Sioux Falls, SD – Jurors continued to weigh the financial fraud case against Sholom Rubashkin on Tuesday but did not reach a verdict for the former eastern Iowa slaughterhouse executive.

The five-man, seven-woman pool spent the day behind closed doors at the federal courthouse in downtown Sioux Falls. The evidence before them includes testimony from 64 prosecution and defense witnesses and reams of financial records from the now-defunct Agriprocessors Inc. in Postville.
They resume deliberations Thursday after today’s Veterans Day holiday.

Immigrations and Customs Enforcement also won’t comment. Tim Counts, spokesman for the Bloomington Office, wrote via e-mail: “For operational security reasons, we don’t discuss ongoing enforcement activity, including confirming or denying that we are looking at a particular person or entity.”
Counts says ABM has not been fined.
“It’s a sticky legal issue of, ‘What did you know and when did you know it?'” said Counts.
Mark Cangemi is a retired ICE official. He used to do these kinds of workplace investigations and he’s practiced immigration law.
Cangemi can’t talk about this specific case or the employer involved, but Cangemi says the patterns in these workplace investigations are always the same.
“Could be a record-keeping error, civil or criminal in nature. We just don’t know,” he said.
The whole issue of the bank fraud came up after he was unable to meet his financial obligations after he was attacked from multiple flanks, by PETA, the unions, the reform movement, Postville priests and finally ICE. If he were allowed to continue his business and the feds would have dealt with him differently on the immigration issue, in all likelihood he would have met his financial obligations and all would have been well.
So, yes, I do think that the motives behind the raid are relevant, and I think that the jury should take it into consideration.

The first employees at Agriprocessor were some illegals brought to Postville from New York by Aron Rubashkin. The Rubashkin’s originally recruited from Mexico but found that Guatemalans were more submissive and hard workers, so they directed their recruiting efforts away from Mexico and toward Guatemala. My G-d, there were ads in newspapers advertising “good jobs await you in at a meat packing plant in Postville.” Do you seriously think that In a small closely held, family business Rubashkin didn’t know anything about this?????
As far as SMR taking the fall for his father, brother, sister and other family members. That is precisely what is happening.
