    Justice Thomas Raffaele (RA’-fy-ehl) says he was struck last Friday after midnight when he and a friend came upon officers wrestling with a shirtless man wielding a pipe.

    He says he called 911 because the crowd seemed to be getting out of control, and the officers yelled and cursed, then one struck him in the throat. The judge complained to authorities.

    Police Commissioner Raymond Kelly said Wednesday that the claims were being investigated by Internal Affairs.

    The man wielding the pipe was declared emotionally disturbed and hospitalized, but not arrested.

    The judge is being too vague in his description of the scene. There are a lot of unanswered questions in his statements. Were they uniformed cops or undercover?; Did the crowd know they were police officers?; Maybe he (The judge) was standing too close to the fight and he was hit accidentally?;
    As a judge, he should know that this is not a spectator sport. He should have called for assistance immediately.

    I read the story (in the Times?) yesterday and he seemed quite specific. Still, time will tell.
