Troopers say Gregory Dean Jr. of Hopewell Junction was stopped for an inadequate light on his license plate about 9:45 p.m. Sunday in New Lebanon.

They say their investigation showed the semi-automatic on the passenger seat was a legally possessed but its magazine contained nine rounds, not seven as required since April 15.

Troopers say Dean was charged with aggravated unlicensed driving for a suspended license and unlawful possession of the ammunition feeder, both misdemeanors.

He’s due in New Lebanon town court May 23.

A telephone listing for Dean was out of service Monday.

Just go’s to show the insanity of over legislation. The gun was legal, the bullet’s were legal but the owner probably did not know that the law was changed and that the two extra bullets became a crime. for those who say he should have known the law think about this.

There is federal legislation that you may be prosecuted for a Felony for violating the laws of another country if you import something which is a crime to export under that countries laws.

A US tourist brought a fish fossil from Guatemala to the US and was arrested at customs and charged with a Federal felony. (Because removing the fossil from Guatemala was a crime under their law) and thus, dejure became a federal felony when the tourist brought it here to the US.

Try and keep up with the insane over-legislation.

    Good luck

The man arrested is just the latest victim of the out of control leftist police state controlling America now.

The founding fathers of America would no doubt consider present day America to be a despotic police state where constitutional rights for law abiding citizens have become nonexistent, where the Bill of Rights has simply been shredded to pieces by the PC leftist tyrants in Albany and elsewhere.

This is not a ‘leftist’ or liberal plot. It is Pacifism. Not only that, but I believe that if clips that hold 9 bullets are legal, the licensing would seem legal for 9 bullets. It is a very bad law and it should stricken.

Nine bullets in one magazine: criminal. Five magazines, with seven bullets in each: upright, law-abiding citizen.

Are the inmates running the asylum?

Granted the law is stupid, especially so since 10 round magazines ARE legal, but there is no excuse for not knowing the law. Also, CCW stands for Carry Concealed Weapon. The key word is “concealed”. leaving a legal handgun on the seat of a car in plain view could very well be construed as violation even if it was empty. In some states, your CCW license is in the DMV database so when the cop stops you for a violation and runs your driver’s license the CCW will pop up and he will ask you if you’re carrying. In New York State, the DMV database does not include that info. By law you are supposed to inform the stopping officer that you are carrying, but if it’s well concealed, it’s probably a good idea to avoid the hassle and don’t bring it up. However, don’t lie. If he asks, for sure tell him you are.
