    Mark Madoff, 46, was found hanging from a ceiling pipe in the living room of his SoHo loft apartment as his 2-year-old son slept in a nearby bedroom, two law enforcement officials told The Associated Press.

    Madoff, who reported his father to authorities, has never been criminally charged in the biggest investment fraud in U.S. history and has said he and his brother Andrew never knew of their father’s crimes. A law enforcement official told the AP that Mark was not facing imminent arrest and hadn’t spoken to investigators pursuing possible charges in over a year.

    But he and other Madoff relatives have remained under investigation and been named in multiple investor lawsuits accusing them of profiting from the scheme.

    “This is a terrible and unnecessary tragedy,” Madoff’s lawyer, Martin Flumenbaum said in a written statement. “Mark was an innocent victim of his father’s monstrous crime who succumbed to two years of unrelenting pressure from false accusations and innuendo.”

    A lawyer for Mark’s mother, Ruth Madoff, said, “She’s heartbroken.”

    Mark Madoff’s body was discovered after his wife, Stephanie, became concerned when he sent an e-mail to her early Saturday morning that someone should check on their 2-year-old son, said the law enforcement officials, speaking on condition of anonymity because they weren’t authorized to speak publicly about the death.

    Madoff’s wife, who is at Disney World in Florida with her 4-year-old daughter, sent her stepfather to the home. The toddler was found unharmed, along with a dog.

    Bernard Madoff, 72, swindled a long list of investors out of billions of dollars. He admitted that he ran his scheme for at least two decades, cheating thousands of individuals, charities, celebrities and institutional investors. Losses are estimated at around $20 billion, making it the biggest investment fraud in U.S. history.

    He was arrested on Dec. 11, 2008, after confessing his crimes to his sons.

    The scandal put a harsh light on members of the family. The financier’s brother, Peter, played a prominent role in the family’s company. Mark and Andrew Madoff both worked on a trading desk at the firm, on a side of the business that wasn’t directly involved in the Ponzi scheme.

    In February, Mark Madoff’s wife petitioned a court to change her last name and the last names of their two children, saying her family had gotten threats and was humiliated by the scandal.

    Just days ago, a court-appointed trustee filed a lawsuit seeking to recover any money from the fraud scheme that had been paid to members of the Madoff family, including Mark Madoff’s two young children.

    At least a half-dozen Madoff employees have also faced criminal charges.

    A year ago, the trustee, Irving Picard, sued several relatives, including Peter, Mark and Andrew, accusing them of failing to detect the fraud while living lavish lifestyles financed with the family’s ill-gotten fortune.

    The lawsuit accused Mark Madoff of using $66 million he received improperly to buy luxury homes in New York City, Nantucket and Connecticut.

    “This is a tragic development and my sympathy goes out to Mark Madoff’s family,” Picard said in a statement Saturday.

    Said Bernard Madoff’s lawyer, Ira Sorkin: “This is a great tragedy on many different levels.”

    Calls to the FBI and U.S. Attorney’s office were also not immediately returned. Previously, spokespeople for the brothers had repeatedly denied that they had any knowledge of their father’s crimes.

    Bernard Madoff is serving a 150-year prison sentence in North Carolina. Bureau of Prisons spokeswoman Traci Billingsley said Saturday she didn’t have specific information on whether he had been informed of his son’s death or would be allowed to attend a service. In general, she said, inmates are informed of a relative’s death as soon as the institution is made aware of it and the bureau does allow furloughs for prisoners to attend memorial services.

    A police officer stood guard Saturday morning in the lobby of Mark Madoff’s building, a 12-story luxury condo tower with a penthouse owned by rocker Jon Bon Jovi.

    The building sits on a busy block abutting Broadway in an area crowded with clothing boutiques, cafes and art galleries. The sidewalks and cobblestone streets near the apartment were packed with Christmas shoppers Saturday, as dozens of reporters stood vigil.

    Bystanders gawked as officials from the medical examiner’s office removed the body early Saturday afternoon. The medical examiner will determine the cause of death.

    Nikolay Reva, a 28-year-old salesman in the Prada boutique on same block, said that Mark and his wife would come in with their children to shop, both before and after the scandal broke two years ago.

    Mark “was very sweet, respectful, friendly,” said Reva. “But after his father’s arrest, you could see the person diminishing slowly, you could see something started to happen physically, and he wasn’t as talkative.”

    March 17, 2009: Federal prosecutors tell a judge they want to seize jewelry, business interests and more than $30 million from Madoff’s relatives, including loans Madoff made to his sons, Mark and Andrew.

    June 29, 2009: Bernard Madoff’s wife, Ruth Madoff, breaks her silence and publicly says she was among the victims of her husband’s deceit. She said he “stunned us all with his confession and is responsible for this terrible situation in which so many now find themselves.”

    July 2, 2009: Federal marshals force Ruth Madoff out of the $7 million Manhattan penthouse where she and Bernard Madoff lived.

    July 14, 2009: Bernard Madoff arrives at prison in North Carolina to serve his 150-year sentence.

    Aug. 3, 2009: Ruth Madoff is ordered to report expenses above $100 to a trustee appointed to locate and liquidate Madoff’s assets to pay back thousands of burned customers.

    Oct. 2, 2009: Court-appointed trustee Irving Picard sues Bernard Madoff’s family members in U.S. Bankruptcy Court in Manhattan, claiming they used the family business as a “piggy bank.” Mark Madoff is accused as improperly using $66 million from the business to buy luxury homes in New York City, Nantucket and Connecticut.

    Feb. 24, 2010: Mark Madoff’s wife Stephanie files court papers asking change her last name to Morgan from Madoff. She said the change would help her avoid “additional humiliation” and harassment that included threats. Mark filed papers saying he did not object to the move.

    B’DE. Such a tragedy. The family has suffered so much from the prosecution of the father and all the negative publicity and now this. Will they release the father from prison to help the family get through this tragedy?

    Such a tragedy. To some people, life is not worth living without money. That is the real tragedy. He had a family with a wife and two beautiful kids, and still life was not worth living to him.

    The fact remains that prosecutors believe that its likely that Madoff’s sons along w/ all the “sophisticated ” investors did not know about fraud he committed. So all those who harassed & threatened Mark are responsible for his death more than he for their losses.

    Did he kill himself because his luxurious life was imploding on him or he actually had shame and guilt for the millions of people that were robbed of their lives because of his family’s “business”? I hope the story of Madoff’s sons being clueless about their family’s ponzi scheme is true, even though it’s hard to believe. In Japan they consider suicide out of shame for wrong doing an honorable act. Now, only if Bernie himself would have a soul to hang himself for all the lives he has destroyed and billions he stole with his family and friends. I think he is enjoying his prison food though.

    This a terrible tragedy of a son who suffered from his fathers horrible actions. Even Bernie Madoff doesn’t deserve the pain of having his son commit suicide but will now have to live with the guilt that he caused it.

    So sad 🙁 Do any of us know how we’d have handled the pressure Mark Madoff has had to endure for two years now? A tragedy, especially for the kids and their grandmother who has surely endured her share of suffering. Anyone who has negative comments to make is either cold-blooded or brainless.

    The 3 sons and Ruthie were absolutely in on the fraud from DAY ONE. There is no conceivable way that after thousands of fraudulent transactions, windfalls of ill gotten BILLIONS (mostly stolen from Jews and Jewish organizations) and luxury purchases and trips around the world together, that this family didn’t know the family business. Not to mention Bernie’s sordid affairs. Feh. Did any of you notice that somehow none of the 3 sons or Ruthala had any federal or state indictments against them, only personal lawsuits from victims wanting $$$ restitution? That’s because Bernie plea bargained within days of his arrest, and went to prison without a trial, in exchange for the 3 goniffs and wife to get off scott free. Now Bernie has life in prison and one son took his own— due to greed and hatred of his own people…

    I feel sorry for the small kids and his other children…They lost a father.

    As for Bernie and his gang of crooks (along with his ‘Family’) ..They did horrific damage to Jews, Jewish Groups (Schools, Charities) and other people. They made anti-semitism acceptable in todays America.

    Today we have a president who is openly anti-semitic. Only he doesnt refer to the Jews as “Jews”, but only as the “Banks”. His total disreguard towards Israel and Israel’s welfare is an extention of his true feelings.

    There was a dealbreaker story in June 2009 story about how this son was was hanging around Nantucket “stinking up the place with the air of a ‘jerk who still thinks he’s a big deal after everything that’s happened.'” My guess is the guy felt no remorse…

    The only people one should feel sorry for are the grandkids who were too young to go to work. Mark’s wife, brother and mother lived a grand life. No one has billions of dollars and doesn’t ask where the gelt came from.
