    Lakewood, NJ – Accused Ponzi-schemer Eliyahu Weinstein will remain in a Hudson County jail at least for the weekend even though a federal judge granted him bail, his attorney said Friday.

    Weinstein, who is accused by the government of bank fraud and wire fraud in the amount of at least $200 million, was the victim of “clerical errors, traffic and a manpower shortage,” said his attorney, Ephraim Savitt.

    U.S. Magistrate Judge Mark Falk on Thursday ordered Weinstein, 35, of Lakewood released on a $10 million property bond and a number of restrictions.

    Savitt said that four of the properties being put up for that bond are in New York state. He said the process of filing necessary paperwork in New York county clerks’ offices did not go smoothly Friday.

    Savitt said that the clerks’ offices “on a summer Friday, do not seem to work with greased lightning, and all sorts of clerical errors took place to conspire to keep Mr. Weinstein in jail unnecessarily until Monday morning.”

    On top of that, he said, there were no U.S. Marshals available to pick him up from the Hudson County Correctional Center in Kearny when the paperwork problems were finally resolved.

    “It was already 4 p.m.,” he said. “Given the fact that the marshals’ manpower wasn’t as ample as it normally is in the summer, there’s nobody to pick him up.”

    Savitt said his client should be released Monday morning.”

    “We’ll start the week fresh,” he said.

    One of the conditions of his release is that Weinstein must wear an electronic monitoring device which is equipped with a GPS unit. Savitt said Weinstein will receive the device on Monday, at the federal courthouse in Newark.

    He’ll then be responsible for his own transportation back to his home in Lakewood, Savitt said.

    The situation, Savitt said, is “extremely frustrating, especially for someone who’s never been in this situation before.

    “Everything you read or hear about jail actually comes true for him, including (encountering) an extortionist. All in all, he’d much prefer to be with his family than exposed to these kind of elements.”

    Here we have a case of someone who allegedly stole–or tried to steal–hundreds of millions of dollars. If true, that’s an enormous chilul HaShem.

    To top it off, his lawyer wanted him out for Shabbas. If true, that’s enormous chutzpah.

    Poster # 7 (DRSLZ); Why is it Chutzpah if his lawyer wanted him to be home with his family for Shabbos?! That’s his job. To get his client out on bail as soon as possible. Now, Mr. Weinstein did some things that have had a profound negative impact on some individuals (the translation to plain English of the above sentence need not be elaborated further.) But he still deserves to be with his family until after the trial and sentencing.

    Raboisai: I don’t know the facts, but one thing is forsure, it’s almost rosh hashanah. Even if you think he cheated you, you stil must keep the laws of lashon horah, otherwise your no better than you think he is, and to the dumbo who said thers no such thing as innocent until proven guilty in halacho, which religion are you referring too, couse in judiesem just being guilty barely exists, ever heard of aidim and beth din and someone is not a rasha till after the peak din was given and he won’t listen. so what are you talking about.

    Yes, there are bad people in our community who would absolutely do this, as unimaginable as it is! This happened before, in the not too distant past and we now have a replay with Mr. Weinstein. Do not be don lekaf zechus! Only, have sympathy for his victims. Mr. Weinstein and his ilk belong in jail because they have a propensity to come back every time and do it again in some way.     #28 – I am so sorry for your losses. You have every right to be angry and to vent your frustration. There are good and bad amongst all groups and Yidden are no exception. This swindler is exactly where he belongs.     of course I have proof of the money I gave him ; lots and lots of money and his signed documents of how he was going to return the money in 3 weeks. The whole idea was to spend the interest money on building schools in Arad and Hatzor Israel. Stupid – in hindsight sure – but the idea was wonderful.

    Someone with wisdom, please answer my question. What is permitted, to proactively warn the community that a person is a con artist or a molester? I know that it is an obligation to tell someone to avoid a known abuser (whether financial or sexual), if you know that the person is about to be in danger. But what about the innocent people that don’t get these warnings, because the community is perhaps overscrupulous about the laws of proper speech? Could problems be prevented? Let’s not just pass judgement on what happened, as so many of the posts have been doing; let’s plan for improvement! That is, if there is a way to do it within the bounds of halacha. Thank you.

This facilitates the very important image he needs to continue his activities while bringing himself much kovod. Kovod from the little guy but more importantly, from rabbonim and roshei yeshivah. As long as those we look up to for guidance are blinded by the cash that flows from the schemer, it will be about impossible to put an end to the fraud in its early stages. We need to get smarter as individuals. When a young 30 year old is handing out millions upon millions, one must question, “where did he get it from”? This is not the first time this has happened in recent history. Please, we need to make it the last!
