is also a U.S. citizen.

    The court order was made possible by a law that allows Jewish women to sue for alimony and child support in Israel – and to enforce sanctions on husbands who refuse to pay – even if they are not Israeli citizens. The law does not allow for the detention of recalcitrant husbands merely because they refuse to give a divorce, but it is quietly understood that if he agrees to grant the divorce, other proceedings against him will usually be dropped.

    The case at hand involves a hareidi-religious couple from New York City with one child. The husband and wife have been separated for several years, but the man refuses to grant a Jewish divorce or to pay child support, despite having been ordered to do so by a rabbinic court in New York. The woman has accused her husband of verbal and physical abuse during the course of their marriage, and says she was forced to flee New York due to his threats.

    In the U.S., rabbinic court sanctions generally cannot be enforced by civil courts. In Israel, on the other hand, courts are allowed to forbid a man who refuses a divorce to leave the country, to revoke his driver’s license, and even to send him to jail. The Rabbinate has also published the pictures of missing recalcitrant husbands in an attempt to track them down.

    The law allowing Israeli rabbinic courts to help non-Israeli Jewish women who are being refused a divorce was the brainchild of the Merkaz HaYehudi HaBein-leumi (International Jewish Center). The center was founded by Rabbi Tzuriel Bubliel, an attorney himself, and Attorney Avivit Moskowitz, with the goal of assisting “agunot,” Jewish women denied a divorce; the law aims to bring non-Israeli cases into Israeli courts where rabbinic judges have more tools with which to enforce their decisions.

    Under Jewish law, a woman is not allowed to remarry until her husband gives her a divorce document (known as a Get). If she enters a new relationship without having received a divorce, the relationship is considered adulterous, and children born will be illegitimate. A man is also forbidden to remarry until his wife accepts a divorce, but if he does remarry, the marriage is not considered Biblically adulterous.

    Great move….if we could indefinitely incarcerate those dreche men who refuse to provide a get to their wives, the problem of agunot would disappear in short time. Once he leaves EY, the courts will have no leverage but the more we can make these men suffer, the quicker they will capitulate.

    It is not always the husband’s fault. Sometimes the wive’s refuse the get!

    the story goes like this the husband won full custody and the wife wanted the husband to sign her over custody and 720 000 he never had a problem giving a get i know this woman and i know this for a fact

    It’s interesting how all of you hear one side of the story, and already accuse the husband. Maybe it’s the wife’s fault? Maybe he offered a Get but she’s asking for outrageous things? This happens alot, and since I don’t know the whole story I’m gonna keep quiet, but please remember that “B’midah She’adam Moded, Modedin Lo”, the way a person Judges another person, he’s judged too. Please don’t jump to conclusions from only one side of the story..

    wow that is crazy but the truth ppl dont know that he has custdy after there girl died in a car crash while the mother was shoping and left the kids alone in the street and from what i hear that the brother and his wife got costedy of the kid and she has supervized visits somthing does not make sence here

    This entire story does not make sense as reported. There’s something missing here, maybe even intentionally omitted. And as many of you were alert and responsible enough to comment above, the husband is not always the guilty party. Often it is the wife, backed by organizations and even rabbis with radical agendas. And they are often well funded, and can therefore do as they please without recrimination. And even worse, they will have us al believe facts entirely untrue.

    No one knows this case better than I. Wife was such a liar that she was even denied a Civil Divorce. Legally, they are still married. She absconded with the children to Chicago without Court permission. The daughter died under her care, killed while riding her bicycle unsupervised without a helmet. The Father won custody after two years of testimony and many witnesses. The Mother had the Father arrested for kidnapping and the DA had to drop the charges because they were fabricated. He was not just “not guilty”, he was cleared and exonerated.
    Israel’s Rabbanut fabricated a charge that he owes her child support and alimony to trap him in Israel. The Rabbanut cannot keep him for refusing a GET. They can only lock him in the Country for a monetary claim. She had no such claim. It is a fiction they create to force him to trade a GET for his freedom. The Get is not, therefore, valid. The
    . Wife can also be sued now in New York for falsely imprisoning the Father in Israel.

    hi its so sad how they treated the husband in this case he was 1000 percent not in fault he never ever said he wont give her a get she wanted he should sign over custody and lots of money btw the father won custody for a good reason he is a good man and his ex dragged him in court she is playing as a nebech its all an act she was caught lying in the ny court so she tried her luck in israeli court shame on her . b strong we are all happy u didnt sign over custody to her

    When I got my get, the Beit Din asked me several times if I had been coerced and explained that if I had been, the get was invalid.

    I know the wife in this case I saw with my own eyes how she tried to arrest him right b4 his daughters levaya she is a heart less person lower than that I have never seen and it wasn’t the first time she locked him up . I believe there is a hashem in the world and he won’t forget the tears and pain that the family caused him !!!

    The child did not die because she was not wearing a helmet. She was struck by a car in full view of the mother; a tragic accident, not at all due to the mother’s negligence.

    lawyer of post 22, if that is really your vocation, I wouldn’t hire you to “exonerate” my poodle who chased the neighbors kitten up a tree. When was the last time you heard of a woman who needed court approval to secure herself away from an abusive husband?

    Mrs. Chicago, shame on u for lying. 8 people testified to the exact same story that b4 the levaya there was a police car that drove over to say hello to a friend who was outside the house & did not even talk to anyone else & then left. The father took the son for pizza b4 the levaya by himself- do u want to argue with the 30 people who saw them there. This woman & mother is one of the kindest, selfless, loving and strongest of women I have ever met. I can get over 200 people who actually know her to say the same thing. She has had one focus the last 4 years & that was to protect her children. How dare anyone blame a parent – for the death of her daughter. How evil. It was an accident. The alleys are surrounded by high fences & cars can’t see. She was walking & the kids were on their bikes ahead of her & they crossed the alley & the girl was hit by the car. The facts are in the police report there was not even a thought to blame anyone but the driver. She is one of the most protective and loving mothers there is. All of u wish u could go thru what this woman has gone through & still keep going. Please stop the lies & loshan hara. If the Rabbis ordered the Get- that tells u the truth

    people in chicago do not know the father. such a nice guy. the get he gave her in israel is nooo good. the names there are not right and if she get married now the kids are mamzairim. she will be sued now in ny for 1000000000 bucks till the usband is happy. she thinks that she has the world and could do what she wants she cant.
