New York – A state judge has invalidated a commitment to expand sewer service that Orange County Executive Ed Diana made two years ago before quietly dropping a lawsuit against the Village of Kiryas Joel’s plans to tap the Catskill Aqueduct.

The promise, signed in February 2010, would require property owners in the county’s sewer district to pay for an expansion once the district’s sewage treatment plants in Harriman and Kiryas Joel reach 85 percent of their capacity.
Not so fast, state Supreme Court Justice Francis Nicolai declared. Siding with the Town of Woodbury and villages of Woodbury and Harriman, Nicolai declared that the county had no right to make such a commitment without analyzing the potential environmental consequences.
The decision has no impact on Kiryas Joel’s $29 million water project or the legal settlement that cleared the way for it.
