Brooklyn, NY - Dov Hikind Puts Yeshivas On Notice With Harsh Warning: I am Going To Publicly Shame You If You Harbor Rebbe Molesters

Brooklyn, NY - A hard-hitting follow-up to the subject of sexual abuse and molestation in the Orthodox community was heard on Assemblyman Dov Hikind’s radio show this past Motzoei Shabbos.

Hikind opened the first of several sharply-worded salvos heard throughout the program against perpetrators in the frum world.

After expressing his admiration for cheder rebbis for making a difference, Hikind asserted that “My office is committed to doing something. I have actually assigned staff members to work on this. We are going to stick with this. Those who are abusing our children, doing inappropriate things, I’m coming after you in every single way. Quit before your name is released and your family is embarrassed! I will not be silent or shy away.

Hikind then introduced a Williamburg mother whose son had been molested by his menahel at age 8.5 and left Yiddishkeit at 19 as a result. Most significantly, the mother related the years of devastation, isolation, shame and lack of trust in Torah authority figures. “It was a betrayal of his beliefs,” reports the mother.


After a lengthy discussion on how the victim’s family tried to get the menahel to treatment without embarrassing his own family, which didn’t work, the mother reported that even though the menahel failed a lie detector test and was temporarily removed from his position, he has been returned to teaching in summer school and will be returning to yeshivah in September.

Throughout the program, an audibly outraged Hikind raised his voice and said (among other things):

· “…How can one of the most prominent yeshivos, that educates tens of thousands of kids, know they have a molester destroying people’s lives! How can they continue with him? How’s that possible? … Well, we are going to stop him, okay? … We are going to stop that from happening. Period. But that’s not the point. The point is: What is their thinking? Where is their religiosity and their commitment?”

· “Is there anyone out there who accepts abuse of children? This mother tried to do things in a beautiful way, and they betrayed her son again. They just hoped she would go away. Her son felt, ‘Maybe I accomplished something, maybe I got rid of this skunk!’ Then he finds that a person who is sick and who should never be with children again is back on his job? How do you face G-d now? How do you pray in the morning?”

· “My office is devoted to this. We are asking people to come forward… We have staff working on this. We are building cases and cases and cases. The stories that I have heard this week, all from our communities from Lakewood to Monsey to Borough Park to Flatbush.”

· “You know, I gotta tell you. You ask me, ‘How are you?’ I must be honest. I have not been okay since last Shabbos night since doing this show. Because it affects me profoundly to listen, to listen and to listen. And you know what’s putting a dagger through my heart? It’s that people are more interested in protecting the perpetrator than dealing with the victim! That’s the part that’s putting a dagger through my heart and soul.”

The show concluded with the mention of Beth Israel’s new Sexual Abuse Hotline, 212-844-1495, and several calls from supportive and grateful abuse victims.

Of particularly notable mention was Hikind’s reaction to a caller named Yitz, who asked the mother, “Why don’t you go to the police? And why is this sub-human still on the streets?” Hikind replied: “In her case, they are trying to get him out of a classroom. It’s about getting him away from kids, and I have spoken to quite a few rabbonim and you have every right to do this legally. The first objective is to get this guy out of the classroom. If I have to go public, if I have to hold a press conference outside the yeshivah, I will do that! This guy is not going back to the classroom in September. We will make sure that will not happen.”

I was abused as a kid on numerous occasions by a teacher in my school. I pray that he lives hell on this world and in the world to come for eterity. I can not and will not forgive this animal. may he be cursed.

It's about time someone does something about it. Why the heck can't every school install cameras in every nook and cranny of the inside and outside of the buildings??

My question and concern is as follows. While there may be cases of true molestation and they should be stopped at all cost. But truth be told there are cases of fraudulent accusations as well. Kids may not like a certain rebbe because he may be too harsh and they might make up stories about him and have his life ruined. How do you know for certain that this mother tells the truth? Maybe she does. But maybe not.
And if it did happen, was the menahel warn'd? And maybe he did teshuve, and he didn't touch a boy since? And if he did it, and did teshuve, do you realy want to destroy his and his family's life? is it revenge or haluche that we follow?!
The same goes to all cases.
Of course, if you deal with a proven repeat offender, that dosnt want to change, that a diddrant story!

and his office should force all schools to sign it as their policy

what to do when there is an accusation against a teacher.
there has to be steps taken to verify to corooborate

a system should be installed by all yeshivas how to deal with this

and it should also be accpeted in all camps overnight and daycamp

there is more abuse in overnight camps then anywhere else

I was a Rebbe, who after being a Rebbe for 15 years, was falsely accused by the son/wife of a school big shot, and was subsequently fired. At age 43 I had to find a career, and the sad part is, principal believed me, but there was too much money on the line.

My point is, people might take advantage of a chance to make noise and take nekama on a Rebbe they don't like. Is Dov qualified to know them the other side is lying?

In most cases of Rebbes, more than one child is affected. So while sometimes the Rabbi will plead innocence, and claim the "family is out to get him" for one reason or another,in most cases that are true there is more than one victim.
As far as bochurim with bochurim, how can this be stopped? What about incest? How come no one has mentioned sister and brother, or other relatives in the family that no one wants to believe? Can we reach out to children, who will usually tell the truth, although no one wants to believe them? I personally know of plenty of first hand situations, and how messed up these people are for life! Thank you Dov for finally starting to do something about this!

You need to lay out the steps you will follow in determining the authenticity of each allegation.

Then you need to lay out how you intend to respond to each scenario and when you will deviate from the standard response.

This should not undertaken on a wing and a prayer. There are too many lives at stake.

I have a question. If you are shaming an individual out of a school you know a crime took place are you not then obligated to report this crime lest you become complicit in it?

In order to determine and investigate these incedents in the best possible manner and present it to the local rabbonim, it is essential that we research our information as best as possible and present the facts. Anyone with information concerning 'alleged' abusers should pls contact his office at 718.853.9616. Once information is presented it will be thoroughly investigated and then brought to the attention of the local rabbonim.

For all those that are asking what about bochurim abusing bochurim etc let him take care of one problem at a time hopefully it will bring a stop to this completely. Also for that who said what about those that will be falsely accused there is a saying "innocent until proven guilty" and there will be a lot of information collected before someone is punished. All those that this applies to will think twice before doing and than not do they will need there respect.

His first step to tshuva would have been to ask for forgiveness from his victim! And who is destroying his family's life? Regarding the false accusation issue, kids (especially in our community, or children of a young age) are not naturally intelligent enough to create a well planned false accusation-without help from an adult accomplice- that will prove credible to experienced investigators. This is a fact. They are not creative enough to construct an elaborate story which they will stick to when cross-examined.

Now, to prevent an accusation like this from taking place, Melamdim should be aware and smart enough to look out for themselves, and make sure that they never end up with any child, that is not there own, in a place where they will be obscured from everyone. This is called in non-ignorant terms "having an alibi". Having an alibi is one of the strongest defenses in any criminal investigation. Think, is there any time or place a rebbi can or should possibly be with an underage student? no! This has to be a strict business-like approach. The rebbe teaches him, that's ALL. No rebbi should get to close to a young student in any way, it's not effective or necessary. Kids need to open up to parents, not rebbeyim. Their influence and authority are, or at least should be, very limited.

An allegation of abuse is so terrible, that we must err on the side of caution and suspend the rebbe from his position until it is fully investigated.

Before everyone starts howling at me - this is the standard with all proffessionals in position of authority. Policemen, doctors etc. are suspended (with or without pay - depending on the circumstance)as soon an allegation of serious misconduct is brought to light. Rebbe's should be treated the same way!

I know all about the presumption of innocence, but the risk to the alleged victim and to other members of the public is too high.

When someone is arrested on an allegation of a serious felony (e.g. murder), often the accused will not be released on bail simply to protect the public.

Those who are granted bail, are bound by strict terms to protect the public and the alleged victim.

The safety of the public and the risk of re-offending trumps the presumption of innocence! You may not agree but that's real life.

On VIN recently we have had open talk of abuse; in one case in Torah Temmimah there were/are many defenders. When after many years of back and forth the person finally pleaded guilty. Did we learn anything from this case? Nothing happened to the yeshiva or the perp. No Rabbonim came out with any Kol Korays how to deal with such accusations. But they have a new Kol Koray out about certain electronic players. They claim many kids have gone off because of these devices,
I wonder whether more kids have gone off because of abuse than anything else?

As a mother I am enlighted to hear that the community is waking up to this problem. My son was telling how his melamid is doing this and doing this to him. Kids are innocent, and being a mother to my child I knew what he refers too. Me and my husband went complaining to the menhal,,and after a while when I saw that nothing happens I demanded that my child be transfered out of this particular class, but this melamid stayed on and nothing was even done. I am glad to see that this is issue is on the front page..

What are the guidelines for his investigations, and is there a process for the alleged defender to defend himself? We need a transparent and independent process, not some hot head.

Chaimke @ 10:47 made reference to asking forgiveness and teshuvah. I’m sorry to tell you, but these two issues are so far down the road that they may never occur in the lifetimes of either the perp or the victim.

#1 – Any discussion about teshuvah is out of place here. Teshuvah only has significance in bein odom laMokom, and even if all were done properly, we mortals would never know. Furthermore, the halachos about bein odom lachaveiro involve the equivalent of restitution (returning stolen objects), and this is nearly an impossibility when the victim has had his/her innocence and emotional health torn away.

#2 – Forgiveness is not an event, asking, apologizing, and granting mechila. It is a process. Most perpetrators are clueless in how to ask for mechila. Dov listen to me you don't have to pander to the Rabbis on this issue and if any Rabbi comes out against you because of this issue I would not consider them a Rabbi that I would listen anymore
and I'm sure most regular normal frum yidden would do the same. It's bad enough that the Rabbonim have hushed this inyan up and swept it under the carpet all these years - for them to villify anyone finally coming forward and doing the dirty work would be biggest shunda and I for one would have second thoughts about anything they say. That brings up a very sensitive subject, are we maybe having too many kids, maybe more than we can emotionally support? I’m not by any means implying that the mother is to blame here in any way. If anything, she’s a hero in my book for talking about it on a public radio show. But, the question is, are we there for our children? A father of 10 kids, who after a hard day at work most likely does not have the mental capacity to truly pay attention to detail, how can we expect a child to approach such a father? Yes it occured to me. that's why a level headed person (i.e. rabbi, teacher, politician, friend or blogger) should tell the person to call 911. That is what I am telling anyone out there who is a victim. 911 is only the first step. If they need someone to talk to (which they will) they should find someone, either through community organizations or if needed the police will recomend services. if they want to speak to a trusted rabbi, that's fine, but first call 911. under no circumstances should the person who they have trusted counsel them to drop the charges. we don;t need politicians screaming on radio shows about molestors they wont even name. we need them telling all victims to go to the police and then seek counselling.

And another thing - hikind's JOB is to pass laws. One law currently sitting forever in Albany would require all schools in the state of NY to submit all employees through the state criminal background check. this would be something positive that he could do, but instead he thwarts those who are trying to get it passed.

Oh my go........ I checked this site out and put my zip ocde in and could not believe that there were a few "frum" jewish looking people that are a registered level 3 offenders.

I also typed in zip codes for other jewish areas and found at least two people per jewish neighborhood that are a level 3 offenders and the rest which were over 100 people per neighborhood.

This is what we know and people who are registered and how many we do not know about?

We were discussing this topic in the bungalow colony and it amazed me how many people said that just because people are a level 3 does not mean they are really guilty!

Most people around me were in disbelief that people can be so crazy into believing that a registered person is just a mistake.

Anyone that is registered is guilty 100% and in most cases people who admitted to their crimes.

That is true just like the state court system. The big difference is Beth Din has no real power
to impose their verdict. As the Kolco case proved beth Din was useless. This cannot be handles internally, just like the church could not deal with it internally.

Abuse can happen in Girls schools as well. I say this from experience. I was a victim/survivor of molestation by a very well known and liked teacher. As of yet, I do not believe there is a mechanism in place to handle a single call about a accused molester. As I understand, there is work ongoing to establish a system, and this work will include various Rabbonim that span the spectrum of segments of the frum community. As for asking Das Torah, my husband tried that route when my brother was molested by a well known molester. The molester calmly admitted his guilt to them. The rabbonim begged us not to turn him in. When my husband asked them how they intended to stop this pathetic piece of garbage from hurting the next kid, they had no answer.
With the help of one of the askanim in Boro Park, we turned him into to the s-- crimes unit in crown heights. Why Crown Heights? So that the big shots in Boro Park wouldn't pressure the 66th pct to release the pervert.

After all was said and done, alot of big shots did get involved and Mr.,,,, got 30 lousy days of house arrest. A night before his sentencing he attacked another boy whose father was too cowardly to turn him in.

My boys' school had a teacher accused of molestation. The school quietly suspended him with pay for several days. Using a top-notch children's psychologist, they determined that the molestation charges were true and fired him. He subsequently served time and is now on "megan's list". This argument of innocent until proven guilty and kids/parents using the system to ruin a teacher can be avoided by removing the teacher quitetly and carefully investigating the charges until it is somewhat clear the veracity of it. If abuse happened, it is almost 100% sure this is not the first one and the teacher needs to be removed immediately from contact with children.

And another rabbi told a boy who informed him that an adult had forced him to put his genitals in the man's mouth, "You'll get over it." And as a rosh yeshivah told my friend who was molested by the mashgiach in his yeshivah "it wasn't so bad". As for the other boy who was molested worse "We know about him, but he isn't coming forward to complain so we don't have to worry about him." Then there was the rosh yeshivah who told the therapist of a known molester that he doesn't need therapy because he would give him "torah therapy". These are all maysim shehayu.

EDUCATION -- parents talk to their children, introduce in school discussions FROM THE TORAH that would allow children to know when something is wrong. skipping the story of dina helps no one -- if children would be taught it, it would help the kids who'd been attacked (because they would say, Yaakov's daughter also had it happen) --and it would help those not attacked recognize an unhealthy situation. There are hundreds more of examples of teachable moments in Torah that would give us the open door to begin educating our kids. The fact that we skip it points to the influence of Christianity upon our Yiddishkeit (where certain subjects were taboo because of original sin). In other words, our frumkeit in not speaking is not frumkeit, but stupidity that makes our children vulnerable.
Lastly, there must be zero tolerance for molesters. Those who molest don't just do it to one person. There is a whole swath of lives such person ruins.

I don't think that perpetrators of sexual molestation should be protected but we do have a Torah to follow and there are certain Halochos regarding these issues. For a politician to take things into his own hands in order to get votes(or even if his intentions are Leshem Shomaiyim) is very dangerous. A few months ago I was called to a meeting in Lakewood and was shocked to see a group of the most respected Rabbonim together with a group of 30 Askonim. The agenda was raising money for a Beis Din that was put together a year before that. The Beis Din's spokesman offererd an overview of the mandate they were given and that is to investigate any claims of sexual abuse whether is is in a school setting, neighbors, bochurim or girls and to work to stop the abuse. R' Matisyahu salamon who is directly related and oversees the Beis Din spoke of horror stories here in Lakewood and abroad. No community is immune and only ones that are dealing with it in a professional way have and will be successful. They explained to us that not always is the legal way foolproof and a story was told of how a perpetrator was let loose because the legal system was not able to convict him whereas this Beis Din has been able to keep him in a self prescribed house arrest. There are many things that they do and this is not the forum to write about it but among a few things they do is to ankle braclet perpetrators sometimes requiring them to stay at home and warning them with legal action if they do not comply with the recommendations of going for professional help. They fund therapy sessions if necessary for the perpetrators and for the victims(in most cases if the victims are not properly treated they themselves will become perpetrators). The Beis Din is in constant contact with professionals in this field(to name one Dr. Pelcowitz) and they are getting constant education in this field. If I am not mistaken Lakewood has followed in the footsteps of the Chicago community after they set up such a system. We must remember that we have a higher authority to answer to,THE TORAH. Politicians have their own agenda and we Torah Yiddin need to stay away from these tactics. No one is saying that these people should go unpunished but there is a way to deal with them and not always is the legal system the right way to do it.

The individual who should get the most credit even when it still politically incorrect, is none other than UOJ. This person was advocating for many years about this issue. Only now have all the others jumped on UOJ's bandwagon. Better late than never.

Let's face it neither the legal or rabbinical way really works. What we need is a support group, made up of survivors who have healed to help the victims get through their ordeal and listen and determine which way to go. If legal is neccesary or would Rabbanim help. Me as a survivor would be willing to arrange a group like this. We could involve rabbonim and proffesional help as well. I will be speaking to a psychologist today and will be setting up a confidential website. I will keep you posted.

Parents and educators need to teach children that they can tell them anything, especially if someone is making them feel uncomfortable.

Children need to be taught this at a young age (4-8).

They need to be taught that there are adults who do bad things out there.

They need to be taught that they can tell parents, teachers and other safe people if someone does something that makes them uncomfortable.

They need to be taught that those people who they can tell parents about can even be teachers, rabbaim, brothers, uncles, aunts, friends of family, etc.

I caution parents from telling children that if anything ever happens they will do something bad to the person who does it. Firstly, you can not always follow through on that. Secondly, very often, it is with someone they have a close relationship with and may want to protect.

The secondary (and more devastating) trauma that children (and later as adults) have with sexual abuse is that they feel that they can not tell anyone, or if they do tell someone, their reports are discounted.

To all those who state that we should not presume someones guilt without proof. I fully agree. But, if there is smoke, I, for one, do not want the person watching or spending time with my children until the smoke is clear. Be dam L'caf Sechus, but, be safe and do not allow your children to be alone with him (or her).

Parents: Go home and talk to your children. Tell them that they can always talk to you about anything. Tell them that if an older person does something with them it is not their fault (you don't have to spell it out, it may sound silly to them now. But if the time ever comes, they will know what to do).

Halacha is clear. The result of being a molester is whatever the malchus dictates. Our community has no power to enforce or implement anything. We could create our own registry, but that would have the value of certain hechsherim – “not good enough for me”. We do not have the mechanism to track a molester through the system. He can change addresses easily, and the next yeshiva will not receive information about his history.

The prevailing psak din in our community is that a rebbe that is fired because of being a molester must be given two years salary (the estimate that it takes him to find another job). Think of the menahel that must hire another rebbe while paying one for not working. There is thus a financial incentive to not terminate a molester. That must change yesterday.

Everyone fears the shaming of someone until proven guilty. This is reasonable. However, we must develop a system that is halachically acceptable for determining such guilt. The poskim have already spoken about the issue of eyewitnesses, and the halachos are not with the same stringency of routine eidus in beis din. These piskei denim need to be publicized appropriately so that we do not have the foolish offhanded remarks such as “no penetration” or “who watched it happen”. The poskim I speak of are recognized, household name, renowned gedolim in Eretz Yisroel and America. B’ezras Hashem these tshuvos will be made public.

Among the worst issues in this whole parsha is the protection of individuals who are definitely guilty, and the allowing them to continue in chinuch or similar positions of risk. Dov’s project is proceeding slowly and carefully, and no one should get the idea that his passion for stopping the problem will lead him to do this recklessly. Much care is being taken to protect innocent, and every move will be with many Rabbonim guiding and supporting him.

One of the oldest & biggest yeshivas here in Spring Valley has an accused child molester working in the school. He was let go because of an investigation by the school, but then rehired within a month "because the school had to have rachamonos on him since he wasn't able to get any other job". He is a rabbi, volunteers on hatzolah, has a pirkei group for boys on Shabbos, runs a teenage group for boys, etc. In the majority of these child-molesting cases, the victim grows up to be the molester. This yeshiva is unable to get rid of this rabbi because he will blow the whistle on someone higher up than him, or may be the whole administration. Here in Monsey, child molestation is rampant. However, no one is about to do anything because it will harm the chances of getting a decent shidduch for their children! How sick is that? Generations and generations of sick men & women. No wonder Moshiach refuses to come!

While I agree that child molestation is a vicious crime and "can" be a very disturbing factor in a young mans life, I do not agree that this is a reason for a child to become "UPGIFORIN". If the fact would be that molested children become "UPGIFORIN" then we would have many many more children to worry about. I do believe that the compounding pressure of our community and the misdirection of what true "YIDISHKITE" is, is the main factor of children going off the "DERECH" of Hashem. I think "CHINUCH" should be taught to, rather love Hashem then fear him and the "UPGIFORIN" part would be much less frequent. A child embraces love a lot better then it faces fear. Our "CHINIUCH" must be corrected to solve this problem.
On the topic of issue, a parent should tell his/her children about the terrible things they should beware of. In a smart and cautious way should they inform them that there are people out there who are sick and want to spread their sickness amongst children by touching them in "NOT TZNIUS SPOTS" and if anyone is to do that to them they should tell the parent. We must inform them that there may be a chance that the predator will warn them not to tell, but that is normal for the bad person to tell them. They should not fear anybody's threat and report such abuse immediately. From time to time a parent must remind the child about the conversation they had and ask if there were any violators. Do not fear exposure since the exposure you give them is better learned from a parent rather then a predator.

But then I thought back to my own experiences, thank G-d none too serious, of being approached and attempted "touching". I remember hearing, from a prominent personality in this field, that passive and shy children are typically victims, not the outgoing ones, loud ones, etc.

I myself am a victim of a boy who vented to get even with me, so he went to the rabbe and told him that i did these kinds of things with other boys. He threatens me to "say the truth"... he told me that "he anyway known’s everything"... and the only way of getting away with be to plead guilty. He then gathered the whole yeshiva, and stated that for g-od's sake, everyone should stay far away from me, and not enter my dalit amos. There were constant meetings with all the roshe yeshiva, melamdim and menahalim. What to do with that devastating chote umachte. The rambam paskines, that a senhedrin who kills a parson more then ones in 7 years is called chovlanis. Although the sanhedrin were made up from the biggest tzadikid of the dor (and then there were a holy generation) and each and every step complied with the tore. I am wondering the way people are excited to kill people and ruin their families by believing all those things without any verification. I call out to everyone. Remember, when you believe such things without two eidus who have seen the actual story, (plus, the eidim must be investigated according to the haluche) you give a hand to murders. And you create the biggest mekatreg in haven upon you. (The court in haven will also believe what ever the mekatreg will say without any verification bemide sheudum moded, bo modeden lo [with the manner that a person judges, in the same manner he will be judged.
