The motion filed Tuesday says the government failed to disclose evidence regarding Demjanjuk during various legal proceedings when he was represented by the public defender’s office. Demjanjuk was deported in 2009 to stand trial in Munich.

The 91-year-old was convicted in May of thousands of counts of acting as an accessory to murder at a Nazi death camp.

The motion cites a 1985 report uncovered by The Associated Press that indicated the FBI believed a Nazi ID card purportedly showing Demjanjuk served as a death camp guard was a Soviet-made fake.
