Ber Sheva, Israel – Orthodox Jewish Woman Protests Ruling Placing Son in Custody of His Non-Jewish Belgian Father

    Ber Sheva, Israel – A woman from the south picketed in front of the Knesset to protest the Supreme Court’s decision to return her 9-year-old son to his father’s custody in Belgium.

    The woman, who is ultra-Orthodox, had argued this would endanger the child emotionally and physically, but the court ruled she had kidnapped the boy and must return him to his homeland.

    The boy is the product of the woman’s marriage to a non-Jewish Belgian citizen 10 years ago, which ended in divorce when the boy was 4-years-old.
    She initially had custody, but a Belgian court reversed the ruling, and the mother’s appeal was denied.

    Two years ago she took the child to Israel. The father filed suit in Israel, based on the Hague Convention on International Child Abduction, and the mother countered with accusations of domestic violence.
    The family court, acting on the opinion of child social services in Israel, France and Belgium, ruled out the argument that returning the boy to his father would place him in physical danger.

    The Supreme Court left standing the lower court decisions, and urged the mother to cooperate with return the boy to Belgium, and even to accompany him there for a while to ease his adjustment.

    i honestly do not see her argument. so what if she is now orthodox . He is still the childs father. period.

    entirely different case than yosele shumacher. that child had parents who were not religious; he was sent to the grandfather and he decided to make him religious. in this case, if the mother is a fit mother, why should custody go to the father? religion should not play a part here at all.

    The mother didn’t get custody because the court in Belgium said that the father did. As for why they decided that way you would have to ask the court.

    It should also be noted that the mother took the child out of Belgium without the approval of the father, this is illegal and Israel is bound by treaty to return the child. The fact that the mother is frum and the father is not jewish has nothing to do with it.

    obviously that would woman cannot control her self by sleeping with a none observant guy, how can the court trust such a mother. we should respect the the courts ruling,

    What I wonder about is, why originally the child was taken out of her custody in Belgium. That, to me, is very strange.

    In family matters, the courts are always biased in favor of the mother. What happened that she lost custody, and that her appeal was denied?

    I am french. I was approached by a belgian official(adressed to me by hassidim from Antwerp) some months ago (when they did not know where was the child) to try to negotate with her (through her french family)some kind of agreement for the benefit of the child.The man told me then that when the child is found, there will be no place for negociations. I tried to pass the message through a rabbi. Then, nobody listened. Now, of course, things are bad. In my opinion, we frum jews have to learn that we cannot live as outlaws?

    Yoseph, how about SHE lost custody at the Belgian non-Jewish court because SHE is jewish, and HE is not? did you ever hear about racial profiling?
