Queens, NY – Dr. Mazoltuv Borukhova, accused of arranging the murder of her husband last year, is allowed prison visits with her 5-year-old daughter, according to a Queens Family Court ruling today.

Pre-schooler Michelle Malakov witnessed the murder, which took place Oct. 28, 2007, in a Forest Hills playground during a visitation with her mother. It was during that visit that Daniel Malakov, 34, a dentist, was shot to death point-blank in the chest by an alleged hitman. The murder occurred after the father was granted temporary full custody of Michelle.
A relative of Borukhova, Mikhail Mallayev, has been charged with the murder. Borukhova is facing a murder trial this fall in Queens Supreme Court. She has been incarcerated in Rikers Island since April, when she was charged in the case.
Michelle has not seen her mother since her incarceration. Her mother continues to fight for her custody and wants her daughter to live with her relatives instead of with a paternal uncle, Gabril Malakov, with whom the girl now resides, as was reported today here on Vos Iz Neias.
The jailhouse visitations will begin as soon as the logistics can be arranged by a religious social service agency and will take place in what is being termed as a “child-friendly” visiting room at Rikers.
David Schnall, the law guardian for the girl, said: “Michelle won’t even know where she is.”
This doesn’t make any sense, the court is supposed to ONLY consider the interest of the child. With the likelyhood of this mother spending at least the next 15 yrs in jail,would it not be in the best interst of the child to allow her to forget her mother?
You come with such twisted logic. Visiting a mother, no matter what crime she is accused of, is almost always in the best interests of the child. Remeber, it’s a visit.

Read the article and then comment. The article expressly stated that the room where the child will be with her mother will not even closely resemble a prison. What prompts you to think that a 5 yr old will ask “So mommy what brings you to rikers Island”?

The Mother does not deserve visiting rights after she murdered the childs father.She ruined the childs life.

is anyone here aware of the fact that there are some prisons that have children LIVING there with their mothers. a one time visit is fine, let the kid see her mother, she probably misses her horribly.

we arent talking about what the mother deserves or not we are talking about whats best for the child. A mother is still a mother and a father is is still a father regardless of what he h/she has done.
This mother is not in prison for a white collar crime, she is in prison for murdering the child’s father.
How can you argue that there is any benefit to the child from visiting this women.
The sooner she forgets this women the better of she will be.
In fact visiting this women will cause her such emotional trauma that she will never get out out of therapy
As far as the mothers visitation rights; She lost custody to the father because she prevented the father from seeing the daughter even after the court repeatedly ordered her to allow him visitation.
Besides the whole rights issue is convoluted, children are not property. Parents are entrusted with a privilige to raise children. That privilige comes with a great responsibility. When a parent exhibits grossly irresponsible behaviour they lose their parental privilges
this poor kid lost her father, don’t take her away her mother. a kid needs her OWN patents.
these are the kind of peple that make you wonder what happend to the death penalty
