    A recent article in the Des Moines Register claimed that Rubashkin had been offered a plea deal by Federal prosecutors prior to his trial but he refused, contrary to the advice of supporters.

    “Everything they reported concerning a plea deal is total fiction,” said Rabbi Hecht, “Sholom Rubashkin never considered a plea deal, because the government never put a deal on the table for him to consider!”

    Rabbi Hecht further stated that the Register’s reports of plea deal meetings which supposedly took place at the Brooklyn headquarters of NCFJE have “absolutly no basis in reality”.

    “The quality of journalism that I’ve seen from so many media sources has been nothing short of shocking,” he said.

    Rabbi Shea Hecht was quoted in The Forward on 10/14 stating that the government did offer a plea deal:

    “There were negotiations — an offer was put on the table,” Hecht said. “He had to refuse the offer because compared to what he did wrong, they were asking for too much. There was no way that a man should give the prime of his life away.”-

    If there was no deal offered, why not state that, before the verdict. Coming out with that now, is fishy.

    something fishy is going on here.
    rabbi hecht was quoted in the forward that the gvmt offered a plea deal and rubashkin refused. rabbi hecht did not retract his statement then. why is he doing so now?

    The government is under no obligation to offer plea-bargains to anybody. In a high profile case like this one, plea bargains are rarely offered, unless the quality of the government evidence suggests a fair chance of aquittal.

    I feel very bad for Sholom. It looks like the government threw the book at him…May be he will win on the appeal…

    Read the spin: Hecht is not saying here that Rubashkin was not offered a deal. What he is saying here is that the deal offered by the feds was not acceptable to the Rubashkin camp.

    Hecht and the other beards are running for cover because they are the reson SMR is in the jam he is in. Hecht and that lunatic neighbor of mine Lipschitz fueled the fantasies ala Sharpton and Jackson that this was a witch hunt so now, just like Sharpton, they run for cover because they aren’t the one in the hot seat. The rebbe zal never would have stood for this.

    the way it works in federal cases is that one negotiates a plea with the US Attorney. Sentencing is based upon a formula. If a defendant pleads guilty before indictment, there are less points (less time), and again there are points if one pleads prior to trial. once trial starts that seems to be it. so this story is not accurate.

    Almost never will I accuses someone of outright lying without direct evidence, however, because in this case the outcome was catastrophic which could have been easily avoided and more importantly SMR still have the ability to plea out the second trial, which I hear (not firsthand information) will be devastating not only to Agri and SMR, but to all Jews whereby every anti-Smite would get a chance to point at the exploitation story and use it as a club against other Jews, therefore I will state bluntly without even knowing the man, in my view Rabbi Shea Hecht is lying, and here is the reason why “I believe” he is lying, in cases which has a following logic tells me that the defense would like to leak and let know everybody that they did not want to take a plea deal and they are willing to gamble with the outcome because they are NOT guilty, this is a massage to the jury (even if they cannot read anything about the trial) however, it seems that Rabbi Hecht didn’t try to send the obsolete not guilty massage, according to the reporter he admitted that there were wrong doings but the 15 years was too harsh in SMR’s view, so what happened he just send the opposite devastating massage to the jury that he is guilty but the offer is too harsh, now here is the clincher if it was not true SMR’s lawyers would had come out swinging against Rabbi Hecht and they probably would even submitted a motion to the judge do make sure that this devastating story never reaches the jury, but they didn’t, why, because, they know it was true, and they know it was leaked by the defense not the prosecutor, so they don’t have a leg to stand on, but because there is another trial in waiting, we as Jews need to put pressure on the defense to come to their senses and plea it away, and I am also calling on the reporter who interviewed Rabbi Hecht to release all tape recordings if any, and his contemporaneous notes to prove that Rabbi Hecht is lying.

    I know some of you are pointing to me and saying that some of us are happy with the outcome only because I was one of the few who were clearheaded during the process and were calling to plead out the case, it is the few of us who didn’t have no interested in the nitty gritty of the case, for us it was not spectator sport, who is winning or who is ahead we wanted nothing more than a resolution to the case, but nobody from the defense heeded are advice, now again I am renewing my call to make the second trial go way, we are not interested in a sport contest, this time it is not just Agri and SMR who are on trial, if all the exploitation charges would see daylight and SMR is found guilty than that will directly reflect on all religious Jews and that is where we need to draw the line and not expose it. Yes I know some would say that the best disinfecting agent is the sun and therefore let the sun shine on the problem, I would agree if the problem is pervasive, and I strongly believe that it was anomaly, that is why I would rather see it go away.
