    In a form of reverse stalking, Rep. Anthony Weiner (D-Brooklyn/Queens) wants people slapped with restraining orders to be monitored through GPS tracking devices.

    Since 2004, restraining orders across the five boroughs are up by 45 percent, and violations of those orders are up by 17 percent, he said.

    Last year, the city issued 105,000 restraining orders. Weiner argued that getting a restraining order issued is only the first step in the protective process.

    “We are only doing half of the job if we are not making sure these restraining orders are being enforced,” he said.

    Weiner estimated the start-up cost at $100 million.

    While the need for safety and protection should never be minimized, it takes little to realize that this system has its flaws. The issuing of an order of protection is not based on any verification by the court that someone is guilty. It just requires someone to make a claim and accusation. An order can be issued if an individual feels a threat, even when no threat was ever made. Being the subject of an order creates a possible criminal offense by someone that may have never done anything wrong. Likewise, reporting a violation is extremely easy. I have observed this occurring with divorcing people, where an accusation of violation was made when the “offender” was not even in the same neighborhood. It cost the “offender” a night in jail, and there is no recourse, not even prosecution for making a false police report. Perhaps a GPS could stop these false reports.

    The increase reported in orders and violations may be unrelated to increased need or offenses, but rather to the ease of obtaining them and the sheer popularity that has grown everywhere, including the frum community. People do not divorce out of love but out of hate. This blind hate leads to many unfair, and frankly dishonest things, among which is the abuse of the systems of “protection” which are founded on accusation, not guilt. Firstly, even with basis for an order, there is often a counter order. Secondly, with children in the picture, the couple often needs to interact, and they are bound to disagree about things. The anger commonly leads one of them to accuse the other of violation. This system may deserve to be repaired, and I have trouble seeing the expensive GPS doing that well. Regardless, as Pogo said, “We have met the enemy, and he is us.”

    Unless he is talking about convicted offenders, this would be completely unconstitutional! The whole theory of protective orders is that it is not a restriction of freedom (which would again be unconstitutional), but this would be a pure restriction.
    Well, but that’s the way legislators and there likes works. They don’t study the constitution, they don’t care about it, they just make laws & spend public money. Thet they wait for the court to decide if it is constitutional.
    That is not the way it was meant to be. Every legislator before voting on a law, has to protect the constitution, and decide if the law is constitutional. The court is there just for checks and balance.
    But why am I wasting my time…

    WHO IS GOING TO PAY FOR IT?!?? NYC’s budget is more than 61 Billion annually, that comes to nearly $7,500 for every man, woman and child living here. It is wasteful, unsustainable and crushing people like me that pay pay pay. The politicians never once stop and think about the long run and the well being of the people they represent, Weiner thinks that getting this done will help him get re-elected. I know that I get nothing that is worth $7,500 from the city, the police are there to write a ticket but call when you need them you can wait hours, FDNY ambulance is horrible, water bills are higher then anywhere else, garbage pick up I can get private for $1,000 a year and they wont throw the empty cans all over the place. We should revolt and get a new government in that does the bare minimum as was intended.
