White Plains, NY – A US District Court judge has ruled in favor of village officials in Kiryas Joel, who sought to have their suit against the Village of Woodbury concerning its zoning heard in State Supreme Court. Woodbury, meanwhile, wanted the case heard in federal court.

The plaintiffs, including Kiryas Joel’s mayor, village administrator and village trustees, filed an Article 78 proceeding in State Supreme Court seeking to enjoin the implementation and enforcement of the Village of Woodbury’s comprehensive plan, the Religious Land Use Local Law and related local zoning law amendments.
The Kiryas Joel officials allege the plan, local law and zoning changes violate their rights under the US and New York Constitutions and were adopted in violation of the stat environmental review process and other state, municipal and village laws.
US District Judge Edgardo Ramos remanded the case to State Supreme Court in Orange County to be heard.
