    Dr. Mazoltuv BorukhovaForest Hills, NY – A Queens woman serving a life sentence for having her estranged dentist husband gunned down in front of their young daughter has lost her appeal to overturn the conviction despite errors made by prosecutors.

    Dr. Mazoltuv Borukhova was found guilty of first-degree murder and conspiracy after she hired cousin Mikhail Mallayev to kill hubby Daniel Malakov on the morning of Oct. 28, 2007.

    Borukhova’s appeals lawyer, Alan Dershowitz, charged that several statements introduced into evidence by prosecutors should not have been allowed because his client had not been given her Miranda warnings.

    The Appellate Division agreed that was a mistake but found that the evidence against Borukhova was so “overwhelming” that it didn’t affect the verdict.

    Malakov was shot in the back in front of the couple’s 4-year-old daughter, Michelle, at a Queens park. The couple had been in the middle of a bitter custody battle.

    She took away his life now she wants mercy for her life. No sympathy for murders… What about her cousin, the actual killer? Was he prosecuted? Anybody know how they found out she hired him to do the act? Which evidence was so overwhelming?

    hate hate hate hate hate. for those who don’t know us and for some reason frequent this site, you’d think thats all this community has to offer. yes, she killed her husband and will do life. so do you think anyone needs to read your stupid “lock her up” comments? everyone’s entitled to an opinion, yes, but you are bringing nothing to the discussion if there should even need to be one. #4 you in particular disgust me.

    Before throwing her to the dogs note the recent case also in queens where a women killed her NYPD officer with his own gun yet walked because she was able to prove that he was abusive to her in this case the only reason she is sitting is because she allegedly hired someone to carry out the hit at the end of the day its all up to G-D I personally think she should be freed

    poor daughter……nebach…..on a side note- divorce really can bring out the worstt and unimaginable in ppl…..im not condoning her- she was found guilty of murder but who knows what her ex put her thru during the marriage and during the divorce….

    Her poor daughter. I hope she gets adopted to a caring warm family. And get rid of her last name. I hope the innocent little girl the best in life. How can a mother put her daughter through such an ordeal, when she should be the one protecting her.she failed as a wife,mother and dr. Why she has a dr. Title is beyond me.shame on her.sorry got to serve the consequences!

    No pidyon shvuyim campaign? Why is this woman being treated worse than Rubashkin? Neither was really known to be innocent, and Rubashkin’s crimes were FAR more minor, but why is nobody talking about pidyon shvuyim?

    I am pointing this out because there’s a similar problem with Eli Weinstein, whom everyone has already seemed to have found guilty and deserving of a lifetime in prison.

    What makes people pick “tzaddikim”, who obviously deserve effort and dollars toward pidyon shvuyim, while other people are relegated to their status as criminals deserving of their punishment, or at least unqualified for community support? I have a few answers, but I would love to know what others think.

    I know someone from Queens that knows her and knows this case. She claims the woman is innocent! So, please stop saying those horrible things about her. What do you gain by saying those things????

    Regarding the woman who killed her ex-cop husband, he was in the process of reaching for a gun to finish her off, after threatening to kill her. The jury concluded that her life was in immediate danger, and that she acted in self defense. In this case, the circumstances were entirely different, and the conviction was just. Dershowitz is not a magician. He has lost other cases, also. It must be remembered by Yidden that according to Jewish law, they have an obligation to obey the laws of the country which they live in. Those laws include not hiring a hit man to murder someone!

    There are 613 commandments, besides the ones regarding murder. Just because someone eats the same food and wears the same clothes as orthodox Jews does not make them a martyr for the Jewish people if they are convicted of a crime.
    The evidence against Borukhova was persuasive and overwhelming. The abuse defense is getting to be too frequent a recourse. I have little doubt that there was ugliness and acrimony between Borukhova and her ex. That is why we have divorce, so couples can disengage and get on with their respective lives.
    There were many manifest irregularities in the Rubashkin trial. He was treated terribly unfairly and it takes numerous intellectual contortions to rule out Jew hatred and not see the irregularities.
    But the guy on death row in Florida and this lady Borukhova were convicted in trials that were fair. Sadly, being an orthodox Jew does not remove every evil impulse. We are all tested in great ways and in small ways. Most of us fail sometimes. Borukhova failed spectacularly, with tragic consequences that will affect her daughter for the rest of her life.
