Jerusalem – Rabbis Take On Häagen-Dazs

    Jerusalem – The bad news in Israel keeps piling up. Religious tensions, Iran’s nuclear program and regional instability are all worrying enough – but now Häagen-Dazs ice cream in Israel is under threat, and may become a rarity on supermarket shelves.

    According to a recent kashrut update from the Chief Rabbinate, Häagen-Dazs is not approved by the State Rabbinical Authority, and stores and outlets with kashrut certification that continue to sell the ice cream could lose their kashrut license.

    In an update sent by the rabbinate on Sunday, the kashrut department said that because Häagen-Dazs is made with unsupervised liquid milk, as opposed to milk powder, the marketing and sale of the ice cream in establishments and outlets with kashrut certification is not acceptable and constitutes “a severe infringement of kashrut procedures.”

    “We request from those providing kashrut certificates not to permit the sale of this product in places with [kashrut] supervision,” the notice read. “One should not take into account the opinion of kashrut advisers in this matter who request to continue selling this product, and if the management of any chain insists on selling them it is possible that ‘kashrut [license] withdrawal’ may be enacted against them, according to the law.”

    Milk produced by non-Jews without Jewish supervision was forbidden by the sages of the Talmud due to a concern that it may be adulterated with milk from a non-kosher animal.

    Although arbiters of Jewish law, in particular Rabbi Moshe Feinstein (1895- 1986), have permitted the consumption of unsupervised milk if supervised milk is significantly more expensive or unavailable, it is seen as a less ideal, and the kashrut authorities in Israel do not permit kosher certificates to be issued for products using unsupervised milk.

    Powdered milk from an unsupervised source is, however, permitted according to a ruling of Rabbi Tzvi Pesach Frank (1873–1960), a former chief rabbi of Jerusalem, who held that there is less of a suspicion that someone will go to the bother of adulterating powdered milk.

    Others, however, still forbid unsupervised powdered milk.

    The timing of the rabbinate’s notice is unclear. Although Rafi Yochai of the rabbinate’s kashrut division stated the notice about Häagen Dazs has been issued several times, General Mills Israel said the ice cream has always been produced with liquid milk.

    “Abroad they have different considerations,” said Yochai. “There, the majority of milk is unsupervised so there’s less choice.

    But here, we are living in Eretz Hakodesh [the Holy Land], the majority of the milk produced is supervised, so there’s less reason to permit these products,” he said.

    “There’s enough choice here that we don’t need to rely on this leniency,” Yohai added.

    Asked what Häagen-Dazs lovers should do instead, he replied, “Love God more than ice-cream.”

    General Mills, which markets Häagen-Dazs in Israel, underlined that the ice cream bears kosher certification from the Orthodox Union in the US and pointed out that it is “consumed by the religious and sec ular communities in Israel and abroad.”

    “Super-premium Häagen-Dazs ice cream is made from liquid milk, which provides for an outstanding level of quality in the texture and taste of the product,” the company added as an aside.

    The OU said in response to the rabbinate notice that it continues to give a kashrut certification to Häagen-Dazs “in line with the ruling of Rabbi Moshe Feinstein for people who are not particular about consuming only supervised milk.”

    The rbst in Haagen Daz should concern us.

    I bought an ice cream maker and put half cream, half milk, raw honey and pure vanilla. Nothing tastes better.

    Hagan Daas needs them like a whole in the head and if these rabbis would worry more what comes out from the mouth, a la Kraus, everyone would be better off but without their petty nonsense these Rabbis would be superfluous too

    Carvel in the US is under the Kof-K. I heard a lecture by Rabbi Senter many years ago. He said that the toppings are under his hechsher, but are made with Challav Stam. He agreed with the Israeli policy that only allows Chalav Yisroel into the country. Hence – his ice cream toppings was not acceptable in Eretz Yisroel and he was OK with that.

    There is no need for chalav yisrael on ice cream because it has the same halachic status as butter, which does not need to be chalav yisrael according to the laws in the shulchan aruch….
    The cream content of a non kosher animal’s milk is so low what it would never reach the consistency of ice cream.

    Licensed in many jurasdictions, I know that review is necessery to prevent unscrupulouse people. The Rabbis are right again.

    The importance of Hagen Dasz is that it increases the demand for interventionist cardiologists ,it will increase your blood lipids and clog up your coronary vessels and it is good for the free market system since it will stimulate medical business and income to doctors, of course depending how much Maccabi and Kupat Cholim pays

    Reb Moshe Feinstein never said that it’s ok, he wrote thatyou can be melamed zechus on those who drink cholov stam when there is no other milk. In this day and age where there is enough cholov yisroel there is no heter for cholov stam.
    The rabbinate is right on this issue and of course da’as ba’al habayis would be the opposite.

    It is high time that the OU and all other major kashrus organization, stop giving a hechsher on chalav staam products. and justifying their policy by indicating such on the label as “OUd” etc. There is no reason why in today’s day and age we need to compromise on this issue, and rely on beshaas hadchak kulos.
    Why shouldn’t the hechsher organizations, mostly run by ultra othodox rabbis, insist that only cholov yisroel be used in the food manufacture ingredients, if food producing companies want our business, they will gladly comply

    We’re not choshesh that they’ll put something more expensive into something when the kosher option is cheaper. It’s a gemara in Avodah Zarah 35(?) regarding muryas and yayin nesech.
    We poskin this way explicitly in several places in Yoreh De’ah, look in hil. yayin nesech about buying pomegranate juice.

    Second issue is that chalav tameh tastes very different, and would not taste as delicious as the awesomeness that is only found in Haagen Daas!

    Third, Im pretty sure that whale milk is not a commercially viable milk…
    What are you gonna do? Have whale farms for milk??? How would that even work?!

    For those of you who new R’Moshe Zt’l personally will remember how R’Moshe had lots of Agmas Nefesh (pain) after his ruling on Cholov Stam was made public. R’Moshe never used Cholov Stam and he only permited a Yeshivah out of town that had no money to buy milk and was forced to use the free milk from the govt. programs that was Cholov Stam.
    A Torah Jew will never eat or drink Cholov Stam and lots of people had big Yeshuos once they stopped using it.
    B”h we have lots of delicious KOSHER CHOLOV YISROEL available today!!!

    For all those who rely on reb moshe’s heter. He writes as follows (letter date rosch chodesh tammuz 5716, reprinted in pitchei halacha pg. 107(free translation)) “With regard to companies’ milk in our countries, there are definitely reason to permit it, maintaining that it is not within the prohibition of Chazal, and as we see that many people are lenient in this regard due to pressing circumstances, in many places. However, in places where Jewish milk can be obtained, even if it involves a little more effort and even if it is a little more expensive, it is not fitting to be lenient in this matter, and jewish milk must be obtained. ” Gut voch

    Plain and simple technically.If the Ice cream is made outside the United States and liquid milk was used from countries other than the U.S….then it has to be Cholov Yisroel.All milk in the U.S is kosher because of strict FDA laws.These same laws do not exist outside the States.This is according to Rav Moshe Feinstein.So they do have a point.

    Rav Feinstein is the bottom line.Igres Moshe is the bottom line.Anyone else who say’s differently is an ignorant fool! It’s almost laughable how people can distort information and make life so difficult! So sick of the politics and flip flopping goes on when it come to kashrus!

    I once heard (never checked out if ttrue, but it makes sense!) That the Lubavitcher Rebbe said if you want pure frum children then you should refrain from givingg them cholov akum. BTW there iss plenty of delicious ice cream in Israel with good hechsherim so why buy Haagen Dasz!!

    Other than in modern day Halacha Seforim where else have you seen the term cholov ‘stam’ in ANY source in Halacha???
    Besides, most Poskim and/or Yirei Shamayim today NEVER use none Cholov Yisroel items .

    Amazing. Stop the anecdotes and insults! The “I heard a story” type of argument is not the way of halacha and no one can or should decide halacha based on a VIN article.
    Now we’ve reached a point of accusing each other of not understanding Torah, being insulting to others, and being disparaging of various Rabbanim—-all behaviors that are, IMHO, assur.
    Rabbosai: please calm down! There are those in the Torah-true community in some countries that will eat Haagen Dazs (and other “non-cholov yisroel” products); there are those that won’t. That’s the reality. How we deal with those who “hold” differently or have accepted certain humras (or kulas) is the issue.
    A friend of mine about to get Smicha once pointed out a truism: the person who holds one more humra is “frummed out” while the person who holds one more kula is an apikorus.
