Judge Linda Reade ruled today that the “prodigious” amount of negative pretrial publicity about Agriprocessors, Inc., and former top manager Sholom Rubashkin caused potential jurors to develop a bias against them.

The trial has been set for Oct. 13.
The order filed Tuesday was the second victory for Rubashkin’s defense team , who earlier asked for and received a month’s delay in the trial.

Rubashkin and three co-defendants have pleaded not guilty to immigration, bank fraud, wire fraud and mail fraud charges.
Agriprocessors was the subject of a massive immigration raid in 2008.

I’m not sure it will make any difference….everyone in the region has heard about the the “Rubashkin Affair” and the Agriproccesors’ case. There are very few Jews in South Dakota so maybe they haven’t focused on the details but the local media will quickly pick up the story.

Since Obama publicly opined as to their guilt (in his view), it is hard to see how they could get a fair trial, but their chances seem better out of state.

I’ve been writing and saying this for the past year:

Sholom Mordechai HaLevi ben Rivka will walk away completely from these charges and I would not be surprised that he sues the U.S. Government and wins.
