Ramapo, NY - Fight Over Held House Continues

Ramapo, NY - An appeals court has rejected the latest bid by Venera Held to keep the house she insists was stolen from her.

The dispute, though, which has been ongoing since 2003 when Held said she was duped into signing a contract in a bagel shop, is not out of court.

Joel Scheinert, a Nanuet attorney representing the buyer, Michael Goldstein, said he was in the process of appealing a ruling by Ramapo Justice Arnold Etelson.
Etelson dismissed Goldstein’s attempt to have one of Held’s daughters, Marie, evicted from the 60 Decatur Ave. house, along with tenants in a second apartment.

In his decision, Etelson ruled that state Supreme Court Justice Alfred Weiner had to decide if a late payment for the property by Goldstein and his wife, Chaya, blocked their ownership.
“As far as we’re concerned,” Scheinert said, “Judge Weiner’s previous rulings leave no dispute as to the ownership of the property.”

A message left at the office of her mother’s attorney, Ronald DeCaprio of Garnerville, was not returned yesterday. His latest appeal was rejected by a four-judge panel of the Appellate Division headed by Judge Howard Miller.
In its decision, the appellate court decided in part that no issues relating to Weiner’s previous rulings had been raised.
DeCaprio has said that because Goldstein missed a deadline that Weiner set for payment for the house, Held had the right to cancel the contract.

Weiner had ordered Goldstein to deposit the money with the county Department of Finance within 10 days of Nov. 30, 2007. The $204,356 was not deposited until Dec. 31.
Weiner also ordered that Held pay Goldstein $3,000 compensation for each month that he was unable to use the property because of the presence of the tenants. That leaves the amount now due to Held at about $183,000, Scheinert estimated, a sum that continues to decrease each month.
