Gary Spencer, a Court of Appeals spokesman, says Thursday a five-judge panel was unable to reach the necessary four-judge consensus after earlier arguments.
With two judges still recused from the case, two Appellate Division justices will join the five remaining top court judges to hear arguments again on Aug. 24.
A jury found the Port Authority of New York and New Jersey failed as a landlord to maintain reasonably safe premises and was mostly at fault, blaming terrorists for the other 32 percent. A midlevel court upheld the verdict.
The authority appealed, claiming government immunity and reasonable security before the unprecedented attack.
