Rockland County, NY – A 31-year-old Monsey man pleaded guilty Thursday to sexually molesting two young brothers, accepting an offer for a probationary sentence and joining his brother on the state registry of sex offenders.

Shmul Dym pleaded guilty as a state Supreme Court jury sat ready to hear evidence he improperly touched the young boys, ages 7 and 9.
Rockland District Attorney Thomas Zugibe said he approved the plea agreement at the behest of the boys’ parents, who wanted to spare their children from testifying.
Zugibe said the family had withstood pressure from some leaders in their ultra-Orthodox Jewish community to refrain from cooperating in Dym’s prosecution.
Other community religious urged them to cooperate, he said.
“I commend the victims’ family for withstanding community pressure and cooperating throughout the process,” Zugibe said. “They were concerned about their sons having to testify. In the end, we went with the family’s wishes.”
Funny. I always thought I was part of the community and I never ever pressured a family member. What’s all this talk about family members being pressured “BY THE COMMUNITY” ?
Why are we all being shunned when it is the action of mere, sick, individuals?

I know that this is not funny, but I have to laugh; when these accusations first surfaced on VIN all the comments were in favor of this super, special, tzaddik, gentleman…… Well I guess people arent always who they seem to be!

Even if he does behave, for a while. The spotlight will remain on him for life. This little action, is a giant step; for any future misdoings.

I have some difficulty with accepting this judgment. The reason for incarceration is to successfully keep him off the streets. That is NOT accomplished with a probationary sentence.
The comparison with Kolko is foolish. Contrary to the drivel from the fanatic activists, Hynes got the best deal possible from that case. There were witnesses who would not testify (due to pressure and threats), and the court would not have convicted Kolko of a sexual crime (that would have automatically placed him on the registry). The plea bargain was the best conviction the DA could get, and it was a crime called endangerment, not molestation. Since the crime is not a sexual offense, there is no registry. The DA does NOT have authority to stop a sexual offender from being registered on the list.
The bargain here did not involve a step down from a sexual offense, and that is why he gets onto the registry. I still would have hoped for some jail time, not just because of the message, but because it gives the community the feeling of safety.
I don’t think that it reached the level of raglayim ldavar that the family can go to police it looks more like yadayim ldavar

So, Kenny Gribetz let another molestor go free. He must be very proud of his practice. I wonder if his kids were molested if he would still protect the thug.

He belongs on a prison farm where he can help cultivate food to feed the poor and homeless. This way he gets the opportunity to help others and not be a complete waste of space for the rest of his life. The idea that other kids could encounter this man in public sends a shiver down my spine.
I have a question. What was going on when this animal was growing up…it says his brother is already on the SO Register. Has anyone looked to see where other siblings and the parents are holding? This is horrible.

Sorry but he is not behind bars. Where is the justice for our kids? Has somebody been paid off??? He belongs in prison for a minimum of 10 years with good therapy!!
These cases are very difficult to really get a grip on. There is almost never any real evidence other than the testimony of the kids. Because of that, the decision of the jury is so unpredictable. They can believe the children totally, or not at all. This can be the difference between 20 years prison and walking away scott-free without even being registered or anything. Therefore, very often it is worth it for all parties to make the plea rather than risk the unknowns of the jury decision. That way, they can avoid the risk of major jail time, and the prosecutor can place that person on the sex offender registry to (in theory) make him less of a danger. This happens regardless of weather or not the person is totally guilty or completely innocent. Its not fair, but thats the bottom line. Without any hard evidence (of which there is very rarely any) its a toss up.

It really makes me wonder if the posters here are all semi-literate reactionaries. As someone who is pretty familiar with this case from a front row seat, I can tell you all the following.
You really have to know his personality to understand that he is definitely no threat to society and to understand how this all came about.
While no one could testify for sure as a charachter witness and say it did not happen (אין אפטרופוס לעריות) , as a former employer of his i can tell you the following ;
Mr. Dym is an adult with a juvenille disposition, who has not outgrown many childish fantasies and collections. For example, he can keep a whole bunch of kids entertained by reciting facts about animals and pyrotechnics etc. He relates to adults and children at the same level. He is strong as an ox, and children are fascinated hearing about his supposed exploits. He has a silly side to him as well, and is pretty much a harmless teddy bear. If children from the neighborhood should come to visit, it would be natural for him to play games with them and keep them entertained.
The mother in this case, after her son came back from a visit, found out that his brother was on the list (a whole other story of a 17 yr old kid getting railroaded and destroyed for life by a minor indescretion) and became frantically distraught when she interrogated her son, and he claimed that mr dym tickled him on his socks. She ran all over town to rabbis making a fuss, and eventually to the DA. They offered him a plea deal for registry and probation. He knew full well how his brother is suffering and adamantly refused to the deal, maintained his innocence and insisted on a full trial. People all over explained to him the poisoned atmosphere on the street against orthodox people accused of such crimes and told him to expect a jury of 12 to practically hang him even without evidence, simply because of the prevailing attitudes pervading by the rabble on the street, like most posters here. A day before the trial I begged him to take the deal and he still refused. Apparently someone else with better powers of persuation convinced him at the last minute before trial, or he simply folded from all the pressure.
This is no win or lose for the DA. Just a headache that needed to go away.
The parent in this case was never intimidated, she managed to create this fuss all alone, and will have to live with herself and justify her own actions. She definitely messed up her child far more than he ever could.

There are many levels of abuse, ranging from unwanted touching to forced rape, and it is a long stretch of road from something minor and harmless to abuse that can damage a victim for life. He was accuse of “improperly touching”.
So before you get on your soap box and scream for he to be mounted on a stake, just remember that the next time you give your 12 year old niece a kiss or a hug, you are a candidate for “THE LIST”

Mr Dym. Obviously refused to accept plea originally (as reported earlier this week in the journal news) “were anxious to have our day in court” his attorney was quoted as saying, Jury was selected & trial was about to start, Only then after extreme pressure Mr. Dym was convinced that facing a jury in todays judemental enviroment would probably end him up in jail, he reluctantly agreed to accept the plea not to cause a chilul hashem this trial would of for sure created.
Judging from all the comments above, To see how judgemental & short sighted so called “frum” people are, I can only commend him for taking the plea as the smartest alternative out of this mess, Imagine what a Non-Jewish Jury under the influence of the recent Media frenzy on this issue would conclude?!
A beth-din sat on this case & investigated all the accusations & found that their are many lies & non founded allegations in this case, (& they produced a letter stating that to Mr. Dym) If there was any trust in the justice system today, this weak case would of for sure ended in an aquital.

Yossi Gestetner spins that Dym is innocent and just pleaded guilty to make it easier and that nothing bad really happened. Bad move on Yossi’s first announcement representing the Republican party. He should have told the truth.

This does not make sense. I can’t believe anyone is going to make such a fuss over tickling on the socks or hugging. Come on! The DA would look for a possible 10 year sentence for such “offences?” Naurishkeit! When it comes to an allegation of something serious as going inside a kid’s body, there are medical tests which can help verify whether or not there is something to such an accusation. Get real, already.
